The Board of County Commissioners of Indian River
County,.Florida, met at the Courthouse, Vero Beach, Florida, in a
regular meeting held at 8:00 o'clock, A. M.., Tuesday, November 21,
1961. Present were Robert W. Graves, Chairman, B. Q. Waddell,
Donald Macdonald and J. J. P. Hamilton. Absent was D. B. McCullers.
Also present were John Gould, County Attorney, Ed Schmucker, County
Engineer,and Al Webber and Freda Wright, Deputy Clerks.
Homer Fletcher, Tax Assessor, appeared before the
Board and requested the Board to authorize adjustment on valuation
on the following property:
Lot 13, Churchill Downs, correct assessed value
$2000.00, Correct tax to be extended $102.87
Lot 31, Block 7, Ixora Park No. 5, correct assessed
value $100.00, correct tax to be extended $5.10
Lot 5, Block B, Floralton Beach Sub., correct
assessed valuation $5000.00, correct tax to be
extended $255.18
Upon Motion made by Commissioner Waddell, seconded
by Commissioner Macdonald and unanimously carried, Mr. Fletcher was
authorized to make the adjustments.
Mr. Fletcher also asked to transfer monies in various'
other accounts to the Property Card Account. Mr. Gould was asked to
prepare resolution on same to be adopted at the next meeting.
Mr. Wyn appeared before the Board with regard to trans-
fer of easement on his property. He was advised he would have to
file petition with the Board before any action could be taken.
Mr. Merzbacher appeared before the Board regarding the
procedure to be taken to install curbs in Rockridge Subdivision. He
was advised that it would have to be handled by the various property
owners and subject to the approval of the County Engineer. Upon Motion
made by Commissioner Waddell, seconded by Commissioner Hamilton and
unanimously carried, it was Ordered that curbs could not be installed
in Rockridge Subdivision without specific approval of the County Engineer.

Mrs. Brown appeared before the Board with regard to
furniture and fixtures for the Small Claims Court. Ed Schmucker
was requested to help Mrs. Brown to prepare the advertising for
the necessary equipment.
Mr. Charles Herring appeared before the Board to report
on progress of Oslo Road right of way. After considerable dis-
cussion, motion was made by Commissioner Waddell, seconded by
Commissioner J. J. P. Hamilton and unanimously carried, that W. C.
Graves be offered $3,200 for right of way of his property, in lieu
of any other compensation. Upon motion made by Commissioner
Hamilton, seconded by Commissioner Macdonald and unanimously
carried, the Elliotts are to be paid $500.00 for their right-of-way.
Mr. Herring stated that he would have complete list
ready for consideration or condemnation at the next meeting.
Mr. Lloyd appeared before the Board and requested
approval of subdivision plat for citrus development. After consi-
erable discussion, Motion was made by Commissioner Waddell, seconded
by Commissioner Hamilton and unanimously carried, to amend plat
regulations to fit this type of plat. Mr. Gould was asked to prepare
the amendment to the plat regulations and present it at the next
meeting. Mr. Lloyd was advised that approval of his plat could not
be made at this time.
Mr. Burks appeared before the Board with regard to water
and sewer franchise in the Gifford area. He was advised that it
would have to be advertised for public hearing and that the notice
presented to the Board was not in proper form and that no action
could be taken until such time it was presented in proper order.
J. Ralph Lundy and others appeared before the Board
with regard to a voting precinct in the Gifford area and they were
advised that a new precinct could not be made at this time, but that
in a couple of years if the population warrants, a new precinct might

be created.
Upon Motion made by Commissioner Waddell, seconded by
Commissioner Macdonald, and unanimously carried, the following
Resolution was adopted.
RESOLUTION
WHEREAS, ARTICLE VIII, Section 5, Constitution of the
State of Florida, provides that there shall be one County
Commissioner in each of the five County Commissioner's
districts in each county, which districts shall be numbered
one to five, inclusive, and shall be as nearly as possible
equal in proportion to population, and requires that the
Board of County Commissioners in the respective counties
shall from time to time fix the boundaries of such dis-
tricts; and,
WHEREAS, the increase and shift in population of Indian
River County, Florida, which have taken place since 1949 have
caused certain of the county commissioner's districts of said
county to become larger in proportion to population than other
of the county commissioner's districts of said county, by rea-
son of which it is now necessary to fix the boundaries of the
county commissioner's districts in said county to the end that
all five districts shall be as nearly as possible equal in pro-
portion to population; and,
WHEREAS, the members of this Board who are present at this
meeting of this Board have agreed unanimously on the fixing of
boundaries of the county commissioner's districts of Indian
River County, Florida, as is evidenced by this resolution,
now, therefore,
BE IT RESOLVED, that the boundaries of the county commis-
sioner's districts of Indian River County, Florida, be and the
same are hereby fixed, effective , as
follows and with each of said districts numbe ed as follows:
Election District No. 1
Begin where the Southeast corner of Lot 8 of Hudson's Sub-
division intersects with the West shore of the Indian River in
Section, 31, Township 30 South, Range 39 East; thence run West
on the South line of Lot 8 of Hudson's Subdivision to the North-
east line of Fleming Grant; thence run Southeast on Fleming
Grant line to intersect with the North line of Ocean Breeze
Heights Subdivision; thence run in a Southwesterly direction

