HomeMy WebLinkAbout2009-139 5 a , � 1' WORK ORDER NUMBER CD = 1 This Work Order Number CD - 1 is entered into as of this 19th day of May , 2009 , pursuant to that certain Professional Civil Engineering Services Agreement entered into as of October 2 , 2006 and amended effective November 18 , 2008 ( as so amended , the "Agreement" ) , by and between INDIAN RIVER COUNTY , a political subdivision of the State of Florida ( " COUNTY " ) and KIMLEY- HORN AND ASSOCIATES , INC . ( " CONSULTANT' ) . The COUNTY has selected the Consultant to perform the professional services set forth on Exhibit 1 ( Scope of Services ) , attached to this Work Order and made part hereof by this reference . The professional services will be performed by the Consultant for the fee schedule set forth in Exhibit 1 ( Fee Schedule ) , attached to this Work Order and made a part hereof by this reference . The Consultant will commence the professional services within the timeframe more particularly set forth in Exhibit 1 ( Commencement ) , attached to this Work Order and made a part hereof by this reference all in accordance with the terms and provisions set forth in the Agreement . Nothing contained in this Work Order shall conflict with the terms of the Agreement and the terms of the Agreement shall be deemed to be incorporated in each individual Work Order as if fully set forth herein . Fell , Senior Assist rnt Cou(fy Attorney EXHIBIT 1 SCOPE OF SERVICES Jones ' s Pier PROJECT OVERVIEW The Jones Pier property (the " Site ") is an approximately 16 . 5 - acre tract of land located northeast of the intersection of Jungle Trail and Morningside Drive in Vero Beach , Indian River County , Florida . Indian River County (the "County) purchased the Site and intends to utilize it for conservation purposes . Investigations conducted by Kimley- Horn and Associates, Inc . ( KHA) in June and July 2008 confirmed the presence of pesticides in the soil and ammonia in the ground water at the Site . The pesticide concentrations in the soil were found to exceed the marine surface water leachability soil cleanup target levels ( SCTL ) defined in Chapter 62 - 777 , Florida Administrative Code ( FAC ) . Correspondingly , the ammonia concentrations in the ground water were found to exceed the ground water cleanup target levels (GCTLs) as defined in Chapter 62 - 777 , FAC . The identified impacts are likely the result of the historical use of the subject site for agricultural purposes . ASSUMPTIONS The Scope of Services herein was prepared based on the following assumptions : • No additional site assessment will be required beyond that described in Task I of the Scope ol' Services . • The depth to ground water across the Site is less than 4 feet below surface ( bls) . • No soil or ground water contamination extends off- site . • Active ground water remediation is not warranted . • Active soil remediation is not warranted . • Engineering controls will not be used in association with the site- specific remedial strategy . • The Combined Document will be reviewed by Indian River County prior to submittal to the FDEP . • One year of quarterly ground water monitoring will be sufficient to demonstrate that the Site meets with requirements for Risk Management Option ( RMO ) Level 11 with respect to the identified ground water impacts . • The FDEP will approve the use of RMO Level I with respect to the identified soil impacts . 1 EXHIBIT 1 SCOPE OF SERVICES Jones ' s Pier • The FDEP will approve the use of RMO Level II with respect to the identified ground water impacts . • Following the completion of one year of quarterly ground water monitoring, the localized ground water quality will meet the minimum requirements for RMO Level II . • The Site will be used for conservation purposes . • Indian River County is amenable to the application of institutional controls as a remedial strategy for the Site . SCOPE OF SERVICES The following Scope of Services was prepared to address the soil and ground water impacts on the Site in accordance with the regulatory requirements of Chapter 62 - 780 , FAC . This scope of services is based on our knowledge of the Site , the current Site conditions , and our practical experience with similar contaminated sites throughout the State . Task I — Site Assessment The Limited and Expanded Phase ll Environmental Site Assessments ( ESA ) completed in June and July 2008 have provided preliminary data regarding the site - specific soil and ground water quality . However , based on our experience with FDEP and the requirements for Site Assessment Reports additional sampling will be required . The results of the Limited and Expanded Phase II ESAs suggest the presence of pesticides in the soil above either the ground water or the marine surface water default leachability SCTL , defined in Chapter 62 - 777 , FAC . However, no soil impacts were identified above the residential or commercial direct contact exposure SCTL . Furthermore , pesticides have not been identified in the ground water above the GCTL . One monitoring well exhibited elevated concentrations of ammonia above the GCTL . As such , KHA proposes the collection of site assessment data in association with Chapter 62 - 780 , FAC . The purpose of the site assessment will be to demonstrate that : • Pesticide compounds are not present in the soil above the residential or commercial default SCTL . • Low - level pesticide concentrations is the soil are not leaching into the ground water . • Pesticide concentrations are not present in the ground water above the GCTL . EXHIBIT 1 SCOPE OF SERVICES Jones ' s Pier • Ammonia concentrations in the ground water are limited to the I mmediate vicinity of existing monitoring well MW- 1 . The site assessment field activities shall consist of the following : • Collection of soil samples from up to 40 soil borings completed across the Site ( approximately 2 borings per acre) . The soil boring locations will be determined in the field . The depth to ground water across the Site is assumed to be less than 4 feet below land surface (bls) . Therefore , soil samples will be collected from each soil boring at the following intervals : 0 to 0 . 