Another letter was received from the Board of Public Instruction requesting a joint meeting with the Board of County Commissioners and the County Tax Assessor. The Board set a date at 2:00 P.M. Tuesday, May 24th in the School Board meeting Room and requested the Clerk notify them. A letter was received from Southern Gulf Utilities, Inc., together with a letter from Pan American Surety Company requesting an extension of the bond for Dixie Garden, Unit #3. Upon Motion made by Commissioner McCullers, seconded by Commissioner Hamilton andcarried, an extension was granted until May 4, 1961. The County Engineer stated that we needed a 15 foot right of way on 12th Street and U.S. #1 from Baumke. Upon Motion made by Commissioner Waddell, seconded by- Commissioner McCullers, and carried, the Board approved payment for this right of way up to but not more then $450.00. The County Engineer stated that Hobart Bros. had made application to the Trustees of the Internal Improvement Fund to build facilities for a boat dock and to dredge a channel in the Indian River and this would create about S small islands. After some discussion in the matter and upon Motion made by Commissioner McCullers, seconded by Commissioner Waddell and carried, the Board authorized the Clerk to write a letter to the Internal Improvement Fund with a copy of the letter to Corp of Engineers, stating that the bulkheading would be within the limits of our Bulkhead Law, but we would, however, prefer that the spoil from dredging the channel be placed on existing islands rather creating additional spoil islands as requested by Hobart Brothers. The County Engineer stated he had prepared a bid notice to advertise to buy radio equipment. .Upon Motion made by Commissioner McCullers, seconded by Commissioner Waddell, and carried, the Board authorized said notice be adver- tised for June 7th. Mr. James Kelly and his Attorney, Charles Sullivan appeared.before the Board and were informed that the re -zoning hearing had been held at 9:00 o'clock as advertised. Mr. Sullivan said they would like to be heard, even though they were late. The Board.informed Mr. Sullivan that he had not sent word that he would be late for the hearing, that they had denied the re -zoning and he would have ,to make a new application for a re -zoning of the property.
