(DEMOLITION AND REMOVAL SERVICES) PRIVITY AGREEMENT
This First Amendment to Asbestos Abatement (Demolition and Removal Services) Privity
Agreement ("First Amendment ) is entered into effective Novemberf;L_, 2007, by and between Indian
River County ("County") and Cross Environmental Services, Inc. ("Cross") .
BACKGROUND RECITALS
A. Effective September 4, 2007, the County and Cross entered into an Asbestos Abatement
(Demolition and Removal Services) Privity Agreement ("Agreement").
B. The County and Cross desire to amend the Agreement by adding additional services, in
accordance with the provisions of the Agreement, as set forth in this First Amendment.
Now therefore, for good and valuable consideration , the receipt and sufficiency of which is hereby
acknowledged , the parties hereto, intending to be legally bound , covenant and agree to amend the
Agreement as follows:
( 1 ) The background recitals are true and correct and form a material part of this First Amendment.
(2) From and after the effective date of this First Amendment, the Agreement is amended as follows:
In addition to the services set forth in the Agreement, Cross shall provide the asbestos abatement
services, at the agreed upon price, all as more specifically set forth on Attachment A attached hereto and
made a part hereof.
(3) All terms and conditions of the Agreement not amended by this First Amendment shall remain in
full force and effect.
IN WITNESS WHEREOF , the County and Cross have caused this First Amendment to be signed
by their respective duly authorized officers as of the day and year first stated above.
