HomeMy WebLinkAbout2004-291 . ` h WORK ORDER NUMBER 1 -� 4 This Work Order Number 1 is entered into as of the 16th day of November , 2004 , pursuant to that o Lf - Zct certain Wetland Operation and Maintenance Contract Agreement for Professional Services entered into as of August 12 , 2003 ("Agreement") , by and between Indian River County, a political subdivision of the State of Florida ("COUNTY") and Ecotech Consultants , Inc . (CORPORATION) , a Florida corporation ("CONSULTANT") . The COUNTY has selected the CONSULTANT to perform the professional services set forth in Attachment 1 , attached to this Work Order and made a part hereof by this reference . The professional services will be performed by the CONSULTANT for the fee schedule set forth in Attachment 2 , attached to this Work Order and made a part hereof by this reference . The CONSULTANT will perform the professional services within the timeframe more particularly set forth in Attachment 3 , attached to this Work Order and made a part hereof by this reference all in accordance with the terms and provisions set forth in the Agreement. Pursuant to paragraph Article 9 of the Agreement, nothing contained in any Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein . Should permitting be denied for any reason , or should the project be deemed unfeasible for any reason , then the County may terminate the Work Order, and pay CONSULTANT for services rendered to date . Baird, County Administrator pproved as to form andJe al s Iiciency : Assista t County Attorney ATTACHMENT 1 INDIAN RIVER UTILITIES DEPARTMENT NORTH COUNTY BRINE DISPOSAL SCOPE OF SERVICES This Scope of Service covers work to be performed by the Ecotech Consultants, Inc . consulting team for the Indian River County Utilities Department related to design and permitting of a 60 acre wetland site for disposal of the brine water discharged from the North County Water Treatment Facility. The project site is contiguous with the Indian River and is located just north of the North Relief Canal , see Attachment 4 for a general location map . The project site previously was drained by ditches for mosquito control and to drain the citrus groves west of the site . The site currently is isolated from surrounding lands by drainage ditches . The western portion of the project site will be developed into an emergent salt marsh community for the purpose of dispersing the brine water across the project site . The brine water will be mixed with water from the Indian River prior to discharge to the project site . This work is being proposed in response to Florida Department of Environmental Protection permitting conditions that require the County to cease discharge to the Indian River. The proposed wetland site will provide the County with a long term disposal option for the brine water that also supplements the existing brine reuse project currently under construction . The County will act as the Engineer of Record for this project, and will provide survey data as may be necessary to complete the permits for this project . The work associated with this Scope of Services has been broken down into a series of eleven primary work tasks . A description of the work to be performed under each task is presented below . Task 1 . Site Analysis Ecotech Consultants , Inc . (ETC ) will complete an environmental site assessment (ESA) for the project site . The purpose of the ESA will be to assimilate information needed to address the anti - degradation issues associated with the Florida Department of Environmental Protection (FDEP ) Construction and Environmental Resources permits , and the U . S . Army Corps of Engineers (USACOE) Section 404 permit . This information may include a historical analysis of the project site, a landscape analysis , a review of site topography (topographic and boundary survey to be provided by the County) , a flood-tide line analysis, assimilation of surface water data, assimilation of ground water (may include the installation of two shallow wells , one east and one west of the western site boundary) , an analysis of existing stormwater management system on- site and adjacent to the site, and a wildlife survey. This information will be compiled into a summary report . Two copies of the summary report will be provided to the County. Task 2 . Water Quality ETC will compile existing data from the North County Water Treatment Plant relating to the R . O . waste stream, the Indian River, and where possible for adjacent ditches (including the North Relief Canal) . ETC will collect water samples in the ditches contiguous with the project site . These samples will be analyzed for total dissolved solids , heavy metals (As , Pb , Hg, Ag, Cd , Cr, Ni , and Cu) , herbicides , pesticides , total nitrogen , and total phosphorus . ETC will use the water quality data to develop a chemical profile of the R. O . waste stream from the North Plant through the wetland system to the Indian River . This analysis will be used to determine the volume of water from the Indian River needed to dilute the R. O . waste stream . This information will be compiled into a summary report . Two copies of the summary report will be provided to the County. Task 3 . Site Plan & Design ETC will assist the County with the preparation of the construction drawings for the wetland site Specifically, ETC will provide the County with draft drawings providing the following information : ❖ Site layout ; ❖ Hydraulic profile (site boundary and topographic data to be provided by the County) ; ❖ Cut and fill cross- sections through the construction areas within the wetland ; ❖ Boardwalk design details ; ❖ Pump station details for pumping water from the Indian River on- site ; ❖ Details of the water distribution system on the wetland site ; and ❖ Vegetation planting plan . One copy of the draft drawings (hard copy and electronic format) will be provided to the County for review . ETC will modify the drawings as appropriate in response to comments received from the County, after the County completes their review of the draft drawings . ETC will provide the County with one copy (hard copy and electronic format) of the drawings . Task 4 . FDEP Construction Permit ETC w ill a ssist t he County with t he p reparation o f t he F lorida D epartment o f E nvironmental Protection (FDEP) construction permit application . One copy of the draft application will be provided to the County for review . ETC will modify the draft application as appropriate in response to comments received from the County, after the County completes their review of the draft application . ETC will provide the County with one copy of the construction permit application for review and signature . The County shall be responsible for all permit fees associated with the FDEP construction permit application . ETC will meet with FDEP staff on- site to inspect the site conditions . ETC will conduct a pre - application meeting with FDEP staff in Orlando , and will meet one additional time with FDEP staff in Orlando to discuss the construction permit application, if necessary. ETC will assist the County with preparation of responses to requests for additional information (RAI) letters received from the FDEP for the