HomeMy WebLinkAbout2003-051 o -v � IMPLEMENTATION OF THE EAST INDIAN RIVER COUNTY MASTER STORMWATER MANAGEMENT PLAN : WORK ORDER No . 4 TO THE PROFESSIONAL ENGINEEERING SERVICES AGREEMENT BETWEEN CARTER ASSOCIATES, INC., AND INDIANRIVER COUNTY, FLORIDA FOR A PRELIMINARY ENGINEERING REPORT FOR VORTEX-TYPE TREATMENT UNITS AND FLOATING DEBRIS BOOMS IN THE MAIN RELIEF CANAL AND SOUTH RELIEF CANAL Pursuant to the Professional Engineering Services Agreement ( MASTER AGREEMENT ) dated May 8 , 2001 , by and between INDIAN RIVER COUNTY , a political subdivision of the State of Florida , hereinafter referred to as the COUNTY , and CARTER ASSOCIATES , INC . , Vero Beach , Florida , hereinafter referred to as the ENGINEER , this WORK ORDER No . 4 is an extension of and hereby becomes a part of the MASTER AGREEMENT as follows : SECTION 1 = PROJECT LIMITS AND DESCRIPTION In accordance with the East Indian River County Master Stormwater Management Plan ' s ( Master Plan ) recommended improvements and actions , WORK ORDER NO . 4 is for the preparation of a Preliminary Engineering Report for the feasibility of vortex-type stormwater treatment systems and floating boom systems as discussed in Alternatives No . 3 and 4 of the Master Plan . A vortex-type stormwater treatment system and a floating boom system will be considered at a selected location in the Main Relief Canal and at a selected location in the South Relief Canal . This Work is discussed in more detail in SECTION III — SCOPE OF SERVICES PROVIDED BY THE ENGINEER . SECTION II = COUNTY OBLIGATIONS A . The COUNTY will comment on the ENGINEER ' s work in a timely fashion . SECTION III - SCOPE OF SERVICES PROVIDED BY THE ENGINEER A. PROJECT ASSIGNMENTS The "design team " is collectively comprised of Carter Associates , Inc . and FAPublic Works\KeithM\Stc mwater Projects\East IRC\Contracts\Cmsultant Contract with Carter & Associates\Wcrk Order No. 4 - Vortex Treatment Units\Work Order #4 - Latest Version .doc 1 Environmental Consulting & Technology, Inc . Specific assignments follow : 1 . Carter Associates , Inc . ( CAI ) —CAI shall provide project quality control services . The following CAI personnel are required to work on this project : a . Dean F . Luethje , P . E . 2 . Environmental Consulting & Technology ( ECT ) — ECT shall provide all preliminary engineering design and related work . The following ECT personnel are required to work on this project : a . Frank E . Marshall , P . E . , Ph . D . b . Robert Naleway, P . E . C , Lora Saunders , Associate Scientist Be GENERAL The pollution prevention projects covered by this Work Order are intended to remove pollutants (suspended solids in particular and to a lesser extent , nutrients ) and floating material from the waters of the Main and South Relief Canals . The projects ' purpose is to protect the water quality of the Indian River Lagoon and thereby aid in restoring the Lagoon ' s seagrass coverage . The proposed vortex treatment structures shall be located as far downstream in the canals as practical . co ENGINEERING SERVICES Task 1 - Preliminary Engineering Report - Prepare a preliminary engineering report . This report will primarily focus on vortex-type stormwater pollution removal devices , but it will also include preliminary engineering designs of floating boom systems . The first focus of the report is to expand the original investigation and analysis of vortex systems that was performed for the Master Plan . In accordance with this , continue the original investigation in more detail and verify that vortex-type stormwater pollution removal devices are applicable and recommended for the proposed application . If this further investigation reconfirms that they are an appropriate and recommended pollution control application , then expand the preliminary engineering report to include , but not be limited to : recommend a manufacturer ( performance specifications will be written around this manufacturer in a future Work Order) ; perform field inspections of representative installations and collect data on pollutant removal efficiencies of existing systems ; investigate potential installation locations along the Main and South Relief Canals and recommend a location in each canal ; determine whether tilting weir gate structures should be constructed adjacent to the proposed vortex structures to provide operational head and to provide canal drawdown capabilities in anticipation of a major storm event ; investigate vacuum trucks and discuss the types of vacuum trucks that are capable of cleaning the vortex structures (and similar structures such as baffle boxes , catch