WHEREAS, the Department and the Recipient entered into the Agreement, pursuant to which the Department provided a grant of $ 75500,000 . 00 to the Recipient under the Disaster Recovery Initiative Community Development Block Grant ("CDBG") Program as set forth in the Agreement; WHEREAS, the Department and the Recipient desire to modify the Agreement; NOW, THEREFORE, in consideration of the mutual promises of the parties contained herein, the parties agree as follows : 9 Reinstate Agreement 1 . Austin, Enclosed, please find an amendment #4 package for the above referenced grant. This amendment requests the following : • A six month time extension. This time extension request will extend the contract ending date from February 19, 2008 until August 19, 2008 . • A decrease in the budget for Phase I of the Wabasso water line project from $650,000. 00 to $555 ,083 . 50 ; a difference of $94,916 . 50 . • A decrease in the budget for Phase II of the Wabasso water line project from $ 175 ,000. 00 to $ 115 , 844. 50; a difference of $59, 155 . 50 . • A decrease in the budget for the reconstruction of Fire Station #4 from $2, 182,645 .00 to $2, 130,096.03 ; a difference of $52 , 548 . 97 . • An increase in the budget for the Rockridge sewer project from $3 ,970,404 . 00 to $4, 177,024. 97 ; a difference of $206,620. 97. Both the Oslo fire station replacement project and Phase I of the Wabasso water line project are now complete, while the Rockridge Sewer project is under construction, and a contract for Phase II of the Wabasso water line project has been awarded. At this time, the County is requesting an additional six (6) months to complete the construction of the CDBG DRI project due to unforeseen delays with the Rockridge Sanitary Sewer project and the expansion of the West Wabasso water line project. With respect to the Rockridge Sewer project, that project has been delayed due to circumstances beyond the County' s control. The delay has been associated with the County' s FEMA Hazard Mitigation Grant Program (HMGP) application. To fully fund the Rockridge Sewer project, the County had planned to utilize HMGP funds in conjunction with CDBG Disaster Recovery Initiative program funds. The County, however, has been unsuccessful in obtaining approval from the Division of Emergency Management (DEM) and FEMA for HMGP funding. In fact, the County recently received a letter from FEMA rejecting the HMGP funding request because the county had begun construction of the project prior to FEMA' s authorization for initiation of construction. The County has since filed an appeal with FEMA. Recently, the County requested assistance from the CDBG Disaster Recovery Initiative grant management group to reverse the FEMA-HMGP management team' s denial of funding for the project. Even though the County has to date been unsuccessful in securing HMGP funding, the County has progressed with the sewer project. In June 2007, the County issued a "Notice to Proceed" for construction of the Rockridge vacuum sewer system project. Currently, the project is approximately 60% complete. With regard to Phase lI of the Wabasso water line project, that project was included as a new activity in grant Amendment #2 . Recently, the County awarded a contract to construct the project, held a preconstruction conference, and issued a "Notice to Proceed" to the contractor to begin construction.
