The Board of County Commissioners of Indian River County, Florida
met at the Courthouse, Vero Beach, Florida in a regular meeting held at
9:00 o'clock A.M., Tuesday, January 24, 1961. All members were present.
Also present were Ed Schmucker, County Engineer; Sherman N. Smith, Jr.,
Attorney; and Katherine Morrison, Deputy Clerk.

The foregoing Notice was read by the Chairman and all bids received
were opened. The first item was for two dump trucks, bids were received
as follows on the dump trucks:

Bids were received as follows:
M. D. Moody & Sons, Inc. bid $1857.00
No other bids were received and Motion was made by Commissioner Macdonald,;
seconded by Commissioner McCullers and unanimously carried, to accept the
only bid received of Moody & Sons in the amount of $1857.00.
Ellis Duncan was recognized by the Chair and stated that he was the
spokesman for a delegation from the Rosewood P.T.A. and they were appearing
before the Board for the purpose of obtaining a bicycle path on 16th Street
from Belmont Park S/D to the Rosewood School. He further stated they would
be satisfied with marl or rock or anything. The Chairman asked the County
Engineer if he had figured how much it would cost with Asphalt or maybe
Concrete. The County Engineer stated a rough estimate would be around
$5,000.00 for an asphalt walkway and about $6500.00 for a concrete walkway.
Motion was made by Commissioner Waddell, seconded by Commissioner Mac-
donald and unanimously carried, that the County Engineer be requested to
investigate the possibility of the City aiding us in this project and
report back to the Board at the next meeting. And further the Board is
only interested in a concrete walkway.
A delegation from Roseland appeared before the Board and requested
that the County open up the ditch which had been closed because of a
request from Mrs. Hansen and others. The County Engineer stated that
Ed Carter of Carter Engineering had called him last week and said he had
been hired by Mrs. Hansen to do some surveying, etc. in this area for the
reason that Mrs. Hansen wants to put in a subdivision, and that after Mr.
Carter made his survey he might come up with some solution to the drainage
problem in that area. After considerable discussion the Board requested
the County Engineer try to obtain a report from Carter Engineering on their
findings before the next Board meeting and report back at that time.

The Chairman read the foregoing Notice and there were none present
who wished to be heard except Attorney Sutherland, represening the property:
owners. After some discussion, and upon Motion made by Commissioner
Hamilton, seconded by Commissioner Macdonald and unanimously carried,
the following Resolution was adopted:
R E S 0 L U.T 10 N -- No. 61-3
BE IT RESOLVED by the Board of County Commissioners of
Indian River County, Florida, that this Board does herewith find
and determine as follows:
1. That Leon J. Deming and Lola Faye Deming, his wife,
and Walter Nielsen and Marion Nielsen,_his wife, on the talfday of
December, A. D. 1960, at a meeting of said Board, has filed a Pe-
tition before this Board requesting this Board to adopt a Resolution
closing, vacating and abolishing that part of the public road, street
and'right-of-way lying between the Indian River and Lots 201 to 203
inclusive, on the Plat of Orchid Island Unit No. 1, as recorded in
Plat Book 4, page 3, Indian River County public records, it being
designated on said Plat as Indian River Drive.
2. That this Board has published two weeks' notice thereof
one time in the Vero Beach Press Journal, a newspaper of general cir- -
culation published in Indian River County, Florida, said Notice being
published at least two weeks prior to the date stated therein for
such public hearing.
3. That said part of the public road, street and right-of-
way above described is not a State or Federal road and is not main-
tained by the State of Florida and is not located within the corporate
limits of any municipality and is located in Indian River County,
Florida.
4. That a public hearing thereon has been held by the
Board of County Commissioners of Indian River County, Florida, in
the offices of said Board in the Indian River County Court House,

BE IT FURTHER RESOLVED that this Board does herewith close,

Vacate and abolish that part of the above described public road and
right of way and all portions: thereof, and does herewith renounce and
disclaim any right of Indian River County, Florida, and the public in
and to all of said part of the public road, street and right of way
above described. Provided, however, that there is herewith retained an
easement for the use and benefit only of the owners of Lots 201 through
204, inclusive, of Plat of Orchid Island, Unit �1, as recorded in Flat
Book 4, page 3, Indian River County public records for their exclusive
ingress and egress, over, along and across the Last fifteen feet of
that part of the above described public road.
The following' Resolution was introduced by Commissioner Macdonald,
seconded by Commissioner Waddell and unanimously carried.
RESOLUTION NO. 61-4
BE IT RESOLVED by ,the Board of County Commissioners of
Indian River County, Florida, that the Resolution of this Board establishing
and regulating the subdividing of lands in Indian River County be herewith
amended as follows:
'Under Section X, Paragraph B. 4, add the following sentence:
"Marl base roads shall not be allowed for curb and
gutter construction. "

