The Board of County Commissioners of Indian River County, met.
at the Courthouse, Vero Beach, Florida, in a regular meeting held at
8:00 o'clock, A. M. Tuesday, April 10, 1962. Present were Robert W.
Graves, Chairman, and members Donald Macdonald, B. Q. Waddell and J. J. P.
Hamilton. Absent was D. B. McCullers. Also present were Ed Schmucker,
County Engineer, John Gould, Attorney, Al Webber and Freda Wright, Deputy
Clerks.
The Chairman asked if there were any changes or additions to be
made to the minutes of March 6 and March 27, 1962. There were none and
upon Motion made by Commissioner Hamilton, seconded by Commissioner
'Waddell and unanimously carried, the minutes were approved as read.
The Chairman read a letter from the Florida Development Commis-
sion advising that there are certain sums of money set aside for Indian
River County for aviation purposes. The County Attorney was requested to
write the Commission as to specific use of the money and upon receiving
this information, to send a copy to the City of Sebastian and the City of
Vero Beach.
Rosemary Richey, Supervisor of Registration, appeared before the
Board and requested authorization for her and two other persons to attend
a school of instruction in Tampa on April 10, 1962. She also asked the
Board if she might hire someone to set up the voting machines at such
time as necessary and suggested that James Roberts, Service Officer, would
possibly be interested. The Chairman suggested that she find out all the
particulars and report to the Board for further action. Upon Motion made
be Commissioner Waddell, seconded by Comissioner Hamilton and unanimously
carried, the trip to Tampa was authorized.
Al Webber requested a transfer of money to pay freight bill on
the voting machines. Upon Motion made by Commissioner Waddell, seconded
by Commissioner Macdonald and unanimously carried, the requested transfer
was granted and the following Resolution adopted.

WHEREAS, there is a total surplus of $595.18 in the Capital
Outlay Fund of Indian River County under some items and which surplus
exists after payment of all necessary expenditures under such items
for the current fiscal year; and
WHEREAS, there is a deficiency in funds necessary to provide
for the proper and authorized expenditures under some items in the
Capital Outlay Fund; and
WHEREAS, said items mentioned are a part of the same fund and
the transfer from one item to another item in the same fund and is not
a transfer from one fund to another fund; therefore,
BE IT RESOLVED that there is herewith transferred the sum of
$595.18 from some items where there is a surplus to the items where
there is a deficiency, according to detailed statement attached, all
in the Capital Outlay Fund of the current budget of Indian River County
as provided by law.

The Chairman stated that he had been requested to have the
alignment of A -1-A and the Sebastian Inlet bridge changed. After some
discussion and upon Motion made by Commissioner Waddell, seconded by
Commissioner Hamilton and unanimously carried, the Chairman was re-
quested to notify the State Road Department to proceed with the road
and bridge as the alignment now stands without further delay.
Al Webber, Deputy Clerk, presented a letter from the Sheriff
stating that the Sheriff wanted a budget amendment in'order to purchase
three new cars and a car radio for the Sheriff's department. ,Upon
Motion made by Commissioner Macdonald, seconded by Commissioner Waddell
and unanimously carried, the request was granted and the'following
Resolution adopted.

The County Service Officer and the County Agent filed their monthly
reports with the Board.
The Chairman read a letter from the Legislative Council stating
there there would be a meeting for the purpose of hearing any complaints
with regard to shell homes in this area. The County Attorney was requested
to send a copy of the letter to the various lumber companies and if they
have any complaints, the Board will make necessary arrangements to follow
up the matter.
The County Attorney read a letter from the Bureau of Land Manage-
ment requesting the Board to adopt a plan for the use of the beach property
just North of the Missile tracking station and if the plan meets with
their approval it can be purchased by the county for $50.00. The Chairman
suggested that the Board as a whole get together and work out plans to sub -

mit to the Bureau for approval.
Commissioner Macdonald stated that Mr. Hurst was again requesting
the Board for further help with regard to the high enbankment on his pro-
perty. After some discussion and upon Motion made by Commissioner Mac—
donald, seconded by Commissioner Waddell and unanimously carried, the
County Attorney is requested to prepare a release to be signed by Mr.
Hurst before the work is done and the County Engineer is requested to
build the headwall at a cost of about $400.00.
The County Engineer reported that there were about four crossings
that would need culverts on the Fellsmere Cross State Road and that he

member that wish:. to go would go out and make a personal
inspection of the road to determine just what the situation is.

