HomeMy WebLinkAbout1/22/1963it is hereby requested to pay for the rights of'way, borrow pits and easements for said road, includirig the removal of buildings,' fences and .other structures and improvements thereon, and for other expenses of acquiring title to said rights of way, borrow pits and easements by purchase or condemnation, from such funds and under such conditions as are set out in the contract hereto attached; and be it further RESOLVED, that said County, through its Board of County Commissioners, comply with the request -of said Department and procure, convey or vest in said State the free, clear and unencumbered title to all lands necessary for said portion of said Section, and deliver to the State Road Department said lands physically clear of all occupants, tenants, fences, buildings and/or other structures and im- provements situate upon or encroaching within the limits of the lands required for said portion of said Section, and that the Chairman and the Clerk of this Board be and they are hereby authorized and directed to execute and deliver on behalf of said County to said Department the Contract in the form hereto attached, and be it further RESOLVED, that the attorney for this Board be, and he is hereby authorized and directed to proceed to take the necessary steps for the County to acquire in the name of said County by donation, purchase, or condemnation said rights of way, borrow pits and ease- ments for said portion of said Section, and to prepare in the name of said County by its County Commissioners all condemnation papers, affidavits and pleadings, and prosecute all condemnation proceedings to Judgment;, and furnish to the Department the abstract search pro- vided for in said Contract. Motion was made by Commissioners McCullers, seconded by Commissioner Haff field and unanimously.carried, that the following Resolution be adopted. RESOLUTION WHEREAS, Indian River County, a political subdivision of the State of Florida, as Owner, and Netto Construction, Incorporated, a Florida corporation, as Contractor, did on October 1, 1962, enter into a building contract calling for the construction by the Con- tractor for the Owner of certain additions to the County Jail of Indian River County, Florida; and, WHEREAS, Nelson A. Faerber, the architect who prepared the plans and specifications for said additions and who is supervising the con- struction of same by the Contractor, has recommended that certain changes be made to said plans and specifications; and, WHEREAS, the Board of County Commissioners of Indian River County, Florida, has found and does find that. said changes in said plans and specifications do not Anvolve a substantial change in the general plan or character of the construction to be done, and, further, that delays, inconvenience and expenses incident to advertising for bids would be numerous; and, WHEREAS, said Board has been advised by its attorney, that, under the laws of Florida as declared.by the Supreme Court of Florida in Escambia County v. After some discussion, the purchase of the property for marl pit was authorized. Douglas Baker, Clerk, stated that Reports of Receipts,Expenses and Net Income for the year ending the 31st day of December, 1962, were filed with the Clerk on or before January 15, 1963, as required by Law, by the following: Homer C. Fletcher, Tax Assessor; John R. Gould, Prosecuting :attorney; Troy E. Moody, Tax Collector; Miles B. Mank II, County Judge; Charles A. Sullivan, Judge Small Claims Court and Douglas Baker, Clerk Circuit Court. Mr. L. B. Vocelle, Attorney, representing Mr. and Mrs. Macren, appeared before the Board and requested the County Engineer and the County Zoning Inspector to investigate the business of Harry Cole and determine whether or not he is operating a business and violating the Zoning Ordinance. After considerable discussion, the County Engineer and County Zoning Inspector were requested to investigate the matter and to give a report of their findings to Mr.. Voc`lle. The County Attorney stated that Charles Smith, Attorney, would like the Board to make a request to the State Road Department to deed to the County the following described property: All that part of the former right-of-way of State Road #5 (U. S. Highway #1) having a width of 66 feet extending Southward from a line described as follows: commencing on the North boundary line of <--venue B of W. E. Geoffrey's Subdivision as; recorded in Plat Book 2, page 32, pub- lic records of St. Lucie County, at a point where the former State Road #5's westerly boundary line intersects the North line of said ivenue B; thence go West on an extension of the North.line ofavenue B to the East bouridary-line.of'the Florida East Coast Railroad