and WHEREAS , EXECUTIVE ORDER NUMBER 04 - 192 ( Emergency Management) was issued by Jeb Bush , the Governor of the State of Florida , on September 1 , 2004 that declared that Hurricane Frances , alone and in combination with the destruction by Hurricane Charley, threatens the State of Florida with a catastrophic disaster; and WHEREAS , EXECUTIVE ORDER NUMBER 04 - 192 ( Emergency Management) declared that a state of emergency exists in the State of Florida for sixty (60 ) days from September 1 , 2004 , unless extended ; and WHEREAS , EXECUTIVE ORDER NUMBER 04 -206 ( Emergency Management) dated September 10 , 2004 , extended the state of emergency that exists in the State of Florida for sixty ( 60 ) days from September 10 , 2004 , that is , until November 10 , 20049 unless further extended ; and WHEREAS , Section 8 of each of the aforementioned EXECUTIVE ORDERS found that the special duties and responsibilities resting upon some state , regional and local agencies and other governmental bodies in responding to the disaster may require them to deviate from the statutes , rules , ordinances , and orders they administer, and therefore gave such agencies and other governmental bodies the authority to take formal action by emergency rule or order in accordance with Sections 120 . 54 (4 ) and 252 . 46 (2 ) , Florida Statutes , to the extent that such actions are needed to cope with this emergency ; and WHEREAS , by operation of law , the aforementioned EXECUTIVE ORDERS , Florida Statutes sections 252 . 36 , 252 . 38 , and 252 . 46 , and Indian River County Resolution 2004 - 118 , the Indian River County Board of County Commissioners sitting as the Board of Commissioners of the Emergency Services District of Indian River County has the 1 authority to issue orders and rules during the period of the declared emergency , and has delegated the ability to issue Emergency Orders for Indian River County to the County Administrator, and WHEREAS , EXECUTIVE ORDER 04 - 188 was issued by Jeb Bush , the Governor of the State of Florida on August 25 , 2004 , suspending the provisions of Section 489 . 113 (3 ) , Florida Statutes as set forth therein , but only for the therein -enumerated counties ; and WHEREAS , EXECUTIVE ORDER NUMBER 04-210 , issued by Jeb Bush , the Governor of the State of Florida , on September 14 , 2004 : incorporated EXECUTIVE ORDER 04- 197 by reference into EXECUTIVE ORDER NUMBER 04 -210 ; extended the effectiveness thereof throughout the State of Florida ; and extended the effective date until the expiration thereof, i . e . , until November 13 44_ , 2004 , as provided in Section 5 thereof; and WHEREAS , EXECUTIVE ORDER NUMBER 04 -241 issued by Jeb Bush the Governor of the State of Florida , on November 10 2004 • incorporated EXECUTIVE ORDER 04- 197 and EXECUTIVE ORDER NUMBER 04-210 by reference into EXECUTIVE ORDER NUMBER_ 04-241 ; extended the effectiveness thereof throughout the State of Florida ; and extended the effective date until the expiration thereof, i . e , , until May 9 , 2005 , as provided in Section 3 thereof; and WHEREAS , due to the declared state of emergency as set forth above Indian River County desires to adopt EXECUTIVE ORDER NUMBER 04-241 , as more specifically set forth in this Emergency Order, solely from the period commencing October 5 , 2004 and ending no later than 5 . 00 pm on May 9 , 2005 and applicable throughout Indian River County' s jurisdiction with respect to subcontracting of roofing work for the repair and installation of roofs made of wood shakes , or asphalt or fiberglass shingles in Indian River County ; and WHEREAS , due to the declared state of emergency as set forth above , Indian River County desires to adopt EXECUTIVE ORDER NUMBER 04 -241 24-0, as more specifically set forth in this Emergency Order, solely from the period commencing IOctober 5 , 2004 and ending no later than 5 : 00 pm on May 9 , 20059 ber-4-4 2094; subject to the self-executing extension set forth herein , and applicable throughout Indian River County's jurisdiction with respect to the issuance of specialty roofing licenses in Indian River County, NOW, THEREFORE , this Emergency Order is issued declaring that solely from Ithe period commencing October 5 , 2004 and ending no later than 5 : 00 pm on May 9 , 2005 , November- 14 , subject to the self-executing extension set forth herein , and applicable throughout Indian River County's jurisdiction , Indian River County adopts EXECUTIVE ORDER NUMBER 04-241 " � as more specifically set forth in this Emergency Order, with respect to the issuance of specialty roofing licenses in Indian River County, as follows : 2 1 . The provisions of Section 489 . 117 , Florida Statutes , are suspended to the extent that local jurisdictions are authorized to issue local specialty licenses , without additional local ordinances , for the repair and installation of roofs made of wood shakes , or asphalt or fiberglass shingles . 2 . All applicants for these specialty roofing licenses shall provide : (A ) an affidavit of competency from their original jurisdiction ; ( B ) proof of compliance with applicable workers ' compensation as required by Chapter 440 , Florida Statutes ; and ( C ) public liability and property damage insurance as required by Section 489 . 115 ( 5 ) (a ) , Florida Statutes , to the Indian River County Building Department . 3 . All specialty roofing licenses issued by Indian River County pursuant to this Emergency Order shall be subject to a minimum processing fee of One Hundred Dollars ($ 100 . 00 ) , payable in cash or by credit card . 4 . All specialty roofing licenses issued by Indian River County pursuant to this Emergency Order shall last for a period of 90 days , provided , however, that all jobs issued permits during the 90 day period shall be allowed to be completed . FURTHER „ this Emergency Order declares that solely from the period commencing October 5 , 2004 and ending no later than 5 . 00 pm on May 9 , 2005 , and applicable throughout Indian River County's iurisdiction , Indian River County adopts EXECUTIVE ORDER NUMBER 04 =197 , as extended by EXECUTIVE ORDER NUMBER 04 =241 , as follows : the provisions of Section 489 113 (3 ) , Florida Statutes , are suspended in all Counties in the State of Florida to the extent that a certified , or registered , general , building , or residential contractor is not required to subcontract roofing work for the repair and installation of roofs made of wood shakes or asphalt or fiberglass shingles . THIS EMERGENCY ORDER shall be in effect throughout Indian River County's jurisdiction from October 5 , 2004 and shall expire no later than 5 : 00 pm on May 9 , 2005 Nevember 14 , , subject to the self-executing extension set forth herein , unless further extended by subsequent Emergency Order.
