HomeMy WebLinkAbout2008-056AMENDMENT AND EXTENSION TO WETLAND MAINTENANCE SERVICES AGREEMENT This AMENDMENT AND EXTENSION TO WETLAND MAINTENANCE SERVICES AGREEMENT ("Amendment') is entered into as of this 19th day of February 2008 ("Effective Date"), by and between INDIAN RIVER COUNTY, a political subdivision of the State of Florida ("County") and ECOTECH CONSULTANTS, INC. ("Consultant'). BACKGROUND RECITALS A. Effective May 1, 2005, the County and the Consultant entered into the WETLAND MAINTENANCE SERVICES AGREEMENT ("Agreement') for the provision of wetlands maintenance services as set forth therein. B. Pursuant to paragraph 3 of the Agreement, the County may request that the Consultant perform additional services under the Agreement. C. Further, the County and the Consultant desire to extend the term of the Agreement as set forth in paragraph 6.1 for the first of the three (3) allowable renewals of one (1) year each. NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. The background recitals are true and correct, and form a material part of this Agreement. 2. From and after the Effective Date of this Amendment, paragraph 3 of the Agreement is amended to include the Services as more specifically set forth in Exhibit 1, for the price set forth in Exhibit 1. 3. From and after the Effective Date of this Amendment, the term of this Agreement is extended though April 30, 2009. 4. All remaining terms of the Agreement, not herein amended, shall remain in full force and effect. B' don,.Q6rK;7FCourt By Deputy Clerk Cr Q w Z 0 Z 10 U 'J ti G 1 1 N a z as a EXHIBIT 1 ATTACHMENT SCOPE OF SERVICES This Amendment provides for completion of a detailed restoration plan for three (Earman Island, Duckhead Island, and Hogshead Island) of the Lost Tree Islands as per permitting responses provided to FDEP, and for restoration of approximately six acres currently covered by Australian pine and/or Brazilian pepper on either Earman Island or Duckhead Island to comply with an existing U.S. Fish & Wildlife grant. A brief description of the scope of services is provided below: Task 1. Lost Tree Restoration Plan Ecotech Consultants, Inc. will assist the County with the preparation of a detailed restoration plan for Lost Tree Islands as described above. The plan will include proposed contour elevations, a generalized soil balance, areas to be cleared and the process for removing and disposing of the cleared material, the general location of the plant communities to be created in the cleared areas, planting specifications for creating the selected plant communities, and a proposed recreational plan for the three islands. Ecotech Consultants, Inc. will assist the County with presenting the draft plan to the public and regulatory agencies for the purpose of soliciting comments and approval. Ecotech Consultants, Inc. will modify the restoration plan to reflect comments received from the public and regulatory agencies as necessary. The deliverables for this task will be a set of plans and specifications that can be used as the basis for restoring the three islands. The restoration plan will be designed to include discrete sub -sectional areas that could be restored as part of a mitigation project by a third party for a local project. Task 2. Shoreline Restoration Project Ecotech Consultants, Inc. will restore six acres land currently covered by Australian pine and/or Brazilian pepper on either Earman Island or Duckhead Island. The cleared areas will be re - vegetated using salt marsh or mangrove species when necessary. The deliverables for this task will include a map showing the areas cleared, and the type, general location, and density of plants used to re -vegetate the cleared areas. Page 1 of 3 ATTACHMENT 2 PROJECT BUDGET Ecotech Consultants, Inc. proposes to complete the Scope of Services described in Attachment 1 for the amount of $102,954.00. A breakdown of the costs for each task is shown below. Task Budget Lost Tree Restoration Plan $535809.00 Shoreline Restoration Project $49,145.00 ADDITIONAL SERVICES The cost to complete work not included in the Scope of Services as described in Attachment 1 will be billed at the hourly rates shown below. Direct charges for additional services will be billed to the County at their actual value. The time needed to complete each of the tasks described in Attachment 1 by Ecotech Consultants, Inc. and the County can be reasonably estimated as shown below with the limitation that neither the County nor Ecotech Consultants, Inc. can control the phase of the permitting process controlled by the Florida Department of Environmental Protection, the St. Johns River Water Management District, or the U.S. Army Corps of Engineers.
