The Board of County Commissioners of Indian.River County, met
at the Courthouse, Vero Beach, Florida, in a regular meeting held at
8:00 o'clock, A. M., Tuesday, February 6, 1962. All members were
present. Also present were Ed Schmucker, County Engineer; John Gould,
Attorney, Al Webber and Freda Wright, Deputy Clerks.
The Chairman asked if there were any changes or additions to be
made to the minutes of January 9 and 23. Commissioner Hamilton asked
that the minutes of January 23 be changed to show that he made the
motion pertaining to the Russell Hurst property. Upon Motion made by
Commissioner Waddell, seconded by Commissioner McCullers and unanimously
carried, the Minutes of January 9 were approved as read and the Minutes
of January 23 as amended were approved as read.
Mr. Dave Albrecht appeared before the Board and asked for county
assistance and equipment for the extention of 13th and 14th avenues.
After some discussion, motion was made by Commissioner Macdonald, seconded
by Commissioner McCullers and unanimously carried, that the county parti-
cipate in the development of the avenues and the work schedule to be con-
trolled by the County and City Engineers.
Mr. Ben Thompson appeared before the Board with regard to payroll
deductions for the United Fund drive. After considerable discussion,
Motion was made by Commissioner Waddell, seconded by Commissioner Hamilton
and unanimously carried, that payroll deductions for county employees are
authorized on a voluntary basis and that if at any time control for these
deductions add costs to county operations, it should be reported to the
Board. Deductions from employees of the Fee Officers will have to be
approved by them individually.
Mr. Harlow G. Fredrick, Jr. and Mr. Robert W. Parker, representing
a group of citrus growers, appeared before the Board and asked if something
could be done to open the old Fellsmere Cross State Road to Kenansville.
After hearing the reasons for the request and upon Motion made by Commis-
sioner Macdonald, seconded by Commissioner Waddell and uanimously carried,
Ed Schmucker, County Engineer, was requested to make a survey of this

road and report to the Board at his earliest convenience in order that
it might be put in the plan for secondary roads.
Upon Motion made by Commissioner Waddell, seconded by Com-
missioner McCullers, and unanimously carried, payment to the Sheriff of
$35.00 for Bond Estreature set aside on Calvin Thomas Milan is authorized.
Upon Motion made by Commissioner Waddell, seconded by Commis-
sioner McCullers and unanimously carried, the following Resolutions for
transfer of money are adopted.

WHEREAS, Indian River County, Florida, filed on June 6, 1958,
application No. BLit 046981, with the Bureau of Land Management,
U. S. Department of the Interior, to purchase certain described
rublic land within the State of Florida under provisions of the
Recreation and Public Purposes Act of June 14, 1926 (44 Stat.741),
as amended for development and use for recreation and other public
purposes and,
WHEREAS, the regulations of the Department of the Interior,
governing procedures under the Act, supra, and supplemental instruc-
tions of the Director of the Bureau of Land Management require, in
consideration of the reduced purchase price to be set because of
the proposed public use of the land, certain assurances that the
purpose and intent of the Act will be fulfilled following; passage
of title of the lands to the State, NOW, THEREFORE,
BE IT RESOLVED by the Board of County Commissioners of Indian
River County, Florida, that Indian River County, Florida, does hereby
obligate itself to the following commitments and consent to the in-
corporation of these commitments, by reference or otherwise, in the
patent or patents issued to the County pursuant to the above identi-
fied application:
A. To maintain the lands open to use by the public for
recreation purposes without discrimination or favor.
B. To make no more than a reasonable charge for the use of
facilities on the land (whether by concession or other-
wise) and to charge no more for entrance to and use of
the area than is charged at other comparable installa-
tions managed by State and local agencies, all charges
to be subject to review and modification by the Secre-
tary of the Interior, under due process procedures.
C. To develop and manage the lands in accordance with an
approved program of utilization, which program must
include a statement of need and a statement of purposes
and objectives and must contain a plan of development,
plan of operation, and time schedules in sufficient
detail to permit effective enforcement by enabling
clear showings of nonperformance if necessary..
D. To allow the Bureau of Land Management, U. S. Depart -
went of the Interior, to manage, consistent with the
recreational objectives of the area, all other values
of the lands and to recognize the right of the United.
States to retain the revenues from such management.
BE IT FURTHER RESOLVED that Indian River County, Florida, does
hereby consent to the inclusion in the patent or patents of a restric-
'tion that no building will or may be constructed on such land which
is more than 38 feet above mean sea level.

