The foregoing Notice was read and the Vice -Chairman asked if there
were any present who wished to be heard regarding the Supplemental Budget.
There were none, and Motion was made by Commissioner Hamilton, seconded
by Commissioner Waddell and unanimously carried, and the following Reso-
lution was adopted:
RESOLUTION NO. 61 -
WHEREAS, the Board of County Commissioners did receive and
examine and tentatively adopt a proposed budget of excess receipts
and their expenditures for the fiscal year ending September 30, 1961;
and,
WHEREAS, this Board did cause a summary statement thereof
to be advertised one time in a newspaper of general circulation pub-
lished in Indian River County, Florida, to -wit: In the issue of
July 6, 1961 of the Vero Beach Press Journal as will more fully appear
by proof of publication thereof filed in the minutes of this Board; and
WHEREAS, this Board did meet at the time and place stated
in said advertisement for the purpose of hearing requests and complaints
of the public regarding said Supplemental Budget and for the purpose of
holding a public hearing and making whatever revisions in the budget it
may deem necessary; Now, therefore,
BE IT FURTHER RESOLVED that the Board of County Commissioners
of Indian River County, Florida does herewith tentatively adopt said
Supplemental Budget for the fiscal year ending September 30, 1961 in
the form heretofore tentatively adopted and duly advertised.
BE IT FURTHER RESOLVED that said Supplemental Budget shall
be filed in the office of the County Auditor as a public record and the
Clerk .hereof shall transmit two copies of the Supplemental Budget as
adopted to the Comptroller of the State of Florida and said Supplemental
Budget shall be considered as finally adopted and official upon approval
as to form by the Comptroller.
J. A. Coach Thompson was recognized by the Chair and stated he was
speaking on behalf of the School Board and requesting additional Race
Track Funds. After quite a lengthy discussion, Motion was made by
Commissioner Macdonald, that the Secretary be requested•to send a letter
of intent to the School Board stating this Board's decision to give the
School Board $40,000.00 race track funds in the year 1961-62. This motion
was seconded by Commissioner Hamilton and unanimously carried.

The foregoing Notice was read by the Attorney and it was decided to
take them item by item.
Item #1- No one was present who wished to be heard. Motion was made by
Commissioner Hamilton, seconded by Commissioner Macdonald and carried
that said property be rezoned from R-1, Single Family District to R -2-A,
Multiple Family District.
Item #2- No one was present who wished to be heard. Motion was made by
Commissioner Waddell, seconded by Commissioner Hilton and carried, that
said property be rezoned from C -1-A, Restricted Commercial District, to
R-1, Single Family District.
Item #3. No one was present who wished to be heard. Motion was made by
Commissioner Hamilton, seconded by Commissioner Macdonald and carried,
that said property be rezoned from R -2-A, Multiple Family District to R-1,
Single Family District.
Item #4- No one present wished to be heard. Motion was made by Commissioner
Macdonald, seconded by Commissioner Hamilton and carried, that said
property be rezoned from R-1, Single Family District to M-1, Industrial
District.
Item #5- Hazel Barber appeared before the Board and stated she would like
her property to be rezoned the same. After checking Mrs. Barber was in-
formed her property was already zoned for transient. Motion was made by
Commissioner Macdonald, seconded by Commissioner Hamilton and carried,
that said property be rezoned from R-1, Single Family District, to R-3,
Transient District.
Item #6- No one present wished to be heard. Motion was made by Commissioner
Macdonald, seconded by Commissioner Waddell and carried, that said property
be rezoned from R-1 Single Family District, to C-1, Commercial District.
Item #7- John Charles Mitchell was recognized by the Chair and stated he
was representing 26 property owners who are all opposed to the rezoning.
The following were also heard opposing the zoning change: Lewis Gluckner,
Ed McKeon, Nelson Cunningham, Bev Mitchell, Angelo Sanchez, John Tippin,
Earl Groth, Stanley Griffis, Gail Templin, Lewis Gerbhardt. Mr. Samuel
R. Smith was then recognized and stated he was the one requesting the re-

by Commissioner Waddell and carried, that the proposed re -coning of Item

missioners of Indian River County,
Florida, will receive ealed bids to
the hour of 9:00 o'clock A. M. on
the 18th day of July, 1981, and at
said time publicly open the same
at its offices in the Indian River
County Courthouse, Vero Beach,
Florida, for a standing table and
a standing desk as set forth In de-
tail in Itemized specifications avail-
able at the office of David V.
Robison, Architect, 1837 - 20th
Street, Vero Beach, Florida.
Each bid should be in a

