z WORK ORDER NUMBER 6 SECTOR 3 CULTURAL RESOURCES SURVEY This Work Order Number 6 is entered into as of this 8th day of September , 2009 pursuant to that certain Continuing Contract Agreement for Professional Services entered into as of December 13 , 2005 ("Agreement") , by and between Indian River County, a political subdivision of the State of Florida ( " COUNTY ") and Coastal Technology Corporation (" CONSULTANT ") , The COUNTY has selected the Consultant to perform the professional services set forth on Exhibit 1 , attached to this Work Order and made part hereof by this reference . The professional services will be performed by the Consultant for the fee schedule set forth in Exhibit 2 , attached to this Work Order and made a part hereof by this reference . The Consultant will perform the professional services within the timeframe more particularly set forth in Exhibit 2 , attached to this Work Order and made a part hereof by this reference all in accordance with the terms and provisions set forth in the Agreement . Pursuant to paragraph 1 . 4 of the Agreement , nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein . Fell , ssistant`County orn EXHIBIT I Indian River County an Sector 3 Cultural Resources Survey Scope of Work Sector 3 Beach and Dune Restoration Project Cultural Resources Survey Introduction : The State Historic Preservation Officer ( SHPO) at the Florida Division of Historical Resources in Tallahassee has requested a formal Phase I Cultural Resources Survey be conducted for the proposed Sector 3 Beach and Dune Restoration project area, in accordance with Chapters 267 and 373 Florida Statutes and Florida ' s Coastal Management Program for possible impacts to historic properties (archeological or historic sites) listed in or eligible for listing in the National Register of Historic Places or otherwise of historical, architectural or archeological value ( see attached SHPO letter) . Since receipt of the SHPO request, the Project Area has been sufficiently delineated in collaboration with regulatory agencies to now warrant performance of the requested survey, for which the following describes the services to be provided by COASTAL TECH via subcontract with FLORIDA ARCHEOLOGICAL SERVICES , INC . (FAS ) under this Scope of Work : Task I : Cultural Resources Survey General : In general, a Phase I Cultural Resources Survey of the Area of Potential Effect (APE) will be conducted using current SHPO/professional standards and guidelines . The survey will include a terrestrial phase and non-terrestrial (marine) phase archeological survey of the APE . Task Ia — Terrestrial Investigations : FAS will conduct the terrestrial portion of the survey which will include investigation and evaluation of sites within or in close proximity to the APE, including : ( 1 ) previously recorded "target" sites as listed in Table 1 below, and (2) areas of High Archeological Probability adjacent to Selected Portions of the Project Area that may contain unrecorded archeological sites . The Selected Portions of the Project Area which may contain unrecorded archeological sites "up hill " of the proposed beach dunes include six (6) "Construction Access/ Staging Areas" (Treasure Shores Beach Park, Turtle Trail Beach Access, etc) depicted as black- hatched areas Page I of 2 August 20, 2009 Indian River County Sector 3 Cultural Resources Survey Scope of Work on the attached COASTAL TECH exhibits titled, "Exhibit — SHPO Historical Sites" ( Sheets 1 - 3 ) . For these Selected Portions of the Project Area, FAS will conduct a Phase I level study to include : ( 1 ) "Judgmental Testing" in areas deemed by the Field Archeologist to likely contain unrecorded sites, (2) assessment and evaluation of all cultural resources (archeological and/or historic sites) for significance in accordance with National Register Criteria (36CFR60 . 4) (3 ) CRM (Cultural Resource Management) recommendations in accordance with SHPO Procedures for the Protection and Enhancement of Historic and Cultural Properties ( 36CFR800) . Task Ib — Non-Terrestrial (Marine) Investigations : The non-terrestrial (marine) phase of the survey will address the nearshore region and proposed pipeline corridors of the Project Area and shall include : The phase survey will use current professional standards and guidelines and will be completed to current SHPO standards . The non-terrestrial ( marine) investigations will consist of the following : ( 1 ) Phase I Remote Sensing Survey - including : (a) Magnetometer Survey (b) Side- Scan Sonar Survey (c) Sub-bottom Profiler Survey (d) Recordings via real time depth and position via Differential Global Positioning System (DGPS ) (2) diver ground-truthing of existing marine Archeological Sites and any new sites to assist with the determination of significance per National Register Criteria (36CFR60 . 