E. C. Railway with regard to.railway crossing south of town. 8d gchm eker

Board.
John Gould presented for Jack Jennings a plat of Floralton
Beach Subdivision for re -plating. After some discussion and upon Motion
made by Commissioner Macdonald, seconded by Commissioner McCullers, and
carried, replat is granted, said replat will show dedication of street on
Block C and D of Floralton.Beach Subdivision.
Upon Motion made by Commissioner Macdonald, seconded by
Commissioner McCullers and unanimously carried, the County Attorney was
authorized to notify General Waterworks, purchasers of the Rockridge Water
Franchise, that the Board would not take action with regard to the Franchise.
( Mr. Gould advised the Board that the Franchise was purchased on a Mortgage
Foreclosure and no action was necessary.)

Mrs. Baisden and others, representing the Roseland Woman's
Club, appeared before the Board in regard to the Roseland dump. Commis-
sioner Macdonald advised them that a fence would be built around the
dump, that the county bulldozer would be sent more ofter and that every-
body concerned would have to cooperate if the dump is to be kept in a
more favorable condition.
Upon Motion made by Commissioner Macdonald, seconded by Com-
missioner McCullers and unanimously carried, Rosemary Richey, Supervisor
of Registration, was authorized to attend Registrar School in Tallahassee

Mr. Robert R. Atha appeared before the Board and requested
abandonment of easement in Tropicana Subdivision. He was advised that he
would have to get approval from the power company who is using the ease-
ment before any action can be taken by the Board.
Mr. F. M. Loughlin, State Auditor, appeared before the Board
and suggested that several outstanding county warrants be cancelled and
the monies returned to their respective funds. Upon Motion made by
Commissioner Waddell, seconded by Commissioner Hamilton and unanimously
carried, the following Resolution was adopted authorizing same.

RESOLUTION
BE IT RESOLVED by the Board of County Commissioners of
River County, Florida, that this Board does herewith find and determine
as follows:
WHEREAS, R. A. WINN and MARY E. WINN, his wife, 'have
applied to the Board of County Commissioners of Indian River County,
Florida, at their regular meeting on Tuesday, December 5, 1961, to
vacate that certain 10 foot easement as shown on Plat of Wyn Cove Sub-
division, which plat is filed in the office of the Clerk of the Circuit Court
of Indian River County, Florida and recorded in Plat Book 4, page 61,
said 10 -foot easement running from the easternmost termination of :Wyn
Cove Drive to the Atlantic Ocean, and
WHEREAS, R. A. WINN and MARY E. WINN, his wife, have
shown that they are owners in fee simple to the title to that property on
which the easements are sought to be released and vacated; and
WHEREAS, R. A. WINN and MARY E. WINN, his wife, have pro-
posed to substitute for said easement an easement over and across the
North 10 feet of Parcel A and over and across the West 10 feet of Parcel
A, north of Wyn Cove Drive, according to that certain plat of Wyn Cove
Subdivision recorded in Plat Book 4, page bl, public records of Indian
River County, Florida; and
WHEREAS, said Board of County Commissioners, upon proof duly
shown, has found that there is not now, or ever has been, any use made
by the public of said easement on said plat which is herein sought to be
vacated; and
WHEREAS, said Board of 65unty Commissioners has found that
said property is not located in any incorporated city or town, and that it
r the best interest of the public and the owners of said property that said
plat be vacated insofar as the aforesaid easement is concerned; and
WHEREAS, said Board of County Commissioners does further
find that it was authorized and empowered by Chapter 57-1412, Special

