HomeMy WebLinkAbout2007-426 7S aQU � ya INTERLOCAL AGREEMENT between INDIAN RIVER COUNTY, FLORIDA and THE SCHOOL DISTRICT OF INDIAN RIVER COUNTY This INTERLOCAL AGREEMENT, by and between Indian River County, Florida, a political subdivision of the State of Florida, by and through its Board of County Commissioners, hereinafter referred to as COUNTY and THE SCHOOL DISTRICT OF INDIAN RIVER COUNTY, FLORIDA, a part of the State of Florida System of Public Education, by and through its School Board, hereinafter referred to as SCHOOL BOARD, for the purpose of providing video-recording service, which shall include audio recording, to Indian River County. WHEREAS , the Florida Interlocal Cooperation Act of 1969 (Chapter 163 , F . S .) grants the COUNTY and SCHOOL BOARD the authority to enter into interlocal agreements; and WHEREAS, the COUNTY has determined that it is in the public interest to televise County Commission proceedings, Planning and Zoning meetings, Election results, and Emergency programming; and WHEREAS, it would be of mutual benefit to have the School District' s Television Production students/personnel, under the Supervision of the School District' s Television Production Coordinator, video-record and broadcast on the Government Channel (Comcast Cable Channel 27), ( 1 ) County Commission proceedings, (2) Planning and Zoning meetings, (3) Election Returns, and (4) Emergency Management briefings/press conferences which take place in the County Commission Chambers and at remote locations when possible; and WHEREAS, it is in the public interest to set forth, by way of agreement, each entity' s responsibilities, NOW THEREFORE, in consideration of the mutual terms, conditions, promises, covenants, and premises hereinafter set forth and pursuant to the statutory authority set forth herein the COUNTY and the SCHOOL DISTRICT agree as follows : 1 . It shall be the responsibility of the SCHOOL BOARD to: a) Designate a liaison to work with the COUNTY liaison. b) Provide trained personnel (may be Television Production students from Vero Beach High School and/or Sebastian River High School) to operate the television video-recording equipment which is provided by Indian River County, and located in County Commission Chambers to accomplish in a professional manner the video-recording of County Commission meetings, 1 Planning and Zoning Meetings, Election Returns, and Emergency Management briefings/press conferences, provided the School Board is given a minimum of two weeks ' notice of such meetings (except in the case of Emergency Management briefings/press conferences and/or special called meetings whereby as much notice as possible would be acceptable). c) Provide necessary television video-recording equipment for meetings held in remote locations. This equipment shall include but not be limited to: required number of cameras as determined by the School District Television Production personnel, video mixer/equipment, recording devices, sound mixer board, wireless microphones, batteries for wireless microphones, microphone stands, Vbrick system and all necessary equipment to operate same, all cabling, headsets, recording decks, and any other equipment deemed necessary by the School District Television Production personnel. d) Provide adequate transportation for Television Production students/personnel to and from the County Administration Building and other mutually agreed upon locations to accomplish required tasks. e) Provide appropriate compensation, insurance, and worker' s compensation coverage for students in the performance of duties. f) Provide a supervisor to oversee students/personnel during required tasks. g) Be responsible for the safety of students as that safety is related to the required tasks. h) Within 24 hours, deliver to appropriate COUNTY liaison the video/DVD of the meetings, marked with the meeting and date information. i) Work jointly with the designated COUNTY liaison to determine appropriate content for Channel 27 on a 24/7 basis, complete the weekly programming for the channel, and prepare the weekly schedule for the Press Journal ' s TV Guide. j) Post PowerPoint slides created by County government entities on Channel 27 whenever there is no other live, tape-delayed programming or other programming scheduled, as directed by Indian River County. Permitted postings include but are not limited to: County meeting agendas and notices, County job postings, Law Enforcement information, County activities/programs/special events, County board vacancies, notices of other governmental agencies, emergency information, athletic recreation, and special activities available in the community, etc. The PowerPoint slides must be created using a legible font type and size. k) Coordinate the Closed Captioning of specific meeting as determined by the County. 2 . It shall be the responsibility of the COUNTY to: a) Designate a liaison to work with the SCHOOL BOARD liaison. b) Provide the SCHOOL BOARD with an annual calendar showing date, time and location of regularly scheduled County Commission proceedings, Planning and Zoning meetings, and Election Returns coverage requirements, with the understanding that additional workshops, meetings may be scheduled 2 throughout the year, for which a minimum of two weeks ' notice to the SCHOOL BOARD will apply when possible. If two weeks ' notice is not possible, it will be up to the discretion of the SCHOOL BOARD as to whether or not they can comply with the request. c) Provide at least 24 hours notice of cancellation of meetings, by fax or email, with a follow-up phone call to SCHOOL BOARD liaison, or pay the hourly rate times one hour, to the SCHOOL BOARD when notice of cancellation is not provided. d) Pay the SCHOOL BOARD for the video-recording/live broadcast of ( 1 ) County Commission meetings, special meetings, workshops, (2) Planning and Zoning meetings, 3) Election Returns, (to include set-up and take-down times as denoted in item (e) below), at the rate of $ 138.00 per hour. This fee will be rounded to the nearest 30 minutes (at a rate of $ 69.00 per 30 minutes). Payment to be made promptly upon receipt of invoice. (Note : Emergency Management briefings/press conferences will be video-recorded/live broadcast at no cost to Indian River County). e) Provide access to County Commission Chambers (to include Control Room) 30 minutes prior to and immediately following regularly scheduled Commission meetings held in the Chambers, to allow for adequate preparation of equipment prior to and after video-recording, and two hours prior to and immediately following meetings held at remote sites, to allow for set-up and removal of all necessary equipment. f) Provide all necessary equipment for television video-recording, including but not limited to: video cameras, sound mixer, microphones, amplifiers, and all associated audio equipment, video switcher/monitoring equipment, lighting control, presentation/video playback, cabling, closed circuit encoding equipment, phones, phone lines, computer, Compix graphics overlay, DVD, and all other recording equipment, will be maintained by Indian River County. g) Provide maintenance and repair of all video-recording equipment, (including closed captioning equipment) installed in the Commission Chambers. h) Provide the proper environment for video-recording inside the County Commission Chambers. i) Pay the SCHOOL DISTRICT for the video-recording of any additional government events, meetings, as mutually agreed upon, at a rate of $ 138 . 00 per hour. 3 . General a) Term and Cancellation: This agreement shall be filed with the Clerk of the Circuit Court of Indian River County pursuant to Florida Statute 163 .01 ( 11 ) and commence on January 1 , 2008, and shall be continuing in nature unless and until terminated by 30 days written notification by any party to the other party, or amended in writing by mutual agreement. b) Anti-discrimination: The parties to this agreement will comply with all applicable Federal and State civil rights and anti-discrimination laws and regulations, including but not limited to Title VI and VI 1 , Civil Rights Act of 3 1964, Section 504 of the Rehabilitation Act of 1973 , as amended, (Non- Discrimination against the Handicapped and Americans with Disability Act). It is expressly understood upon receipt of substantial evidence of such discrimination; the parties shall have the right to terminate this contract for breach. c) Amendments : This agreement may be amended only by written consent of the parties. d) Annual Review: The parties shall designate appropriate personnel to meet at least one time each year to review this Agreement regarding changes that are recommended to be made in this Interlocal Agreement so that the provisions of this Agreement comport with changed circumstances. In WITNESS HEREOF, the parties hereto have caused this interlocal agreement to be executed by their duly authorized officials.