5 feet, 0 . 5 to 2 feet, and 2 to 4 feet bls . Up to 120 soil samples will be collected from the Site . The 0 to 0 . 5 feet soil sample from each boring will be analyzed for chlorinated pesticides using ( USEPA Method 8081 ) . It elevated concentrations of chlorinated pesticides are identified in the 0 to 0 . 5 feet sample , then the samples from the subsequent intervals ( 0 . 5 to 2 feet and 2 to 4 feet) will also be analyzed for chlorinated pesticides . • The site- specific leachability concentration will be determined utilizing the synthetic precipitate leaching procedure ( SPLP ) . The results of the soil sampling will dictate the SPLP analysis . As such , SPLP analysis for pesticides will be completed on up to 30 soil samples ( 10 samples per sampling horizon ) . • A deep and two shallow monitoring wells will be installed on the Site . One shallow monitoring well will be installed up - gradient on the eastern third of the Site . The second shallow mr onitoing well will be installed down - gradient of M W - l along the western side of the Site . The deep monitoring well will be installed adjacent to MW - 1 . The monitoring wells will be installed using hollow - stem auger techniques . Each of the shallow monitoring wells will be installed to a depth of approximately 12 feet bls . The deep monitoring well will be installed to a depth of approximately 40 feet bfs . The monitoring wells will be constructed of 2 - inch diameter, schedule 40 PVC with 10 feet of 0 . 01 - inch machine - slotted well screen . The monitoring wells will be constructed with a 20/ 30 sand pack , bentonite seal and flush- mount concrete well pad , with manhole cover . Each monitoring well will be developed following construction to facilitate sorting of the sand pack and increase hydraulic communication between the sand pack and water-bearing formation . • Ground water samples will be collected from the five existing monitoring wells ( MW - 1 , MW - 2 , MW - 3 and MW - 5 ) and the three proposed monitoring wells on the Site . The ground water samples will be analyzed for ammonia ( USEPA Method E350 . 1 ) , nitrate- nitrite (USEPA Method E353 . 2) , total Kjeldahl nitrogen ( USEPA Method E351 . 2) and total dissolved solids ( USEPA Method E160 . 1 ) . The monitoring wells 3 EXHIBIT 1 SCOPE OF SERVICES Jones ' s Pier will be sampled on two separate occasions approximately one month apart. • Completion of in - situ permeability testing using the existing monitoring wells to estimate the hydraulic conductivity of the surficial aquifer . • Completion of a drive by well survey of the properties within a half- mile radius of the Site . • Completion of a site survey that includes northing/easting coordinate and top - of- casing elevations for the existing monitoring wells by a Professional Land Surveyor . KHA will provide the Florida Department of Environmental Protection ( FDEP ) with notification regarding the County ' s intent to initiate site assessment activities in association with the Jones Pier site . KHA will also notify the FDEP of the scheduled commencement date of the proposed field activities . The soil and ground water samples collected from the Site will be analyzed by a laboratory accredited by the NELAC ( National Environmental Laboratory Accreditation Conference) Institute . The samples will be analyzed on a standard ( seven to ten day ) turnaround time . The sampling activities will be conducted in general accordance with the FDEP ' s Standard Operating Procedures . Task Z — FDEP Meeting Following the completion of the site assessment field activities and the receipt of the corresponding laboratory data , KHA will prepare for and attend one meeting with staff members from the Waste Cleanup Section of the FDEP ' s Orlando District Office . The purpose of the meeting will be to discuss the soil and ground water data collected from the Site . Furthermore , KHA will discuss strategies for obtaining regulatory closure for the identified impacts . This meeting will preempt the preparation of the Combined Document for the Site . Task 3 — Combined Document Following the completion of the site assessment activities and the meeting with the FDEP , KHA will prepare a Combined Document for the Site . The Combined Document will include the equivalent of a Site Assessment Report ( SAR ) and a Remedial Action Plan ( RAP ) . The SAR will summarize and present the findings of the site assessment activities . Remedial strategies will be developed to address the soil and ground water impacts and will be presented in the RAP portion of the Combined Document . The Combined Document will include the 'following : • A summary of the site assessment methodologies and results . 4 EXHIBIT 1 SCOPE OF SERVICES Jones ' s Pier • An interpretation of the soil and ground water quality data collected from the Site . • Maps depicting the location of soil borings and monitoring wells . • Ground water contour maps . • Iso - concentration maps . • Copies of the laboratory data sheets . • Copies of the field sampling logs . • Monitoring well construction logs . The proposed remedial action for the Site will be based upon the nature and extent of contamination identified in the soil and ground water during the site assessment . However, it is assumed that the County will be amenable to the use Of institutional controls ( restrictive covenants ) to limit the use of the property and preclude exposure to the contamination . Therefore , the RAP will outline procedures for meeting the requirements of RMO Level Il , The Combined Document will be prepared in accordance with Chapter 62- 780 . 