Acts of 1957, by Resolution adopted without Public Notice or Hearing to vacate
and abandon and to relinquish and disclaim the rights of the public acquired by
dedication or otherwise to any and all rights-of-way, easements or alleys,
either conveyed to said County or dedicated to the public by Plat or Deed
recorded in said County; and
WHEREAS, said Board of County Commissioners has found that Delia
J. Mitchell is the owner of the property immediately North of the property
owned by the Petitioners and that Henry A. West is the owner of the property
immediately South of the property owned by the Petitioners, and that both of
said property owners have consented in writing to the vacating and relocation
of the easements as proposed in the Petition of R. A. Winn and Mary E. Winn,
his wife.
NOW, THEREFORE, BE IT RESOLVED that that certain ten -foot ease-
ment shown on the Plat of Wyn Cove Subdivision recorded in Plat Book 4, page
61, extending from the Atlantic Ocean along the South lot line of Parcel A for a
distance of 288 feet and extending from this point on the Southerly line of said
Parcel A in a Northwesterly direction a distance of 128.75 feet to Wyn Cove
Drive, be, and the same is hereby vacated, abolished and abandoned, and the
rights of Indian River County and the public therein are hereby -relinquished an(
disclaimed forever, and there is substituted therefor an easement described as
follows:

South, Range 39 East; the sane to be changed from R-1, Single Family
District, to M -1-A, Restricted Industrial District, subject to public
hearing.
Ed Schmucker reported that FAA has approved extention of Clemanns
Avenue, subject to City Council approval. Ed Scbmacker was requested to
obtain necessary information for this extention in order that it may be
included in the secondary road plan.
Motion was made by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried, that the County not be charged for
permits for county construction on county lands outside of the municipal
limits.
Motion was made by Commissioner Hamilton, seconded by Commissioner
McCullers and unanimously carried, that Charles Herring, Attorney, is
authorized to file condemnation proceedings on Oslo and Citrus Roads and
that Al Webber, Deputy Clerk, is authorized to pay necessary amount for
cost of same.
Mr. Butler, representing Realtors from Melbourne, appeared before
the Board and invited the Chairman to attend a meeting with the Realtors n
in Melbourne on February 21, to discuss AlA extention. The Chairman fel=

requested a letter be written before the meeting and he would advise
whether or not he would attend. s
The County Engineer requested information as to how such bond
should be required for subdivision developers if the subdividers adver-

Upon Motion made by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried, the Board tentatively approves that
the Zoning Map be changed from C-1, Commercial District, to M-1, Indus-
trial District, on the following described property, to -wit:
That area East of the Florida East Coast Railway West of a
point 660 feet West of the centerline of U. S. Highway
No. 1 (State Road No. 5) South of the Vero Beach City Limits

Mrs. Christensen, County Welfare Worker, appeared before the
Board and gave a report of her activities for the month of February.
Upon Motion made by Commissioner Macdonald, seconded by Com-
missioner McCullers and unanimously carried, $98.87 is authorized to•be
paid to Commissioner Waddell for travel expenses on trips to Cocoa,
Orlando and Tallahassee.

The several bills and accounts against the County, having been
audited, were examined and found correct, were approved and warrants
issued in settlement of same as follows: General Revenue, Warrant Nos.
324 to 384 both inclusive, Road and Bridge Fund, Warrant Nos. 226 to
260, both inclusive, Fine and Forfeiture Fund, Warrant Nos. 28 to 33
both inclusive,and Capital Outlay, Warrant Nos. 13 to 18, both inclusive.
Such bills and accounts being on file in the office of the Clerk of the
Circuit Court, the warrants so issued from the respective funds being
listed in the Supplemental Minute Book as provided by the rules of the
State Auditor, reference to such record and the list so recorded being
made a part of these minutes.