construction permit application . This assistance shall be limited to two FDEP RAI letters . Task 5 . Agency/Public Support ETC will assist the County with gaining public and regulatory agency support for the project . This assistance may include meetings , public workshops , preparation of presentations , and on- site visits . ETC will solicit written support of various public and regulatory agencies as may be necessary to augment the permit applications submitted to the Florida Department of Environmental Protection and the U . S . Army Corps of Engineers . Task 6. Environmental Resource Permit ETC will assist the County with the preparation of the Environmental Resource Permit (ERP) application . One copy of the draft application will be provided to the County for review . ETC will modify the draft application as appropriate in response to comments received from the County, after the County completes their review of the draft application . ETC will provide the County with ten copies of the ERP application for review and signature . The County shall be responsible for all permit fees associated with the ERP . ETC will meet with Florida Department of Environmental Protection (FDEP ) staff on- site to inspect surface water and vegetation conditions . ETC will conduct a pre- application meeting with FDEP staff in Orlando , and will meet one additional time with FDEP staff in Orlando to discuss the ERP application, if necessary. ETC will assist the County with preparation of responses to requests for additional information (RAI) letters received from the FDEP for the ERP application . This assistance shall be limited to two FDEP RAI letters . Task 7. U. S . Army Corps of Engineers Permit ETC will assist the County with providing supplemental information needed to complete the Environmental Resource Permit (ERP) application for the U . S . Army Corps of Engineers (USACOE) . One copy of the draft application will be provided to the County for review . ETC will modify the draft application as appropriate in response to comments received from the County, after the County completes their review of the draft application . ETC will provide the County with ten copies of the supplement information required by the USACOE for review and signature . ETC will meet with USACOE staff on- site to inspect surface water and vegetation conditions . ETC will conduct a pre-application meeting with USACOE staff in the Merritt Island office, and will meet one additional time with USACOE staff in the Merritt Island office to discuss the ERP application, if necessary. ETC will assist the County with preparation of responses to requests for additional information (RAI) letters received from the USACOE for the ERP application . This assistance shall be limited to two USACOE RAI letters . Task 8 . Consumptive Use Permit ETC will assist the County with the preparation of the consumptive use permit (CUP ) application . One copy of the draft application will be provided to the County for review . ETC will modify the draft application as appropriate in response to comments received from the County, after the County completes their review of the draft application . ETC will provide the County with one copy of the CUP application for review and signature . The County shall be responsible for all permit fees associated with the CUP . ETC will meet with St . Johns River Water Management District (District) staff on- site to inspect surface water conditions . ETC will conduct a pre- application meeting with District staff in the Palm Bay office . ETC will assist the County with preparation of responses to requests for additional information (RAI) letters received from the District for the CUP application . This assistance shall be limited to two District RAI letters . Task 9 . Transmission Pipeline Permit Assistance ETC w ill a ssist t he C ounty w ith t he p reparation o f t he F lorida D epartment o f E nvironmental Protection (FDEP) construction permit application for the transmission pipeline from the Bent Pine RIB Site to the wetland site . Specifically, this assistance will be limited to issues relating to wetlands , wildlife, the County arbor ordinance, and historic and archaeological resources . This information will be provided to the County to be included in the FDEP construction permit application for the pipeline . One draft copy of this information will be provided to the County for review . ETC will modify the environmental information as appropriate in response to comments received from the County, after the County completes their review of the information . ETC will provide the County with one copy (hard copy and electronic format) ofthe environmental information . The County shall be responsible for all permit fees associated with this permit . ETC will meet with County, FDEP and U . S . Army Corps of Engineers (USACOE) staff on- site to inspect the environmental site conditions along the pipeline route . ETC will assist the County with preparation of responses to requests for additional information (RAI) letters received from the County, FDEP and the USACOE as they relate to the environmental information within this permit application . This assistance shall be limited to two FDEP RAI letters . Task 10. Indian River County Permit Assistance ETC will assist the County with the site planning process . This assistance will include attending the Pre-application meeting, Technical Review Committee meetings , Planning and Zoning meetings , other meetings with the County Planning Department , public hearings , County Commission meetings , and the modification of the information collected, compiled, and prepared as part of tasks 1 through 9 as described above to address specific County development codes . This task will not include a pre and post stormwater analysis , or the preparation of any other stormwater management plans or permits . Task 11 . Construction Services ETC will assist the County during the construction phase of this project with the following issues : ❖ attend pre-construction meetings ; ❖ assist with management of the permits ; ❖ review Contractor submittals as these submittals pertain to environmental aspects of the permits or the wetland system ; ❖ attend monthly progress meetings ; ❖ assist County with review of Contractor invoices and change order requests as they pertain to the wetland system ; ❖ weekly inspection of the wetlands site ; ❖ assist the County with preparing a punch list based on as -built drawings provided by the Contractor; and ❖ assist the County with completion of project permits . ATTACHMENT 2 INDIAN RIVER UTILITIES DEPARTMENT NORTH COUNTY BRINE DISPOSAL PROJECT BUDGET Ecotech Consultants , Inc . proposes to complete the Scope of Services described in Attachment 1 for the amount of $ 88 , 020 . 00 . The time needed to complete each of the tasks described in Attachment 1 by Ecotech Consultants , Inc . and the County can be reasonably estimated as shown below . However, neither the County nor Ecotech Consultants , Inc . can control the phase of the permitting process controlled by the Florida Department of Environmental Protection, the St . Johns River Water Management District , or the U . S . Army Corps of Engineers .
