HomeMy WebLinkAbout2004-260 BOARD OF COUNTY COMMISSIONERS 1584650 THIS DOCUMENT HAS BEEN RECORDED r` JL IN THE PUBLIC RECORDS OF ►� INDIAN RIVER COUNTY FL BK : 1793 PG : 223 , Pagel of 3 10/22/2004 at 01 : 52 PM , �LQRIpA COURT JEFFREY K BARTON, CLERK OF INDIAN RIVER COUNTY EMERGENCY ORDER 2004 = 11 [MODIFYING THE SEALED BID THRESHOLD FROM $ 5 , 000 TO $ 25 , 0001 [HURRICANE FRANCES AND HURRICANE JEANNE] WHEREAS , EXECUTIVE ORDER NUMBER 04 - 192 ( Emergency Management ) was issued by Jeb Bush , the Governor of the State of Florida on September 1 , 2004 that declared that Hurricane Frances , alone and in combination with the destruction by Hurricane Charley , threatens the State of Florida with a catastrophic disaster; and WHEREAS , EXECUTIVE ORDER NUMBER 04 - 192 ( Emergency Management ) declared that a state of emergency exists in the State of Florida for sixty ( 60 ) days from September 1 , 2004 , unless extended ; and WHEREAS , EXECUTIVE ORDER NUMBER 04 -206 ( Emergency Management ) dated September 10 , 2004 , extended the state of emergency that exists in the State of Florida for sixty (60 ) days from September 10 , 2004 , that is , until November 10 , 2004 , unless further extended ; and WHEREAS , EXECUTIVE ORDER NUMBER 04 -217 ( Emergency Management ) CldtE;d 5epieinuer G4 , 2u04 , exti; meed the �tatc �;f $ i ei 'gc � C� ' t . cit ei� ijt� ii'r tiic .S'. tiatc: : ` Florida for sixty ( 60 ) days from September 24 , 2004 , that is , until November 24 , 20049 unless further extended ; and WHEREAS , Section 8 of each of the aforementioned EXECUTIVE ORDERS found that the special duties and responsibilities resting upon some state , regional and local agencies and other governmental bodies in responding to the disaster may require them to deviate from the statutes , rules , ordinances , and orders they administer, and therefore gave such agencies and other governmental bodies the authority to take formal action by emergency rule or order in accordance with Sections 120 . 54 (4 ) and 252 . 46 (2 ) , Florida Statutes , to the extent that such actions are needed to cope with this emergency ; and WHEREAS , by operation of law, the aforementioned EXECUTIVE ORDERS , Florida Statutes sections 252 . 36 , 252 . 38 , and 252 . 46 , and Indian River County Resolutions 2004 — 95 , 2004 — 096 , and 2004 - 118 , the Indian River County Board of 1 County Commissioners sitting as the Board of Commissioners of the Emergency Services District of Indian River County has the authority to issue orders and rules during the period of the declared emergency , and has delegated the ability to issue Emergency Orders for Indian River County to the County Administrator, WHEREAS , Section 105 . 01 of the Code of Indian River County provide as follows : Section 105 . 01 . Authority of county administrator. Except as otherwise provided by Florida Statutes , the county administrator or his designee is granted authority to purchase or contract for supplies , materials , equipment , real property , or services (other than services under section 287 . 055 , F . S . ) costing five thousand dollars ($ 5 , 000 . 00 ) or less for the county after taking such action as the county administrator shall deers necessary to obtain the best price for the county. Any such purchase or contract may be executed by the county administrator in the name of the county without commission action , although copies of any such contracts shall be available to the commission for inspection . In an emergency, contracts for purchase of parts or repairs to then -existing county equipment or machinery may be purchased or contracted by the county administrator in his capacity as the county administrator, provided the county administrator certifies that a true emergency exists , and routes a copy of the contract to the commission for its inspection with a memorandum describing the emergency situation . WHEREAS , due to the declared state of emergency as set forth above , Indian River County desires to modify Section 105 . 01 of the Code of Indian River County as follows , solely from the period commencing October 15 , 2004 and ending at 5 : 00 pm on November 24 , 2004 : Section 105 . 01 . Authority of county administrator. Except as otherwise provided by Florida Statutes , the county administrator or his designee is granted authority to purchase or contract for supplies , materials , equipment , real property , or services (other than services under section 287 . 055 , F . S . ) costing #vefwenty-five thousand dollars ($ 25 , 000 . 00 ) or less for the county after taking such action as the county administrator shall deem necessary to obtain the best price for the county, including, without limiting the generality of the foregoing, allowing the county to obtain and use written quotes from vendors, suppliers, or contractors in place of sealed bids where the purchase price is twenty-five thousand dollars ($25, 000. 00) or less . Any such purchase or contract may be executed by the county administrator in the name of the county without commission action , although copies of any such contracts shall be available to the commission for inspection . In an emergency , contracts for purchase of parts or repairs to then -existing county equipment or machinery may be purchased or contracted by the county administrator in his capacity as the county administrator, provided the county administrator certifies that a true 2 emergency exists , and routes a copy of the contract to the commission for its inspection with a memorandum describing the emergency situation . NOW, THEREFORE , this Emergency Order is issued declaring that the Coun Administrator is authorized to Purchase and sign contracts for supplies, materials, equipment, real property, or services (other than services under section 287 055, F. S. ) costing twenty-five thousand dollars ($25, 000. 00) or less for Indian River County where Indian River County has obtained written quotes from vendors suppliers, or contractors in place of sealed bids where the purchase price is twenty five thousand dollars ($25, 000. 00) or less from October 15 , 2004 until 5 : 00 PM on November 24 , 2004 , unless further extended by subsequent Emergency Order.
