HomeMy WebLinkAbout2007-071 PERMANENT PART-TIME EMPLOYMENT AGREEMENT Between INDIAN RIVER COUNTY And CLIFFORD J. SUTHARD, P.E. , PROJECT ENGINEER This agreement is effective as of February 17, 2007 by and between Indian River County, a political subdivision of the State of Florida ("County") and Clifford J. Suthard, P.E. (hereinafter "Project Engineer"), for permanent part-time employment by the County as Project Engineer and Review Engineer for various Public Works Projects commencing February 18 , 2007 and ending February 17, 2009. SECTION 1 . PROJECT ENGINEER' S DUTIES In consideration of Project Engineer' s employment by the County, Project Engineer shall devote attention to coordination and oversight of design and construction of various Public Works projects for the County and development review if needed. Project Engineer shall not engage in the compensated practice of engineering or project management except pursuant to this Agreement unless expressly authorized by the County Administrator or Public Works Director to do so. Project Engineer' s work on behalf of the County shall be under the direction of the Indian River County Public Works Director or his designee who shall determine the matters to be assigned to Project Engineer, the duties to be performed by Project Engineer, and standard of performance to be maintained. The Project Engineer shall be required to make periodic oral or written reports to the County Public Works Director or his designee or to the County Administrator, further the Project Engineer may be required to report to the Board of County Commissioners as frequently and in such form as the County Administrator or his designee directs. The Project Engineer shall work a minimum of 20 hours per week unless the Public Works Director approves less. The County will provide adequate space, personnel support and equipment that in the County Public Works Director' s opinion will provide the necessary resources for the Project Engineer to perform the required duties. The Project Engineer may be permitted to provide F:\Public Works\Luanne WAgreement Docs\Suthard, Employment Agr, 02-2005. personnel support (AutoCAD Technician) at an hourly rate of $20. 00 per hour if the County cannot supply needed support. SECTION 2, AUTHORITY OF COUNTY PUBLIC WORKS DIRECTOR The County Public Works Director or his designee shall have the authority to review all work performed and to require Project Engineer to revise such work or work product, to determine the time and the manner of the performance of all work, and to determine standards of performance. SECTION 3. ETHICS OF PROJECT ENGINEER Where applicable Project Engineer shall be required to abide by and perform all assigned duties in accordance with the Indian River County Administrative Policy Manual, Chapter 112, Florida Statutes, and any other governing laws, ordinances and regulations. Liability and indemnity shall be as provided for full time (permanent) County employees. SECTION 4. COMPENSATION For all services rendered by Project Engineer, Project Engineer shall be paid a fixed hourly rate of Forty-Five dollars per hour ($45 . 00/hour), payable biweekly, less regular payroll deductions for the term of this agreement. The compensation will cease upon termination of this agreement or at the end of the two-year period, whichever occurs first. SECTION 5. BENEFITS An automotive usage reimbursement allowance of $.445 per mile shall be provided for all in-county and out-of-county travel for the Project Engineer' s use of his personal vehicle for County-business-related travel. All other travel expenses shall be paid as provided in Section 112 .061 , Florida Statutes . For the purpose of Engineering license renewal expenses, continuing education tuition expenses, and similar expenses, the County shall reimburse fees not to exceed $600.00 annually. 0 F:Tublic Works\Luanne MWgreement Docs\Suthard, Employment Agr, 02-2005.doe SECTION 6. CONTRACT The Project Engineer acquires no property interest and no property rights in employment or in continued employment, but has only the contractual rights set forth in this permanent part- time employment agreement. The Project Engineer agrees that this permanent part-time employment is strictly "at will" and the County Administrator may terminate this employment agreement at any time for cause or for no cause upon thirty days (30) written notice. SECTION 7, TERM This employment contact is for a fixed period of two (2) years commencing February 18, 2007 and ending February 17, 2009, unless terminated earlier by either party. SECTION &TERMINATION This contact may be terminated at will by the County upon at least thirty days (30) written notice by the County Administrator to the Project Engineer. This contact may be terminated by the Project Engineer upon at least 30 days ' written notice given to the County Administrator. In the event the Project Engineer terminates this agreement upon less than 30 days ' written notice to the County Administrator, the Project Engineer shall pay as penalty to Indian River County 25% of his previous 30 days compensation.