Upon Motion made by Commissioner Waddell, seconded by
Commissioner Hamilton,. and unanimously carried, the following
Resolution was adopted.
RESOLUTION
WHEREAS, by reason of the adoption by the Board of County
Commissioners of Indian River County, Florida, of a resolution
fixing the boundaries of the county commissioner's districts of
Indian River County, Florida, it has become necessary to alter
and create certain registration and election districts and pre-
cincts within said county; and,
WHEREAS, the members of this Board who are present at this
meeting of this Board, being at least four members of this Board,
have agreed unanimously on the altering and creating of such
registration and election districts and precincts; and,
WHEREAS, the Supervisor of Registration of Indian River
County, Florida, is present at this meeting of this Board at the
time of the adoption of this resolution and has recommended and
approved the alterations and creations of such registration and
election districts and precincts as provided by this resolution;
and,
WHEREAS, the registration and election districts and pre-
cincts as altered and created by this resolution are such that no
registration and election district and precinct will lie partly in
one county commissioner's district and partly in another county

BE IT FURTHER RESOLVED, that the Board of County Commissioners.
of Indian River County hereby determines that the bpundaries of
the abovq Districts, as herewith fixed., cause said Districts to
be as nearly as possible equal in proportion to population.
BE IT FURTHER RESOLVED, that it is herewith recited and noted
that the boundary lines of Election Districts in Indian River
County have been fixed and designated at the meeting of this.
Board at which this Resolution is adopted whereby no Election .
District in said County shall lie partly in one County Commis-
sioner's District and partly in another.
BE IT FURTHER RESOLVED, that this Resolution, containing an
accurate description of the boundaries of such County Commission-
er's Districts, shall be entered upon the minutes of this Board;
that a certified copy of this Resolution shall be published once
each week for four (4) consecutive weeks in the Vero Beach Press.
Journal, a newspaper of general circulation published in Indian'
River County, Florida; that the Clerk to this Board shall forth-
with furnish the Secretary of the State of Florida with a certi-
fied copy of the minutes of this Board which shall evidence this
Resolution in full and the adoption thereof and which shall con-
tain the description of the boundaries of the existing County
Commissioner's Districts as herewith fixed and in order that the
Secretary of State shall record a description of such boundaries
in his office in a book kept for that purpose.
J. A. "Coach" Thompson, Superintendent of Schools,
appeared before the Board regarding the location of the new
school districts and stated the School Board wanted to have its
districts conform with those of the County Commissioners, but
could not do so under the proposed plan because School Board
Members, Mrs. Jeannette Merriman and 0. D. Honeywell, would be
placed in one district and.L. D. Baker and Rev. Hendry would be
placed in another district which would bar one incumbent for
re-election.
After careful consideration and much discussion in the
matter, Mr. Thompson was told that the county had been discussing
re -districting nearly eight months and was willing to go along with
the school officials if possible, however, it did not seem advisable
at this time to make any changes because the present plan was the
best solution they could arrive at and had been under consideration
for several months and further that the Board was re -districting on
the basis of population as provided by law.
A certified copy of Resolution No. 1187 adopted by the
City Council concurring in the designation of Clemans Avenue
from State Road 60 North to North Gifford Road as a public road
was received and ordered filed (Note see County Commissioners
Minute Book 7, page 348).
Ed Schmucker requested the Board to approve painting
of the interior, to be done by persons from the Jail, and change
of two partitions of the Health Department, also permission to
build cabinets for Rosemary Richey's office. Upon Motion made by
Commissioner Macdonald, seconded by Commissioner Waddell, and
unanimously carried, the same was approved.
Ed Schmucker asked that he and/or Aubrey Waddell be
given approval to attend the Zoning Conference to be held December
6, 7, 8 and 9 in Tampa. Motion was made by Commissioner Waddell,
seconded by Commissioner Macdonald and unanimously carried, for
Aubrey Waddell and Ed Schmucker to attend.
Mr. Thomas Thompson, Janitor, appeared before the Board
and asked to take over the Courthouselawn care, including the
two buildings and property recently acquired by the County from
Raible, for the sum of $40.00 per month. Upon Motion made by
Commissioner Waddell, seconded by Commissioner Macdonald and
unanimously carried, the request was granted, effective January 1,
1962.
Upon Motion made by Commissioner Waddell, seconded by
Commissioner Hamilton and unanimously carried, Ed Schmucker was
requested to make requisition to the State Road Department for
traffic survey of Route 60 in the Westgate Colony area.
The County Attorney read the recommendations of the
Planning and Zoning Board that a public hearing be held before
this Board on the following:
That the Zoning Map be changed in order that the fol-
lowing described property, situated in Indian River County,
Florida, to -wit:
That part of Indian River County, Florida, lying
South of North Winter Beach Road, North of North
Gifford Road, East of the right-of-way of the
Florida East Coast Railway and West of the
centerline of new U. S. Highway No. 1 (new State
Road No. 5),
be changed from C-1, Commercial District, and C -1-B, Restricted
Commercial District, to M -1-A, Restricted Industrial District,
all subject to public hearing as provided by law.

of the North boundary line of Floravon Shores Subdivi-
sion, according to Plat Book 4, page 78, public records
of Indian River County, Florida, north of the North
city limits of Vero Beach, Florida, to and within 660
feet to the East of the centerline of New U. S. Highway
No. 1 (new State Road No. 5),
be changed from R-2, Single Family District, R-3, Transient Dis-
trict, and C-1 Commercial District, to C -1-B, Restricted Commercial
District, all subject to public hearing as provided by law.
Motion was made by Commissioner Waddell, seconded by
Commissioner Waddell, and carried, that re -zoning is tentatively
approved.
The several bills and accounts against the County, having
been audited, were examined and found correct, were approved and
warrants issued in settlement of same. Such bills and accounts
being on file in the Office of the Clerk of the Circuit Court, the
warrants so issued from the respective funds being listed in the
Supplemental Minute Book as provided by the rules of the State
Auditor, reference to such record and the list so recorded being
made a part of these minutes.
There being no further business, on motion made, seconded
and carried, the Board then adjourned.
