Mr. William Kaser was recognized and stated he had applied for the rezoning to C-1 Commercial for the reason that he had a commercial building on the property prior to zoning and under the present zoning would not be able to enlarge or even build back in case of a fire. There were none present against the proposed rezoning. MotiOn was then made by Commissioner Mac- donald, seconded by Mr. Waddell and unanimously carried that the change for Item #6 be allowed. Item #1 of the Notice was then discussed and Mr. Van Ausdale who requested the rezoning was present and stated their plant and other install- ations were located on these lands and would therefore like to have them rezoned to.M-1-A, restriced Industrial. As there were none present against the rezoning, Motion was made by Commissioner Waddell, seconded by Commissioner Hamilton and unanimously carried, for the rezoning as set forth in Item #1. Item #2 of the Notice was then discussed and Mr. Van Ausdale stated these were the lands they were now mining and would mine in the future. Bob Jackson, Attorney for Mr. W. E. Kelly who owns lands surrounded by those to be rezoned voiced an objection on the ground that,his clients land was presently zoned R-3 transient District and had in mind some day to put up motels on" his land and did not like the idea of the land surround- ing his to decrease -,in zoning and did not like the idea ofmining so close ;i to his property. Mr: Van Ausdale stated that the land Mr. 'Jackson referred to and that of his surrounding was not nothing but marsh land and the best way to recover this land was to mine same. He further stated the land was surrounded by colored property and would not be a very good site for a`motel. After some further discussion in the matter, Motion was made by Commissioner Waddell, seconded by Mr. Macdonald and carried, for the rezoning as set forth in Item 2 of the Notice. Item #3 was then discussed which is a proposed paragraph, -.to be added under Section 7, F-1 Agrigultural District, which said paragraph has to ' do with mining. Mr. Jackson also objected to this paragraph being added to the Resolution stating that the Board should obtain a performance bond from anyone mining the.lands to see that the land was placed in a livable condition.