NOTICE IS HEREBY GIVEN
That the Board of County Commis-
sioners of Indian River County,
Florida, will receive sealed bids to
the hour of 10:00 o'clock A. M. on
January 24, 1961, and at said time
publicly open the same in its of-
fices in the Indian River County
Courthouse, Vero Beach, Florida,
for sale for cash, the following:
Two (2) Light Rescue Vehicles
for use of Indian River County
Civil Defense. Vehicles must meet
OCDM specifications CD VIII -168,
having both standard and supple-
mental Light Duty Tools and equip-
ment. The term "Standard Equip-
ment" to mean all items listed in
Federal Contributions Manual AM
25-1, revised September 1960. The
term "Supplemental Equipment" to
mean all supplemental equipment
listed in the same manual including
item VIII -177 (Resuscitator, mouth
to mask, and case, with aspirator)
to be substituted for item CD
VIII -165 (inhalator, portable). Do
Not include item 1-100 (Radio, mo-
bile, 2 way) in bids. All equipment
must meet OCDM approval as to
quality, specifications and manu-
facturer. Vehicles must be four
wheel drive having power takeoff
and front end winch (6000 lbs.),
equipped with siren, spotlight on
drivers side, and large red flash-
ing emergency light. Vehicles to be

Sheriff Sam Joyce appeared before the Board and
get the State Road Department
the North City limits of Vero
requested the Board
to reduce the speed limit on U.S. #1 from
Beach to Wabasso to 55 miles per hour in
daylight and 45 miles per hour at night. He further requested that the
speed limit be set at 45 miles per hour on Clemans from Road 60 to Citrus
Road and set at 45 miles per hour on Emerson from Road 60 to the South
Relief Canal. Motion was made by Commissioner Macdonald, seconded by
Commissioner McCullers and unanimously carried and the following Resolution
was, adopted.
RESOLUTION NO. 61- 5
WHEREAS, the Board of County Commissioners of Indian River
County, Florida, has made an investigation and has determined that upon the
basis of an engineering and traffic investigation, that the speed of motor
vehicles on'State Road 5, also known as U. S. Highway No. 1 from the North
limits of the City of Vero Beach extending Northward to the present four-
laning immediately North of Wabasso in Indian River County, Florida, as now
provided and established by law is greater than is reasonable or safe under
the conditions found to exist on that section of that highway because of the
fact that said road is sub -standard,` narrow, rough and extraordinarily slick
and bears heavy traffic; and,
WHEREAS, this Board has determined upon the basis of an
engineering and traffic investigation that the speed presently permitted by
law on State Road S-607 from State Road 60 South to the South Relief Canal
of the Indian River Farms Drainage District and on State Road S-611 from
State Road 60 South to the South Relief Canal of the Indian River Farms
Drainage District are both secondary state roads bearing heavy traffic,
having numerous intersecting and crossing streets and in an area containing
a heavy concentration of residences and being on a principal school bus route
where school children gather to be picked up and discharged from school
busses and both of these roads have had in recent months numerous serious
and fatal intersection accidents; Now, therefore,
BE IT RESOLVED by the Board of County Cpmmissioners of
Indian River County, Florida, that this Board does herewith request the State
Road Department of Florida to make an engineering and traffic investigation
of each of the roads above descrthed and after the same has been made, to
establish a reasonable or safe speed for each of the sections of said roads
above described and this Board does after its investigation recommend that
the following safe speed limits shall be established on said roads effective
when appropriate signs giving notice thereof are erectedby the State Road .
Department as follows, to -wit:

BE IT FURTHER RESOLVED that certified copies hereof be
forwarded to the State Road Department of Florida, both the District Office
at Fort Lauderdale and the Headquarters at Tallahassee.
Mr. Harold S. Winner appeared before the Board representing property
owners of the land acquired fror;. Brevard County, protesting to the high
taxes in that area. The Board informed Mr. Winner these people should
have appeared at the Equalization meeting. After some further discussion
as to the proposed A -1-A road in that section, Motion was made by Comm-
issioner Hamilton, seconded by Commissioner McCullers and unanimously
carried, and the following Resolution was adopted:

