SECOND AMENDMENT
to Agreement
between
INDIAN RIVER COUNTY
and
JONEAL MIDDLETON
WHEREAS , Indian River County ( County) is the owner and operator of
Blue Cypress Lake Park on Blue Cypress Lake ; and
WHEREAS , since 1979 , the County has entered into an agreement , with
Joneal Middleton , to fulfill its obligations to manage and maintain Blue Cypress
Lake Park ; and
WHEREAS , this agreement has resulted in a very smooth and competent
operation of Blue Cypress Lake Park ; and
WHEREAS . Joneal Middleton has been married to H . Jean Middleton for
14 years ; and
WHEREAS , H . Jean Middleton has assisted in the operation of Blue
Cypress Lake Park since 1994 and is familiar with every phase of the operations ;
and
WHEREAS , due to her daily involvement with the operations of the park ,
both Joneal and H . Jean Middleton should be named as parties to the lease with
rights of survivorship .
WHEREAS , in the interest of orderly administration the agreement should
be amended ,

NOW , THEREFORE , in consideration of the following mutual covenants
and agreements INDIAN RIVER COUNTY and JONEAL and H . JEAN
MIDDLETON do agree as follows :
1 . The original agreement dated August 22 , 1995 , later amended on October
19 , 2004 , shall be amended to name as parties Joneal and H . Jean Middleton ,
husband and wife with joint rights of survivorship .
2 . Except as amended above , the terms and conditions of the Agreements
dated August 22 , 1995 and October 19 , 2004 shall remain in full force and effect .
IN WITNESS WHEREOF , the parties hereto have hereunto set their
hands and seals this 2nd day of December , 2008 .