The foregoing Notice was read and bids opened. Only one bid was
received and that from Huck Office Equipment Company in the amount of
$1,603.60. Motion was made by Commissioner Macdonaldthat this bid be
accepted upon the recommendation of Dave Robison, Architect. The Motion
was seconded by Commissioner Hamilton and unanimously carried.
The Vice Chairman stated that at the last meeting he had been
appointed on a committee along with Sheriff Sam Joyce, John Beadle,
Alvin Forney and Tracy Turner to make recommendations concerning regulation
of motor vehicles on the beaches of Indian River County, and that they
are herewith submitting their recommendations to the Board. After some
discussion in the matter Commissioner Hamilton introduced the following
Resolution, which was seconded by Commissioner Waddell, and unanimously
passed.
RESOLUTION
WHEREAS, by the provisions of Chapter 61-aX)?Laws of Florida,
Acts of 1961, the Board of County Commissioners of Indian River County,
Florida, is authorized and empowered to adopt rules and regulations
limiting, restricting or prohibiting the operation of motor vehicles
upon any and all or any part of the public beaches located in Indian
River County, Florida; and,
WHEREAS, pursuant to said authority, this Board adopts the
rules and regulations hereinafter set forth, after having given due
consideration to the necessity for such rules and regulations and
after having found and determined that the health, welfare and safety
of the people of Indian River County, Florida, require that such rules
.and regulations be adopted; now, therefore,
BE IT RESOLVED by the Board of County Commissioners of Indian
River County, Florida:
Section 1. For the purpose of this Resolution, certain terms and
words are defined as follows:
MOTOR VEHICLE. Every device which is self-propelled and in,
upon or by which person, persons or property is, are or may be trans-
ported.
PUBLIC BEACHES. That part of the shore of the Atlantic Ocean
in Indian River County, Florida, extending from the ordinary high
water mark toward the ocean to the waters of the Atlantic Ocean and
extending from the south City limits of Vero Beach, Florida, to the
line dividing Indian River and St. Lucie Counties, Florida, and ex-
tending from the north City limits of Vero Beach, Florida, to the
north boundary line of Southern Shores Subdivision.
Section 2. No person shall operate a motor vehicle on the public •
beaches of Indian River County, Florida, at a rate of speed in excess
of 15 miles per hour.
Section 3. No person shall operate a motor vehicle upon the public
beaches of.Indian River County, Florida, between the hours of i:60
o'clock A. M. and 6:00 o'clock A. M.
Section 4. No person

Alice Helleso, County Health Nurse appeared before the Board and
stated that Ethel Klepp, County Health Nurse would like an extended leave
of absence. The Board requested Mrs. Klepp write a letter to this effect
to the Board, at which time some action would be taken.
Mrs. Graham appeared before the Board and presented, on behalf of
Dr. Flood, a suggested list of names from which to pick a committee to
study the feasibility of a Four -County Home for Juveniles and Mental
Patients.
The Board thanked Mrs. Graham and stated they would go over
the list and make their decision at a later date.
The Attorney for the Board stated that the School Board had not
taken any definite action on the re -districting problem but had told him
it would not be the same as the County Commissioners. The Attorney further
suggested that the Board hold up formal adoption of our re -districting
until after the November election or go ahead and adopt same to become
effective after the November election. He further suggested we keep be-
hind the school board to get them to redistrict.
The following Deputy Sheriff's appointment was approved for Charles
G. Edwards, Precinct #3, and Bond was approved for Mr. Edwards with St.
Paul Fire and Marine Insurance Company as surety in the amount of $1,000.00,
upon Motion made by Commissioner Hamilton, seconded by Commissioner
Macdonald and carried.
Motion was made by Commissioner Macdonald, seconded by Commissioner
Waddell and unanimously carried, adopting the following Item to Item
Transfers.

