TINDALE -OLIVER & ASSOCIATES , INC .
WHEREAS , on March 16 , 2004 , the County entered into a four month contract
with TINDALE -OLIVER & ASSOCIATES , INC . to provide consulting services to
complete an impact fee study for 8 new impact fees ; and
WHEREAS , on June 8 , 2004 , the Board of County Commissioners approved an
8 week contract extension to provide time for the School District of Indian River County
to complete its five year capital improvement plan and to provide time for the School
District to review and comment on the impact fee study; and
WHEREAS , both Hurricane Frances and then Hurricane Jeanne , beyond the
control of either the County or Tindale-Oliver & Associates , Inc . , disrupted county
government and school operations severely, therefore limiting the amount of available
time for county and school district staffs to review and provide comments to consultants
regarding the Impact Fee Study and necessitating that the agreement be extended ,
NOW, THEREFORE , in consideration of the following mutual covenants and
agreements INDIAN RIVER COUNTY , FLORIDA and TINDALE -OLIVER &
ASSOCIATES , INC . do agree as follows :
1 . The original agreement , dated March 16 , 2004 , shall remain in full force and
effect until February 28 , 2005 .
2 . Except as supplemented herein , the terms and conditions of the Agreement
shall remain in full force and effect . To the extent of any conflict between the
terms of this Amendment and the terms of the Agreement , the terms of this
Amendment shall control .