right=of-way; thence to a line which is described as follows: Commencing at a point on the South boundary line of Lot 103, Block 7, W. E. Geoffrey's Subdivision as recorded in the office of the Cierk of the Circuit Court of St. Lucie County in Plat Book 2, page 32, at a point where the said South boundary ,Line of Lot 103 intersects the former State Road #5; thence go West on an•extension "of the South boundary line of said Lot 103'to the Eastern boundary line of the right-of-way of the Florida East Coast Railroad. Said land lying and being'in Indian River County, Florida. After considerable discussion, Motion was made by Commissioner McCullers, seconded by Commissioner Haffield and unanimously carried, that the request be made to the State Road Department. Ed Schmucker, County Engineer, reported that he had written the Railroad'Company and asked .permission to use their right-of-way for a road on tha West side of the railway tracks in Gifford and after consi- derable paper work, they refused to do it. The Chairman instructed him to ask Lundy, the head of the move, to get the right-of-way, then the county would make the road.. The County Engineer stated that Mr. Davidson and the Inlet Commission are having a meeting here on January 25 and that all Commis- sioners are invited to attend. The County Engineer reported that he had a request for a cross over On the new U. S. 1 at wabasso. The County Engineer was re- quested to write to the State Road Department and find out their policy on things of this nature. The Chairman read the foregoing Notice and after considerable discussion, if was decided by the interested parties to for public hearing. on Wednesday, February 20, 1963. Mr. Delogua, representing Hallmark.Homes and Mr. Smalley, representing General Waterworks, appeared before the Board to discuss water main extentions to Hallmark Homes Subdivision. After'hearing'the discussion from both parties and the County Engineer,.Motion was made by Commissioner Haffield, seconded by Commissioner McCullers and unanimously carried, that General Watenaorks, lay the water mains to and across the road to the North Lot of the first West Block of the subdivision and the builder will lay the main through the subdivision. When the next two blocks are developed the Gneral Waterworks Company will lay the main across the road to one block and the builder will be responsible for putting it across the road to the other block. 0n the first block the tap on charge will be $100.00 per unit and on the additional blocks the tap on ch4rge will be $65.00 per unit. Mir. _Zobert Cammack and Mr. L. C. Martin, appeared before the Board with a petition requesting the Commissioners to pave Bay Street in Roseland. They also -requested that something be done on the Sebastian :fiver Bridge to protect the fishermen. I� GENERAL REVENUE FUND 341 MAINTENANCE TO JAIL 951 CONTINGENCIES TO FROM $400.00 $400.00 Motion was made by Commissioner Haffield, seconded by Commis- sioner McCullers,and unanimously carried, that the following Resolution be adopted. --------------- RESOLUTION WHEREAS, Indian River County, a political subdivision of the State of Florida, has for the past several months been acquiring right of way for the construction of Florida State Road ,:i -1-A between the unincor- porated community of v4abasso and the north boundary line of said county, all of which right of way is situated east of the Indian River in said county, and, WHEREAS, a large number of landowners along the proposed route of said Florida A -1-A have donated right of way which, if condemned or purchased, would have cost Indian River County a great sum of money and would have delayed or prohibited the construction of said road and the bridge across Sebastian Inlet, and, WHEREAS, the construction of Florida State Road A -1-A in the place aforesaid and the construction of the bridge across the Sebastian Inlet will provided great benefits to the people of Indian River and Brevard Counties, in particular, and to the citizens of and visitors to the State of Florida, in general, and, WHEREAS, some of those landowners who contributed such right of way will be required to purchase from the Trustees of the.Internal Im- provement Fund of the State of Florida bottom lands or submerged.lands ly- ing west of the right of way of said road, NOW, THEREFORE: BE IT RESOLVED by the Board of County Commissioners o -f Indian River County, Florida, that said Board respectfully request the Trustees of the Internal Improvement Fund of the State of Florida to give due consider- ation to the above and that, to the extent allowed by law, such landowners be permitted to purchase such bottom lands and submerged lands at the 1pwest possible prices..
