meeting of said Board in the In-
dian River County Courthouse, Vero
Beach, Florida for sale to the Coun-

RESOLUTION
BE IT RESOLVED by the Board of County Commissioners of
Indian River County, Florida, that this Board does herewith find and deter -

1. That Orchid island Development Company, a Florida
corporation, on the 21st day of June, 1960, at a meeting of said Board, has
filed.a Petition before this Board, requesting this Board to adopt a resolution
closing, vacating and abolishing that part of the public road, street, and
right of way lying between the Indian River and Lot 204 of the plat of Orchid
Island, Unit No. 1, as recorded in Plat Book 4, page 3, Indian River County
public records.
2. That this Board has published two weeks notice thereof
one time in the Vero Beach Press Journal, a newspaper of general circula
published in Indian River County, Florida, said notice being published at
least two weeks prior to the date stated therein for such public hearing.
3. That said part of the public road, street and right of way
above described is not a State or Federal road and is not maintained by the
State of Florida and is not located within the incorporated limits of any
municipality and is located in Indian River County, Florida.
4. That a public hearing thereon has been held by the Board
of County Commissioners of Indian River County, Florida, in the offices of
said Board in the Indian River County Courthouse, Vero Beach, Florida,
on July 19, 1960, at 10:00 o'clock A. M.
BE IT FURTHER RESOLVED that this Board does herewith
close, vacate and abolish that part of the above described public road and
right of way and all portions thereof and does herewith renounce and discla
any right of Indian River County, Florida, and the public in and to all of
said part of the public road, street and right of way above described.

Mr. McCullers, Mr. Waddell and.Mr. Hamilton all went along with this
and further stated they thought the County would do better to leave this
service on a competitive basis.
Robert Jackson then stated they would go along with a non-exclusive
franchise.
After some further discussion in the matter Commissioner Macdonald
made the following Motion: This matter needs further consideration and
suggest that the County Attorney be requested to draw up some operating
rules for consideration by this Board and these applications be tabled until
such time as the County can arrive at some rules as far as the County is
concerned for the granting of non-exclusive franchises. Request that the
three parties interested in such a franchise give the County Attorney their
views in writing on what they think are reasonable rules and regulations
for anon -exclusive franchise, and that the County hold a further hearing
on this matter in October. Motion was seconded isy Commissioner Waddell
and unanimously carried.

the centerline of Old Dixie. He stated he would give this right of way

would request they give hen this material in exchange for the right of way.

such change had been effected. The Board informed i,,ir. Fletcher tnere was
nothi.n , tthey could do for him.
The Attorney for the Board stated he had received the neaps from the
State Road Department for the connecting roads between New 1". S. #1 and
Old l;. S. #1 and noticed they were set up for 100 feet right of way. After
some discussion the Board authorized the attorney proceed with the Title
Search and when the County Engineer gets back have him see about getting
the right of way cut to 70 feet instead of 100 feet.
The Attorney for the Board stated he had been requested by the Board
to see whether or not the Board had the power had the power to adopt re-
gulations prohibiting motels from putting up price signs. he stated he
had looked into the matter and that the Board does not have this authority.
Rosemary Richey, Supervisor of Registration appeared before the Board
and stated she would like to have her salary increased. After considerable
discussion in the matter and upon ?notion made by Commissioner Waddell,
seconded by Commissioner Macdonald and unanimously carried, the foliow inq;
Resolution was adopted:
That the Salary of the Supervisor of Registration, effective Jctocer
1, 1960, be established at $3000.00 per annum payable in monthly irnstall-
ments, with the view that the ?�oard intends to establish the salary of
the Supervisor of Registration in direct rat.:..o to tr.e total number of
registered voters or the County, and that hereafter the Supervisor's
salary will be increased or decreased at the rate of $300.00 per year
for each one thousand registered voters or major fraction thereof to be
computed as of June 30th each year, above the total of nine thousand
until the Supervisor's salary reaches the total sLmi of $4,000.00 per
year, then the matter will be reconsidered.

'Where an above ground storage of gasoline, petroleum
oils or similar inflammable fluids are permitted, then
as to any such facility for storage for a capacity in
excess of 500 gallons, there shall be erected and maintained
a diked area surrounding it. The volume within the diked
area shall be one and onesfourth times the volume of any
above ground storage tanks. The minimum width of any earth
dike at the top shall be four feet wide, sloped to an appro-
priate angle of repose and shall be capable of containing
the liquid for a minimum of two days. The minimum heights of
dikes shall be 3 feet. Other approved dikes constructed of
concrete or other material shall e permitted. The provisions
hereof shall not permit the erection of any structure (including
dikes) outside of the limits of the set back line of any zone.''

Upon Motion made by Commissioner McCullers, seconded by Commissioner Iaamilton
and carried, public hearing before the Zoning Board was ordered.
A recommendation by the County Engineer was read whereby the subdivider
of Heritage Estates will pave 12th street from 20th Avenue to the West
boundary of his subdivision, same being approximately 1000 feet, if the County
will use their equipment to grade the sub -grade and pack the limerock sur-
face feady for surfacing. Upon Motion made by Commissioner McCullers,
seconded by Commissioner Hamilton and unanimously carried, the Board
agreed to go along with this.
A note was read from the County Engineer with regard to the signing
of the final plat of Summer Place Subdivision, and upon Motion made by
Commissioner Waddell, seconded by Commissioner McCullers and carried, the
following Resolution was adopted:
That the Board authorizes the County Engineer sign Unit #1 of
Summer Place Subdivision, changing the single lot and alley easement as
park area to 2 lots plus an alley easement; also there shall be a 70 foot

connecting to the existing road in Oceanaire Heights Subdivision.
A discussion was held as what to do about the land recently purchased
from Daphne Strickland. Upon Motion made by Commissioner Macdonald, seconded
by Commissioner Hamilton and carried, it was ordered that the house on the
corner should be advertised for sale to be removed from the property. Said
bids to be opened at the September 6th meeting. The Board also requested
the C^unty Engineer have some of the men at the barn put rolled roofing on
the small house and then let the Custodian rent the house for $40.00 per
month.
A Resolution was received and ordered filed dissolving the Atlantic -
Gulf Special Road and Bridge District. A check in the amount of $304.21
was received representing this county's share of the balance of the funds
of this Board. Upon Motion made by Commissioner McCullers, seconded by
Commissioner Macdonald and carried, the Clerk was instructed to deposit
said funds in the Road & Bridge Fund.
A deed from the Board of Public Instruction to the County, conveying
one acre of land in Oslo was received and upon Motion made by Commissioner
McCullers, seconded by Commissioner Waddell and carried, the Clerk was
ordered to put said deed of record.
A letter was received from Charles G. Palmer requesting permission
from the Commissioners to allow water service from Vero Beach city owned
mains to lots on 35th Ave. located in the County. Upon Motion made by
Commissioner Waddell, seconded by Commissioner McCullers and carried,
the Clerk was instructed to write Mr. Palmer giving this permission and
copy of said letter to be sent to the City Manager.
The several bills and accounts against the County, having been
audited, were examined and found correct, were approved and warrants issued
in settlement of same. Such bills and accounts being on file in the Office
of the Clerk of the Circuit Court, the warrants so issued from the re-
spective funds being listed in the Supplemental Minute Book as provided by
the rules of the State Auditor, reference to such record and the list so
recorded being made a part of these minutes.
The County Depositories filed their monthly statement, showing re-
ceipts and disbursements of the various funds, which have been audited and
found to be correct.
There being no further business, on motion made, seconded and carried,
the Board then adjourned.