basins , etc . ) and the capital and yearly operating costs of each truck ; investigate potential conflicts with existing utilities ; recommend a floating boom manufacturer (technical specifications will be written around this manufacturer in a future Work F:\Pubhc Works\KeithM\Sto.mwater ProjectsTast IRC\Contracts\Consultant Contract with Carter & Associates\Wak Order No. 4 - Vortex Treatment Units\Work Order #4 - Latest Version .doc 2 Order) ; provide a preliminary opinion of probable construction costs for the vortex units and floating booms , including yearly operation and maintenance costs ; determine probable pollutant removal efficiencies for the vortex devices ; and address safety concerns in the event that public access is provided to or near the treatment facilities for public education purposes . The preliminary engineering report shall discuss findings , calculations , costs , recommendations , cost/benefit analysis , etc . , and it shall include preliminary engineering drawings for the recommended installations . Additionally, investigate permitting requirements for installing the structures . Determine which agencies will have jurisdiction and discuss the proposed project with each of those agencies to determine their permitting requirements and design/construction constraints . Task 2 - Project Meetings - Meet with COUNTY and IRFWCD personnel as requested by the COUNTY at the County Administration Building or project site . As a minimum , the following meetings will be held : a . At least 3 coordination meetings to discuss the project and develop criteria to guide the Preliminary Engineering Report , and one or more meetings to review the Preliminary Engineering Report . b . Meet with local and state regulatory personnel as necessary to determine design constraints and to minimize final design efforts . SECTION IV = TIME FOR COMPLETION After the COUNTY issues a written authorization to proceed , sixty (60 ) calendar days shall be allowed for delivery of the completed work product to the COUNTY . SECTION V - COMPENSATION The COUNTY agrees to pay, and the ENGINEER agrees to accept , a fee for services rendered according to the "Scope of Services Provided by the ENGINEER , " identified in Section III of this WORK ORDER , with a maximum charge of $22 , 850 . 00 . The ENGINEER shall use the form provided in "Attachment 1 , " herein . The ENGINEER shall submit invoices monthly for services performed and expenses incurred pursuant to this Agreement during the prior month . The ENGINEER shall submit duly certified invoices in duplicate to the Director of F:\Pubhc Works\KeithM\Stamwater Projects\East IRC\Contracts\Consultant Contract with Carter & Associates\Work Order No. 4 - Vortex Treatment Units\Work Order #4 - Latest Version.doc 4 , the Public Works Department . For lump sum line items , the amount submitted shall be the prorated amount due for all work performed to date under this phase , determined by applying the percentage of the work completed as certified by the ENGINEER , to the total due for this phase of the work . For time and material line items , the amount submitted shall be based on the actual hours worked and expenses incurred for the billing period . The amount of the partial payment due the ENGINEER for the work performed to date under these phases shall be an amount calculated in accordance with the previous paragraph , less ten percent ( 10 % ) of the invoice amount thus determined , which shall be withheld by the COUNTY as retainage , and less previous payments . Per F . S . 218 . 74 (2 ) , the COUNTY will pay approved invoices on or before the forty-fifth day after the COUNTY receives the ENGINEER' s invoice . Per F . S . 218 . 74 (2 ) , the ten percent ( 10 % ) retainage withheld shall be paid in full to the ENGINEER by the COUNTY , on or before the forty-fifth day after the date of final acceptance of the Work by the Public Works Director, The Agreement is broken into deliverable units . No payment shall be made unless the Public Works Director has received and approved the work products required under the " Scope of Services Provided by the ENGINEER , " herein . SECTION VIII = VENUE Venue for any lawsuit brought by either party against the other party or otherwise arising out of this Contract shall be in Indian River County, Florida , or, in the event of a federal jurisdiction , in the United States District Court for the Southern District of Florida . SECTION IX - RELATIONSHIP TO MASTER AGREEMENT AND LAWS OF FLORIDA All conditions set forth in the MASTER AGREEMENT shall control unless otherwise specified in this WORK ORDER .
