SECTION IV - SCOPE OF SERVICES The DESIGN/BUILDER agrees to add floor striping, delete all landscaping, and obtain an NPDES permit for the project, as detailed in PCL ' s price proposal, dated 7/ 14/03 , which is herein made a part of this Amendment and is attached as "Exhibit A". SECTION VI - COMPENSATION The COUNTY and the DESIGNBUILDER agree to accept for services rendered/removed pursuant to this Amendment, a deductive change to the Guaranteed Maximum Price of $ 6 ,497 . 00 , as detailed in "Exhibit A". Receipt of an executed copy of this Amendment shall constitute the COUNTY ' S notice to the DESIGN / BUILDER to proceed with the work. B . All provisions of the CONTRACT not specifically modified shall remain in full force and effect. C . This Agreement, regardless of where executed, shall be governed by and construed according to the laws of the State of Florida. Venue for any lawsuit brought by either party against the other party or otherwise arising out of this agreement shall be in Indian River County, Florida, or, in the event of federal jurisdiction, in the United States District Court for the Southern District of Florida. Add 600 if of floor striping to designate access and egress pathways per Building Department . 2 . Deduct the existing Landscape Allowance . PCL has been informed that the County will perform this work. 3 . Obtain NPDES permit . This is a new permit requirement effective May 1 , 2003 . The following items are Not included : 1 . Concrete :drive approach located on the south side of the building. 2 . Roof and Siding Insulation. 3 . Monitoring well and water testing for NPDES permit . 4 . Galvanizing of structural beams and columns 5 . Epoxy paint on structure. 6 . Lightning protection. 7 . Floor sealing. 8 . Mitered end sections for ADS pipe, inline ADS drains, and ADS drain basis as indicated on Civil drawings dated February 11 , 2003 "Not for Construction. " 9 . ( 1 ) 8 " GRS Gate Valve per planning department review comments is not included. 10 . Landscaping & irrigation. 11 . Chain link fencing. Clarifications : 1 . Galvanizing of purlins and gurts only. Galvanized surfaces will not be painted. Structural steel will be primed and painted with approved Sherthane 2K paint product on columns and Spraylastic on the beams . 2 . Site office is not included . The County is to provide space in the existing trailer located on the Fairgrounds . 3 . Temporary toilet facilities are not included. The County is to provide access to existing restrooms located on the fairgrounds . 4 . Indian River County will perform the scopes of landscaping and chain link fencing . These activities shall be coordinated with PCL ' s Site Superintendent in order maintain the project completion date. 5 . Foundation costs associated with the increase of the Importance Use Factor will be submitted under a separate cover. The total value for this additional work will be Negative Six thousand Four Hundred Ninety Seven dollars ($6, 497. 00) . This price will be valid for no more than 60 days .
