RELEASE OF EASEMENT
This Release of Easement is executed by the Board of County
Commissioners of Indian River County, a political subdivision of the State of Florida
(" County" ) , whose address is 1840 25th Street , Vero Beach , Florida 32960 , to Flinchum
Construction , Inc . , a Florida corporation , whose address is 2325 18th Avenue , Vero
Beach , Florida 32960 , its successors in interest, heirs and assigns (" Owner ' ) .
WHEREAS , the County has an existing recorded 20400t drainage easement
from Owner across Lots 7 , 8 , 9 , and the west 35 feet of Lot 10 of MEDICAL SERVICE
CENTER SUBDIVISION , dated December 20 , 2002 , and recorded in O . R . Book 1549 ,
Page 795 , of the Public Records of Indian River County, Florida ( "2002 Easement" ) ;
and
WHEREAS , a platted 50-foot drainage easement currently exists along the north
boundary of Lots 7 , 81 9 , and the west 35 feet of Lot 10 of MEDICAL SERVICE
CENTER SUBDIVISION , as recorded in Plat Book 13 , Page 18 , of the Public Records
of Indian River County , Florida ; and
WHEREAS , County staff has determined that the release of the 2002 Easement
would not adversely affect the County;
NOW, THEREFORE , the County does hereby release and abandon all right ,
title , and interest that it may have to the area described on Exhibit "A" attached hereto
and made a part hereof that was part of the 2002 Easement ,
IN WITNESS WHEREOF , the County has caused these presents to be executed
in its name this 24th day of June , 2003 .
