* Whenever used herein the term GRANTOR and GRANTEE include all parties
to this instrument and their heirs , legal representatives , successors and
assigns .
WITNESSETH:
That said GRANTOR for and in consideration of the sum of Ten Dollars ( $ 10 . 00 ) and other consideration ,
receipt of which is hereby acknowledged , does hereby grant, convey and confirm unto the said GRANTEE ,
a non - exclusive underground easement for UTILITY PURPOSES , beneath and through the following
described land , situate in Indian River County, Florida , to -wit :
The West 10 feet of the South 227 . 05 feet of the 60 foot wide private road easement as
shown on the Plat of PINEWOOD ESTATES , according to the plat thereof recorded in Plat
Book 8 , Page 61 , of the Public Records of Indian River County, Florida .
( Hereinafter referred to as " Easement Area ")
SEE CROSSHATCHED AREA ON EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF .
And GRANTOR hereby covenants with said GRANTEE that it is lawfully seized of said servient land in fee
simple and that it has good right and lawful authority to convey the easement established hereby, subject
to mortgages and encumbrances and restrictions of record , if any. By acceptance of delivery of this
Easement , the GRANTEE agrees to repair and maintain the Easement Area at its sole expense .
This grant of easement shall run with the land and shall be binding on and shall inure to the benefit of the
parties hereto , their heirs , successors and assigns .

PARTIAL RELEASE OF EASEMENT

WHEREAS , Indian River County has a ten -foot easement for drainage
and utilities running along the west side of the lots dedicated by the plat of
Pinewood Estates , recorded in Plat Book 8 , Page 61 of the Public Records of
Indian River County , Florida ; and
WHEREAS , in coordination with the interested parties , County staff has
determined that the retention of a certain area of this easement serves no public
purpose ; and
WHEREAS , Grantee has executed , simultaneously herewith , a Utility
Easement to Indian River County covering the area described on Exhibit "A"
attached hereto ;
NOW, THEREFORE , THIS PARTIAL RELEASE OF EASEMENT is
executed by the Board of County Commissioners of Indian River County, a
political subdivision of the State of Florida , whose mailing address is 1840 25th
Street , Vero Beach , Florida 32960 , Grantor, to
Larry L . Evans , Sr.
Post Office Box 780008
Sebastian , FL 32978 -0008
His successors in interest , heirs and assigns , Grantee .
Indian River County does hereby release and abandon all right , title , and
interest that it may have in the area described on Exhibit " B " attached hereto .