WHEREAS, there is a total surplus of $2,500.00 in the Fine &
Forfeiture Fund of Indian River County under some items and which
surplus exists after the payment of all necessary expenditures under
such items for the current fiscal year; and
WHEREAS, there is a deficiency in funds necessary to provide
for the proper and authorized expenditures under some items in the Fine
& Forfeiture Fund; and
WHEREAS, said items mentioned are a part of the same fund and the
transfer from one item to another item in the same fund and is not a
transfer from one fund to another fund; therefore,
BE IT RESOLVED that there is herewith transferred the sum of
$2,500.00 from some items where there is a surplus to the items where
there is a deficiency, according to detailed statement attached, all
in the Fine & Forfeiture Fund of the current budget of Indian River
County as provided by law.

Motion was made by Commissioner Waddell, seconded by Commissioner
Macdonald, and unanimously carried, that this Board hereby directs the
Clerk of the Circuit Court of Brevard'County to transfer to the office
of the Clerk of the Circuit Court of Indian River County, all tracings
of plats covering lands which were formerly situated in Brevard County,
and which are now a part of Indian River County, pursuant to Chapter
61-1009, House Bill No. 520.
The County Engineer reported that he had not exactly been able to
check out the descriptions as furnished by the State Road Department on
their quit -claim deed to the county for the abandonment of right of way
on South U. S. #1. The Board directed the Clerk write a letter to Mr.
Walter Buckingham informing him that the Board is temporarily tabling
this matter until his return to the City.
Motion was made by Commissioner Waddell, seconded by Commissioner
Hamilton and carried, to pay Nina Allen $60.00 in:lieu of removing trees
off U. S. #1 right of way.
Motion was made by Commissioner Macdonald, seconded by Commissioner
Hamilton and carried, to pay to Mrs. Rose Hatch $300.00 for the right of
way on 12th Street.
Motion was made by Commissioner Waddell, seconded by Commissioner
Hamilton and carried, to pay The Samobe Corporation $500.00 for right of
way on 20th and Citrus.
Motion was made by Commissioner Macdonald, seconded by Commissioner
Hamilton and carried, to pay $1300.00 for right of way on 12th Street
from Vero Tropic Estates, Inc.
Motion was made by Commissioner Macdonald, seconded by Commissioner
Waddell and carried, authorizing the County Engineer to pay'up to $1400.00
to Henry Sapp for right of way across his land on 12th Street.
The County Engineer stated that Mr. Lux,developer of Hickory Sands
Subdivision.would like to County to release the park area in this sub.-
division
ub:division in exchange for right of way on. Old Dixie Avenue. Motion was
.made by Commissioner Macdonald, seconded by Commissioner Waddell and
carried, that the Board will accept the proposition made by Mr. Lux as
stated above.

Waddell and unanimously carried, giving the County Engineer authority to
advertise forbids to purchase a dragline.
Upon Motion made by Commissioner Waddell, seconded by Commissioner
Macdonald and carried, the following committee was appointed by the Vice
.Chairman to study the crowded conditions of the jail and make recommenda-
tions to remedy this situation: Sheriff Sam Joyce, Attorney John Gould
and Dr. B. Q. Waddell.
The Board requested the Deputy Clerk write a letter to the State
Road Department as to what action had been taken regarding speed limits
requested some time ago on Clemann, Emerson and U. S. #1 from Vero Beach
to Wabaseo.
The Clerk of the Circuit Court (County Auditor) after tentatively•
ascertaining the proposed fiscal policies of the Board for the. ensuing
fiscal year, from the 1st day of October, 1961, to the 30th day of
September, 1962, prepared and presented to the Board a tentative budget for
the ensuing fiscal year for each of the funds, as provided in Chapter
26874, Laws of 1951, including all estimated receipts, taxes to be levied,

and balance expected to be brought forward, and all estimated expenditures,
reserves and balances to be carried over to the end of the year, were
ordered spread upon the minutes of the Board, and is in words and figures