S, the Board of County Commissioners of Indian River County,
Florida, are now engaged in obtaining the right of way for State Road
n. -1-A, Section 58070-2531, extending from the former North fine of
Indian River County to the Sebastian Inlet, and
'!H EAS, in various locations through this property there are
various and sundry existing public rights of ways including Plats of
record and dedicated rights of ways in all recorded subdivisions except
Sebastian Inlet Subdivision, and there are other rights of ways existing'
by ;public use and maintenance and through reservations made by the
Trustees of the Internal Improvement Fund of the State of Florida in
conveyances under the Murphy Act, Now, Therefore;

County, Florida, that this .Board does herewith declare that with eac}i
and every property owner conveying the right of way for the above stated
road without compensation, that this Board will vacate and abandon any
and all other rights of ways existing as above set forth in view of the
fact that none of the same will be necessary after the construction of
the new State Road A -1-A.
BE IT FURTHER RESOLVED that a certified copy of this Resolution be
furnished to the State Road Department and the Trustees of the Internal
Improvement Fund of the State of Florida, with the request that each
of them will take whatever actions are required by them in order that
the declarations of this Board in this Resolution may be completed and
consummated.
The Attorney for the Board stated that the Florida Inland Navigation
District had requested that someone from the Board of County Commissioners
should be present at their meeting on February 24th. The Board requested
the County Attorney and County Engineer attend this meeting.
The Attorney for the Board stated that the. City of Vero Beach had
.given him a map showing the area they were dedicating for:a launching ramp.
He further stated that he had talked with the State Road Department and
they informed him there was a difference in the City's survey and theirs,
therefore this will cause additional delay in getting the ramp installed.
The Board requested Sherman N. Smith, Jr. to check with the State
Road Department regarding the launching ramp at Roseland and also check
and.see if the State Road Department could install a launching ramp on
State Road 512 at Dike 34.
Upon Motion made by Commissioner Macdonald, seconded by Commissioner
McCullers, and unanimously carried, the following Deputy Sheriff's appoint-
went was approved.:

Upon Motion made by Commissioner' Waddell, seconded by Commissioner
McCullers and carried, the Clerk was authorized to write a check for
$130.00 to Mrs. Billye Chriss and $110.00 for David Kuhn for work at the
Indian River County Booth at the Florida State Fair, and was further
authorized to give the County Agent a statement of balance of funds in
the State Fair account.
Stone Bros. Funeral Home requested permission t� bury a colored man
who had passed away without relatives or funds to bury him. The Board
requested the Clerk wire the State Anatomical Board to see if they wished
the body. They informed Mr. Stone they would let him know after receiving
an answer to the wire.
Audit Report No. 5230 of the Florida Inland Navigation District
for the fiscal year ended December 31, 1959 was presented to the Board,
and same was ordered filed a' part of the public records of the Board,
Pursuant to Section 21.121(3), Florida Statutes.
The Board 0.K.ed the sale of bathroom fixtures for $40.00 to some
of the men with the Road & Bridge Department.
The County Engineer stated he would like to have the Board clarify
what space is to be given to the Small Claims Judge when the new addition
is completed. The Board stated that only the room now used by the Secre-
tary to the .Circuit Judge is to be given to the Small Claims Judge.
A bid was submitted by J. S. Hogan in the amount of $100.00 for
the two-story apartment house, known as the Hewitt Apartments, which had
been advertised for sale some time ago and no bids had been received at that
time. Motion was made by Commissioner Waddell, seconded'by Commissioner
Hamilton and carried, that this bid by J. S. Hogan be accepted.
The County Engineer stated that Hubert Graves will give $1800.00
towards the building of a concrete bridge 4 1/2 miles West of Route 60 on
Ranch Road. The Board told Mr. Schmucker to accept the offer.
The County Attorney reported to the Board the results of jury verdicts
and settlements made at the trial of the condemnation proceedings by the
County in acquiring right of ways for State Road 5, also known as U.S. #1,
according to a schedule of settlements and jury verdicts submitted by the
Attorney to the Board. Upon motion by Commissioner Macdonald, seconded
by Commissioner Hamilton and unanimously carried, the settlements effected
were ratified, approved and confirmed and the verdicts of the jury duly
noted and the payments in accordance with the judgment of the Court were
authorized and approved.
There being no further business, the meeting then adjourned.
CHAIRMAN
