We are pleased to return your executed CDBG Award Agreement with the Department of Community
Affairs (DCA) . The Agreement must be retained in your official CDBG files and made available for
public review upon request. Please note the following instructions before beginning your project :
• Do not incur or obligate more than $5,000 in expenses until you complete an environmental
review of the project and receive a release of funds notice from the Department. You may
incur up to $5 , 000 in administrative costs to cover the environmental review and other start-up
activities .
• Your contract contains performance related Program Conditions (Attachment C, Section II)
that must be met before funds for construction may be drawn. Special Conditions , if applicable,
are reflected in Attachment J. Review your contract immediately and begin the process of
meeting applicable program or special conditions .
• Enclosed are copies of the Projection of Contract Payments Form, Quarterly Report Form and
Minority Business Enterprise Report (with instructions) . Use these forms to project quarterly
payment needs, to report accomplishment data, and to report contractual activities . The
Department cannot process an electronic payment request for an amount less than $5 , 000 (unless
it is the final payment) .

Indian River County proposes to complete a CDBG national objective with this project by
providing Fire Protection/EMS facilities in a predominantly LMI neighborhood within the
unincorporated area of Gifford in Indian River County . The service area is a low income ,
older residential area without a Fire / EMS Station . The new Fire/ EMS Station will provide
for a much more rapid response time to local emergencies and fires in this LMI community .
A new fire station has been designed for this project . The $ 750 , 000 in CDBG funds will
pay a portion of the cost for the new Fire /EMS Station . The full cost is expected to be
about $ 2 , 200 , 000 . The Project will be on vacant , undeveloped land in a residential
neighborhood . The project is not within the floodplain . Local revenues of $ 250 , 000
revenues have been pledged as a match for the CDBG . The balance of funds needed will came
from local revenues .

Part 2. Environmental Certification (to be completed by responsible entity)
With reference to the above Program Activity ( ies)/Project(s) , I, the undersigned officer of the responsible entity , certify that :

On or about Tuesday February 26, 2008 Indian River County will request the Florida
Department of Community Affairs, designated by the U .S. Department of Housing and Urban
Development, to remove the environmental conditions and release Federal funds under Title 1 of
the Housing and Community Development Act of 1974 (PL 93-383) for the following project :
Project Title: Community Development Block Grant, Neighborhood Revitalization
DCA Contract OSDB-T3- 10-40-03-N25
Purpose: Indian River County proposes to complete a CDBG national objective
with this project by providing Fire Protection/EMS facilities in a

County. The site is publicly owned , unimproved and vacant.
Estimated Cost: $21200,000
It has been determined that such request for removal of environmental conditions will not
constitute an action significantly affecting the quality of the human environment; accordingly the
above-named recipient has decided not to prepare an Environmental Impact Statement under the
National Environmental Policy Act of 1969 (PL 91- 190).
The Reasons for such decision not to prepare such Statement are as follows :
An environmental assessment was performed which verified that the only impacts to the
environment would be minimal and beneficial .
An Environmental Review Record respecting the above project has been made by the above-
named recipient that documents the environmental review of the project and more fully sets
forth the reasons why such Statement is not required. The Environmental Review Record
will be available for review by the public and cooving upon request between the
hours of 8 .30 a.m. and 5.00 a.m. at the Indian River County Administration Building

conducted prior to the request for removal of environmental conditions.
All interested agencies, groups and persons disagreeing with this decision are invited to submit
-- - - -written comments for consideration-by-the recipient to-the-office of-the-undersigned.—Such written
comments should be received at the address specified on or before S:OOPM Monday, February
25, 2008. All such comments so received will be considered and the recipient will not request the
removal of environmental conditions or take any administrative action on the above project until
the date specified in the preceding sentence.
The recipient will undertake the project described above with Block Grant funds from the U .S.
Department of Housing and Urban Development (HUD) under Title I of the Housing and
Community Development Act of 1974 through the State of Florida . The recipient is certifying to
DCA that its environmental certifying officer identified below, in the official capacity as BCC Chair,
consents to accept the jurisdiction of the federal courts if an action is brought to enforce
responsibilities in relation to environmental reviews, decision making and action; and that these
responsibilities have been satisfied . The legal effect of the certification is that upon its approval the
recipient may use the Block Grant funds and HUD will have satisfied its responsibilities under the
National Environmental Policy Act of 1969 . DCA will accept an objection to its approval only if it is
on one of the following bases : (a) that the certification was not in fact executed by the certifying
officer or other officer of applicant approved by DCA; or (b) that applicant's environmental review
record for the project indicates omission of a required decision finding or step applicable to the
project in the environmental review process. Objections must be prepared and submitted in
accordance with the required procedure (24 CFR Part 58) and may be addressed to Florida
Department of Community Affairs, Bureau of Community Development, 2555 Shumard Oak
Boulevard, Tallahassee, Florida, 32399-2100. Objections to the removal of environmental
conditions on bases other than stated above will not be considered by DCA.

This is a Florida Small Cities CDBG A full EA is required by the fact that the
project is new construction of a fire station . The work is only within existing
vacant County property properly zoned for the activity. The site is cleared ,

The Florida State Clearinghouse, pursuant to Presidential Executive Order 12372,
Gubernatorial Executive Order 95-359, the Coastal Zone Management Act, 16 U.S.C.
§§ 1451-1464, as amended, and the National Environmental Policy Act, 42 U.S.C. §§
4321, 4331-4335, 4341-4347, as amended, has coordinated a review of the referenced
grant application.
The Florida Department of State (DOS) notes that the proposed undertaking will have
no effect on historic properties, provided the applicant agrees to make contingency
plans in case fortuitous finds or unanticipated discoveries are uncovered during
ground disturbing activities. If any prehistoric or historic artifacts are encountered
during construction, all ground disturbing activities should cease and the applicant
should contact the DOS Division of Historical Resources, Review and Compliance
Section at (850) 245-6333 for further instructions . In the event that unmarked human
remains are encountered, all work shall stop immediately and the proper authorities
notified in accordance with Section 872.05, Florida Statutes. Please refer to the enclosed
DOS letter for additional information.
Based on the information contained in the application for federal assistance and the
enclosed state agency comments, the state has no objections to the allocation of federal
funds for the subject project and, therefore, the funding award is consistent with the
Florida Coastal Management Program (FCMP) . The applicant must, however, address
the concerns identified by our reviewing agencies prior to project implementation.

This office received the above referenced submittal in accordance with Section 106 of the
National Historic Preservation Act of 1966, as amended, and 36 C.F.R. , Part 800: Protection of
Historic Properties; Chapter 267, Florida Statutes; Florida's Coastal Management Program; and
all implementing state regulations, to identify historic properties listed, or eligible for listing, in
the National Register of Historic Places, or otherwise of historical, architectural or archeological
value that could be affected. The State Historic Preservation Officer is to advise and assist
federal agencies and applicants when identifying historic properties, assessing effects to historic
properties, and considering alternatives to avoid or minimize adverse effects to such properties .
Based on the information provided, it is the opinion of this office that the proposed undertaking
will have no effect on historic properties, provided that the applicant makes contingency plans in
the case of fortuitous finds or unexpected discoveries during ground disturbing activities on the
property:
• If prehistoric or historic artifacts, such as pottery or ceramics, projectile points, dugout
canoes, metal implements, historic building materials, or any other physical remains that
