This Modification is made and entered into by and between the State of Florida , Department of Community Affairs, ("the Department") , and Indian River Countv , (" Recipient") , to modify DCA Contract Number 03DB-1Awl 0-40=01 -H12 , dated January 29, 2003 , ("the Agreement") . WHEREAS , the Department and the Recipient have entered into the Agreement, pursuant to which the Department provided a grant to Recipient under the Small Cities Community Development Block Grant (" CDBG ") Program of $ 750 , 000.00 ; and WHEREAS , the Department and the Recipient desire to modify the Agreement by extending the project' s completion deadline date . NOW, THEREFORE , in consideration of the mutual promises of the parties contained herein , the parties agree as follows : 1 . The term of the Agreement is extended so that its termination date is now July 28 , 2005 for all intents and purposes . 2 . The Scope of Work to this Agreement , is hereby modified as set forth in the Revised Activity Work Plan , which is attached hereto and incorporated herein by reference. 3 . The Department and Recipient agree that the Agreement shall henceforth be governed by the provisions of Rule Chapter 96-43 , Florida Administrative Code , as modified and effective March 28 , 2002 . 4 . All provisions of the Agreement being modified and any attachments thereto in conflict with this Modification shall be and are hereby changed to conform with this Modification , effective as of the date of the execution of this Modification by both parties . 5 . All provisions not in conflict with this Modification remain in full force and effect , and are to be performed at the level specified in the Agreement .
