HomeMy WebLinkAbout2009-082 INDIAN RIVER COUNTY 66th Avenue/ County Road 510 Roadway Widening AMENDMENT NO . 5 TO THE PROFESSIONAL ENGINEERING/LAND SURVEYING SERVICES AGREEMENT BETWEEN KIMLEY -HORN AND ASSOCIATES , INC . AND INDIAN RIVER COUNTY , FLORIDA . This is an amendment to the existing Engineering/Land Surveying Services Agreement (AGREEMENT) dated February 22° `x , 2005 between Kimley- Horn and Associates , Inc . ( ENGINEER) and Indian River County (COUNTY) . This amendment addresses changes in " Section III - Scope of Services " , " Section V - Compensation " and " Section XVI — Duration of Agreement " of the AGREEMENT . Amendment Description This Amendment includes the following : " SECTION III — SCOPE OF SERVICES " is being modified to incorporate the following : A : Legal Descriptions and Parcel Sketch Revisions Revisions to the prepared legal descriptions and parcels sketches are required to describe needed construction and drainage easements . This task also includes the preparation of additional legal descriptions and sketches of the proposed right- of-way parcels along the following side streets : 41st , 61st , 65t" 5 69th and 81s' Streets . Any temporary construction easements within the specific parcels will be shown on the right-of- way parcel sketches . Drainage easements and/or access easements may require a separate sketch depending upon the configuration . (Estimated 26 parcels) Additional legal descriptions and sketches will be prepared for those right- of- way parcels along 66th Avenue that were not previously prepared because the proposed right- of- way line was lying within the limits of the Murphy Reservation . (Estimated 5 parcels ) Additional legal descriptions and sketches will be prepared for those right- of-way parcels along 66th Avenue that were previously prepared but excluded the Murphy Reservation . (Estimated 19 parcels) Preparation of legal descriptions and sketches for those parcels along CR 510 that require drainage and/or temporary construction easements . ( Estimated 58 parcels ) Indian River County ; Amendment No . 6 66 `" Avenue/ County Road 510 Roadway Widening B : Right- of- Way Staking/ Support At the request of Indian River County, the ENGINEER shall field stake the existing and proposed right-of-way limits parcel for appraisal purposes . There are a total of 128 parcels within the improvement limits and it is assumed that one -half will require field staking . (Estimated 64 parcels ) " SECTION V — COMPENSATION " is being modified to incorporate the following : The COUNTY agrees to pay and the ENGINEER agrees to accept for services rendered pursuant to this Agreement fees inclusive of expenses in accordance with the following : A . Professional Services Fee The basic compensation mutually agreed upon by the ENGINEER and the COUNTY is as follows : Task Labor Fee Hourly NoNo-Exceed Tasks Legal Descriptions and Parcel Sketch Revisions $ 58 , 320 Right- of- Way Staking/ Support $ 251600 " SECTION XVI — DURATION OF AGREEMENT " is being modified to incorporate the following : The time for completion of the above described Legal Descriptions and Parcel Sketch Revisions in this amendment will be twelve ( 12) weeks following receipt of the notice to proceed from the COUNTY . All other sections of the AGREEMENT shall remain in full force and effect and are incorporated herein . This Amendment No . 5 to the AGREEMENT regardless of where executed , shall be governed by and construed by the laws of the State of Florida .
