HomeMy WebLinkAbout10/15/1962RESOLUTION . Y 1 WHEREAS, Indian River County, a political subdivision of the State of. Florida, as Owner, and Netto Construction, Incorporated, a Florida corporation, as Contractor, did on October 1, 1962, enter into a building contract calling for the construction by.the Con, tractor for the Owner of certain additions to the County Jail of Indian River County, Florida; and, WHEREAS, Nelson A. Faerber, the architect who prepared the plays and specifications for said additions and who is supervising the con- struction of same by the Contractor, has recommended that certain changes be made to said plans and specifications; and, WHEREAS, the Board of County Commissioners of Indian River County, Florida, has found and does find that said changes in said plans and specifications do not involve a substantial change in the general plan or character of the construction to be done and, further,'that delays, inconvenience and expenses incident to advertising for bids would be numerous; and, WHEREAS, said Board has been advised by its attorney that, under the law of Florida as declared by the Supreme Court of Florida in Escambia County v. Blount Construction Company, 1913, 62 So. 650, it is not necessary to advertise for bids for such changes; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Indian River County, Florida, that Indian River County, a political sub- division of the State of Florida, enter into a supplemental building contract with Netto Construction, Incorporated, a Florida corpora- tion, in words, phrases and figures as follows: SUPPIJAWTAL BUILDING COKTRWT THIS SUPPL&MMiTAL AGRZALENT made this day of October, 1962, by and between NRTTO CONSTRUCTION, V�C=>0RAVO, hereinafter called the Contractor, and IUDIJW a political subdivision of the State of Florida, hereinafter called the Owner, WITNI"SL'TH, that the building contract between the Con- tractor and the Owner dated October 1, 1962, be and it is herewith and hereby changed an follows: 1. The Contractor shall furnish all of the materials and perform all of the work shown on the drawing entitled "Compaction Layout For Vibroflotatiou" and described in specifications con- tained in a letter dated October 11, 1962, from Vibroflotatiort Foundation Company, 415 West Magnolia Street, Uerritt island, Florida, to Nelson A. Faerber, Naples, Florida, one copy of such drawing and one copy of such letter being attached hereto and made a part hereof; shall pay up to $200.00 for ton (10) relative den- sity tests above the water table after completion of the foregoing work; and shall establish a now finish grade and a re -layout of the building to be erected. 2. The time forcompletionOf the work called for by said building contract dated October 1, 1962, an changed by this sup- plemental building contract, shall be extended to April 16, 1963. 3-.