600 ( 8 ) , FAC and will be signed and sealed by a Professional Geologist licensed in the State of Florida . A draft copy of the Combined Document will be provided to the County for review . KHA will prepare a total of 4 final copies of the Combined Document . Two signed copies will be submitted to the FDEP and two copies will be provided to the County . Task 4 — Remedial Action Plan lmplenientation Without the benefit of an FDEP - approved SAR, it is difficult to prescribe a remedial strategy for the Site . However, based on our knowledge of the current site conditions and our understanding of Chapter 62 - 780 , FAC , the on - site soils appear to meet the requirements for Risk Management Option ( RMO ) Level I — No Further Action without Conditions . Similarly , the localized ground water appears to meets the requirements for RMO Level 11 — No Further Action with Conditions . Ultimately , the FDEP must approve the remedial strategies prior to their implementation . Therefore , KHA has prescribed the following remedial strategy for the Site based on approved RAPS for similar sites . Based on our experience with similar sites , the remedial strategy for the Site will include the collection of quarterly ground water quality data from the five existing and three proposed monitoring wells on the Site . The purpose of the ground water monitoring is to demonstrate that the contaminant plume is ( 1 ) less than '/4 - acre in size ; (2 ) not increasing in concentration ; and ( 3 ) not migrating 5 EXHIBIT 1 SCOPE OF SERVICES Jones ' s Pier beyond the Site boundaries . KHA assumes that one year of quarterly monitoring will be sufficient to demonstrate that the ground water on the Site meets the minimum criteria for RMO Level It . The Eve existing and three proposed monitoring wells will be sampled for the following analytes : • Ammonia ( USEPA Method E350 . 1 ) • Nitrate- nitrite ( USEPA Method E353 . 2 ) • Total Kjeldahl nitrogen ( USEPA Method E351 . 2 ) • Total dissolved solids ( USEPA Method E 160 . 1 ) . Following collection , the ground water samples will be placed on ice and transported to the designated laboratory under chain - of- custody protocol . The ground water samples collected from the Site will be analyzed by a laboratory accredited by the NELAC Institute . The samples will be analyzed on a standard ( seven to ten day ) turnaround time . The sampling activities will be conducted in general accordance with the FDEP ' s Standard Operating Procedures . KHA will prepare Quarterly Ground Water Monitoring Reports that will be submitted to the FDEP . The reports will include the following : • Written documentation of the ground water sampling activities and methodologies . • An interpretation of the ground water quality data • A summary of the quarterly ground water quality data • Maps depicting the monitoring well locations and ground water flow direction • Copies of the laboratory data sheets • Copies of the field sampling forms and instrument calibration logs • Copies of the laboratory data sheets . Two copies of the Quarterly Ground Water Monitoring Reports will be forwarded to the FDEP . Additionally , the Client will be provided with three copies of each Quarterly Ground Water Monitoring Report. The reports will be signed and sealed by a Professional Geologist licensed in the State of Florida . Task S Site Rehabilitation Completion Report Following the completion of the quarterly ground water monitoring KHA , will prepare and submit a Site Rehabilitation Completion Report (SRCR) to the FDEP . With respect to the identified soil contamination , the SRCR will request No Further Action without Conditions . Conversely , the SRCR will request No Further Action with Conditions with respect to the identified ground water contamination . 6 EXHIBIT 1 SCOPE OF SERVICES Jones ' s Pier The SRCR will summarize the results of the quarterly ground water monitoring and include a draft copy of the deed restriction prepared for the Site . The deed restriction will preclude the use of any and all ground water from the Site regardless of the use . KHA assumes that the Client ' s attorney will be responsible for preparing the deed restriction for the Site . As such , KHA will collaborate with the Client ' s attorney to prepare the deed restriction . The SRCR will include the following : • A written summary of the Site with respect to the identified soil and ground water contamination . • A summary of the completed remedial activities . • A comprehensive summary of the soil and ground water quality data collected from the Site . • Written justification for the implementation of RMO Letter 11 . • A draft copy of the deed restriction prepared for the Site . Two copies of the SRCR will be forwarded to the FDEP . Additionally , the Client will be provided with three copies of SRCR . The document will be signed and sealed by a Professional Geologist licensed in the State of Florida . Information Provided By Client The following information shall be provided by the Client , the accuracy of which KHA will be entitled to rely upon . • Access to the site • Deed restriction language • Boundary Survey COMMENCEMENT KHA will commence task one within 30 days of receiving the Notice to Proceed (NTP ) . FEE SCHEDULE KHA will perform the Scope of Services in Tasks 1 - 5 for the following lump SUM fees , exclusive of sampling expenses : Task I Site Assessment $ 155000 Task 2 — FDEP Meeting $ 21750 Task 3 — Combined Document $ 12 , 000 7 EXHIBIT 1 SCOPE OF SERVICES Jones ' s Pier Task 4 — RAP Implementation $ 205000 Task 5 Site Rehabilitation Completion Report $ 14 , 500 Estimated sampling expense is $ 50 , 000 . All permitting , application , and similar project fees will be paid directly by the Client . 8