4), and (3 ) laboratory/office analysis of all remote sensing and diver collected data. Task lc — Final Report : FAS will prepare a DRAFT Final Report to be submitted to COASTAL TECH and the COUNTY for review . FAS will incorporate any revisions required by the County or COASTAL TECH . FAS will provide to COASTAL TECH five (5 ) hard-copies of the Final Report with a digital copy in " pdf' format on CD . The Final Report will then be forwarded by COASTAL TECH to the SHPO . FAS will informally confer with the SHPO to ensure expeditious review and acceptance of the Final Report . The Final Report will meet SHPO ' s requirements and will be completed in accordance with the requirements of Chapter 1A. 46 Florida Administrative Code , as well as Procedures for the Protection and Enhancement of Historic and Cultural Properties (36CFR800) . Task Id — Agency Coordination : COASTAL TECH will coordinate with FAS , SHPO and the U. S . Army Corps of Engineers (USACE) to facilitate review and acceptance of the Cultural Resources Survey for the purpose of obtaining written SHPO concurrence, which is required by the USACE . The State Historic Preservation Officer is to advise and assist state and federal agencies when identifying historic properties, assessing effects upon them, and considering alternatives to avoid or minimize adverse effects. Our review of the Florida Master Site File and our records indicates that the South Borrow Area has been surveyed (Submerged Cultural Resource Investigation Report Indian River County Beach Preservation Plan). In order to avoid adverse effects to cultural resources, a protective buffer zone of at least a 500400t radius should be established around the magnetic anomalies CO2 and CO 5 identified within the proposed South Borrow Area and the Golden Quest # 1 shipwreck (818860) . Our review also indicates that archaeological sites 81822, 81831 , 81R56, 818438 , and 818818 are recorded within, or in close proximity to, the area for beach restoration. Also , many historic shipwrecks (81828 , 81846 , 81847, and 81R855) are recorded offshore (see enclosure) . None of these sites have been evaluated for significance and professional archaeologists have never systematically surveyed the area. Therefore, it is the opinion of this office that a Phase I cultural resources survey should be conducted for the proposed beach renourishment area. The survey should include terrestrial subsurface testing and utilize the following modern remote sensing technology: magnetometer data, side-scan sonar data, depth recorded capabilities, and sub-bottom profiler. The remote sensing data should be real-time correlated with Differential Global Positioning System data. Ari accredited nautical archaeologist with experience in the operation of remote sensing instrumentation and specific knowledge of Florida' s maritime history should direct the survey. Divers with specific training in underwater archaeological techniques should groundAruth all anomalies that may indicate a potential significant cultural resource. The resultant survey report shall conform to the specifications set forth in Chapter 1A46, Florida Administrative Code. The report must be forwarded to this agency prior to initiating bottom or ground disturbing activities in order to complete the review process . The results of the investigations will determine if significant historic properties would be disturbed by this project . In addition, if significant remains are located, the data and consultant' s conclusions will assist this office in determining measures for avoiding, minimizing, or mitigating adverse affects to historic properties listed, or eligible for listing in the NRNP, or otherwise of historical or architectural significance. Because this letter and its contents are a matter of public record, consultants who have knowledge of our requests may contact the applicant or the applicant' s agent . This should in no way be interpreted as an endorsement by this agency. The Division of Historical Resources does not maintain a list of professional archaeologists who are qualified to work in the State of Florida and/or who meet the Secretary of the Interior ' s Standards for federally involved archaeological projects as specified in 36 CFR 61 , Appendix A. However, the Register of Professional Archaeologists (RPA) maintains a membership directory that may be useful in locating professional archaeological consultants (<httv ://www.pranet.orWabout.hLm>) who work in the area. Many qualified archaeologists are not members of RPA and omission from the list does not imply that an archaeologist does not meet the Secretary' s Standards or that work would not be acceptable. Likewise, inclusion on the list is no guarantee that an archaeologist' s work will automatically be acceptable.
