EAGLE TRACE SUBDIVISION, PHASE 2 and PHASE I REPLAT
AMENDMENT NO. 1 TO THE PROFESSIONAL ENGINEERING SERVICES
AGREEMENT BETWEEN W. F. MCCAIN & ASSOCIATES , INC . AND INDIAN RIVER
COUNTY, FLORIDA
This is an amendment to the existing Engineering Services Agreement (AGREEMENT) dated
April 8 , 2008 between W . F . McCain & Associates , Inc . (ENGINEER) and Indian River County
( COUNTY) . This amendment addresses changes in " Section III — Scope of Services " and
" Section V — Compensation" of the AGREEMENT .
Amendment Description
" SECTION III - SCOPE OF SERVICES " is being modified to incorporate the following :
The ENGINEER agrees to perform professional engineering and related services in
connection with the project as required and set forth in the following :
ENGINEER shall provide additional engineering services associates with the assessment of
damaged pavement sections in both Phases I Replat and Phase II of the Eagle Trace project
not initially anticipated in the original contract scope .
ENGINEER shall provide the necessary inspection services associated with ongoing
roadway repair work outlined above not initially anticipated in the original contract scope .
ENGINEER shall provide a final inspection and recertification of the Eagle Trace Phase
Replat paving and drainage .
" SECTION V — COMPENSATION " is being modified to incorporate the following :
The COUNTY agrees to pay and the ENGINEER agrees to accept for services rendered
pursuant to this Agreement fees inclusive of expenses in accordance with the following :
The basic compensation mutually agreed upon by the ENGINEER and the COUNTY is
as follows :

This AGREEMENT , regardless of where executed , shall be governed by and construed
according to the laws of the State of Florida .
IN WITNESS WHEREOF the parties hereto have executed these presents this
17th day of March , 2009 .