Gentlemen:
The undersigned, Chas. E. Smith, of Heath, Smith & Herring,
attorneys for Petitioners, A. T. LeFEVRE and ALICE K. LE FEVRE, his
wife, does herewith petition you to adopt a resolution closing, vacating and
abolishing the public roads, streets and rights-of-way located on the plat
of CARVER COLONY SUBDIVISION, #1, as recorded in Plat Book 4, page 87,
Indian River County public records, as it pertains to the following described
propery situated in Indian River County, Florida:
All of the right-of-way of 40th Avenue as shown
on the plat of Carver Colony Subdivision #1, as
recorded in Plat Book 4, page 87, Indian River
County public records, EXCEPT the west 30 feet
of said 40th Avenue;
and requests said Board to renounce and disclaim any rights of the said County
and the public in and to the above described public roads, streets and rights-
of-way as delineated on said recorded plat.

wife, are the owners of the property adjoining the above property sought to
be anandoned and the said property sought to be anandoned is not a State or

is authorized to be advertised ons the foregoing Petition.
The County Engineer stated that Mr. Bartholomew will give right of
way on old dixie,highway for 12 truck loads of snarl. The Chairmaa •

stated that the Board had already agreed that there would be no considera-
tion give for right-of-way on that part of old dixie highway, except a
zoning change.
The County Engineer suggested that the Board authorize a transfer
of $35,000.00 in order that a tract of land could be purchased and im-
provements thereof for a county dump. After some discussion and upon
Motion made by Commissioner Macdonald, seconded by Commissioner Waddell
and unanimously carried, the request is granted and the County Attorney
is requested to prepare the Resolution and advertise for public hearing
on the budget change.
The Chairman appointed Commissioner Macdonald, Commissioner Waddell
and the County Engineer as a committee to set up a dump program.
The County Engineer suggested that the county transfer $10,000.00
to the Road and Bridge Fund in order that he might asphalt Citrus Road.
Commissioner Waddell did not think this advisable and requested the
County Engineer to patch up the road at a leaser cost at this time.
The County Engineer stated that the dump custodians had agreed to
work from 7:00 o'clock A. M. to 7:00 o'clock, P. M. and that Mr. Whitfield
had started building a shack on the South county dump. No action was taken
and the matter tabled until the next meeting.
The County Engineer stated that a group of citizens from Wabasso
had requested that the crossing gates at West Wabasso crossing be installed
right away if possible. After some discussion Motion was made by Commis-
sioner Macdonald, seconded by Commissioner Hamilton and unanimously carried,
that the State Road Department be requested to proceed with the crossing
gates at Wabasso Road and Roseland Road as soon as the centerline has
been established and the following Resolution adopted regarding same.

Gentlemen:
The undersigned, Chas. E. Smith, of Heath, Smith & Herring,
attorneys for Petitioners, A. T. LeFEVRE and ALICE K. LE FEVRE, his
wife, does herewith petition you to adopt a resolution closing, vacating and
abolishing the public roads, streets and rights-of-way located on the plat
of CARVER COLONY SUBDIVISION, #1, as recorded in Plat Book 4, page 87,
Indian River County public records, as it pertains to the following described
propery situated in Indian River County, Florida:
All of the right-of-way of 40th Avenue as shown
on the plat of Carver Colony Subdivision #1, as
recorded in Plat Book 4, page 87, Indian River
County public records, EXCEPT the west 30 feet
of said 40th Avenue;
and requests said Board to renounce and disclaim any rights of the said County
and the public in and to the above described public roads, streets and rights-
of-way as delineated on said recorded plat.

is authorized to be advertised ons the foregoing Petition.
The County Engineer stated that Mr. Bartholomew will give right of
way on old dixie,highway for 12 truck loads of snarl. The Chairmaa •

stated that the Board had already agreed that there would be no considera-
tion give for right-of-way on that part of old dixie highway, except a
zoning change.
The County Engineer suggested that the Board authorize a transfer
of $35,000.00 in order that a tract of land could be purchased and im-
provements thereof for a county dump. After some discussion and upon
Motion made by Commissioner Macdonald, seconded by Commissioner Waddell
and unanimously carried, the request is granted and the County Attorney
is requested to prepare the Resolution and advertise for public hearing
on the budget change.
The Chairman appointed Commissioner Macdonald, Commissioner Waddell
and the County Engineer as a committee to set up a dump program.
The County Engineer suggested that the county transfer $10,000.00
to the Road and Bridge Fund in order that he might asphalt Citrus Road.
Commissioner Waddell did not think this advisable and requested the
County Engineer to patch up the road at a leaser cost at this time.
The County Engineer stated that the dump custodians had agreed to
work from 7:00 o'clock A. M. to 7:00 o'clock, P. M. and that Mr. Whitfield
had started building a shack on the South county dump. No action was taken
and the matter tabled until the next meeting.
The County Engineer stated that a group of citizens from Wabasso
had requested that the crossing gates at West Wabasso crossing be installed
right away if possible. After some discussion Motion was made by Commis-
sioner Macdonald, seconded by Commissioner Hamilton and unanimously carried,
that the State Road Department be requested to proceed with the crossing
gates at Wabasso Road and Roseland Road as soon as the centerline has
been established and the following Resolution adopted regarding same.

The County Engineer stated that he had been out to Wallace Acres
subdivision and that Mr. Wallace had complied with all plat regulations
except for a through street and that the adjoining property owner did
not object to this and requested the Board to tentatively approve the
plat for recording in the Plat record book in the Clerk's office. The
same has been recorded in Official Record Book 119 page 276 as a sketch
of information. Motion was made by Commissioner Macdonald, seconded by
Commissioner Waddell and unanimously carried, that a tentative plat of
Wallace Acres as set forth in Official Record Book 119, page 276, public
records of Indian River County, Florida, be and the same is herewith
approved.
The County Engineer presented a Petition from Mr. DeKold with
signatures of the various property owners, requesting the county to
extend Rosedale and Glendale Roads to Lateral D4. The Chairman stated
that the first step would be to secure right-of-way and that at such time
that he had the time and funds further action could be taken.
Gladys Vigliano, County Welfare worker, gave a brief oral report
of her activities for the month of March and filed a written report report
with the Board for the month.
The County Engineer presented a letter of resignation from John
W. Massey, member of the Indian River County Planning and Zoning Board
of Adjustment. The Chairman suggested that the County Engineer contact
Ed Massey and see if he would fill the vacancy and if so1submit his name
torthe Governor for appointment and if not to submit the name of Earl
Groth.
The County Engineer stated that the Planning and Zoning Board
had tentatively approved a zoning change on Lots 1 to 13, both inclusive
Block A, Lakewood Terrace.Subd&yision Unit #1., from C-1, single family
to R -2-A Multiple family. Upon Motion made by Commissioner Macdonald,

The County Attorney read a letter from Mrs. A. D. Quarles
regarding injuries she received from a fall in the Courthouse. She
requested the county to reimburse her for part of her hospital and
medical expense. The County Attorney was requested to write to Mrs.
Quarles as to the liability, if any, of the county.
Motion was made by Commissioner Macdonald, seconded by Commis-
sioner Waddell and unanimously carried, that the secretary advise all
County Officials in the Courthouse to meet with the Board on April 24,
1962, after their regular meeting to discuss accounting problems.
Upon advice of the County Attorney $10.00 commission fee for
Planning and Zoning Board member, John Massey, is authorized.
