The Board o County Commissioners of Indian River County, Florida,

Attorney; and Al Webber and Freda Wright, Deputy Clerks.

cuss the matter at any time and suggested that he have a draft prepared •
of the bill that he had in mind. The County Attorney was requested to write
for an Attorney'General's Opinion on the subject.

Mr. Harry.Cole was recognized by the Chair and stated that the
purpose of his appearance was .to give pertinent facts with regard'_to the
operation of his business and the problems that'exist between he and Mr.
and Mrs. Macren. Mrs. Durrance and Mr.. Whipple also appeared and gain
their opinion as to.the character of Mr. and Mrs. Macren. The matter was
tabled until such time as Mr. Cole's Attorney could appear before the
Board.
Mr.'Bill Payne, representing the Road and Gun Club, appeared be-
fore the Board and requested that the county furnish a dredge for fill
for more parking area at Blue Cypress Lake. The County Engineer was re-
quested to furnish same at such time as the dredge was available.
Mr. R. F. Lloyd appeared before the Board and presented a map
showing a part of Oslo Road that he would like to have abandoned. Public
hearing was set for the meeting of March 20, 1963.
The County Engineer inquired as to zoning regulations with regard
to fences. After some discussion, the County Attorney was requested to
make a study of this particular regulation for further action at a future
meeting.
Mr. Schmucker also suggested that a Resolution be prepared re-
questing a change in location of Interstate Highway 95. Motion was made
by Commissioner Macdonald, seconded by Commissioner Waddell and unanimously
carried, that the County Attorney be requested to prepare Resolution for
same.
The County Engineer gave a report of his findings on North Road
out of Fellsmere and stated that he would attend a meeting of the Fellsmere
City Council on Friday, February 8, 1963, to get their views and opinions
with regard to same.
After some discussion, Motion was made by Commissioner Macdonald,

seconded by Commissioner Waddell and unanimously carried, that a Reso-
lution be adopted to establish a right of way of 60 feet to include old
Roseland Road (Bay Street) from new U. S. 1 to old U. S. 1 (Indian River
Drive) the certerline being the South boundary of the Kjorsvik property.
Motion was made by Commissioner McCullers, seconded by Commissioner
Macdonald and unanimously carried, that a trip to Tallahassee on January
28 and 29, 1963 by Robert W. Graves, Charles Herring, John Gould and Jack
Jennings and a trip to Orlando to a Regional Council meeting on January
31 and February 1, 1963, by B. Q. Waddell; is authorized.
The Chairman gave a report of the meeting in Tallahassee on the
bulkhead .line, the report being that it had been very successful.
Motion was made by Commissioner McCullers, seconded by Commission-.
er Macdonald and unanimously carried, that the County Commissioners, Coun-
ty Engineer, County Attorney and the Clerk to the Board are authorized to
attend a County Commissioners meeting in Tampa on February 24 through
February 26, 1963, and Al Webber, Deputy Clerk, is authorized to attend
a County Finance Officers meeting in Jacksonville, February 28 through
• March '2, 1963.
Motion was made by Commissioner Waddell, seconded by Commissioner
Macdonald and unanimously carried that the following Item to Item transfer

WHEREAS, the Board of County Co amissioners, acting for
and upon behalf of Indiana River County, Florida, have entered into an
agreement with the State Road Department to obtain on behalf of the County
for the State of Florida, for the use and benefit of the State Road Department,
all of the rights of ways, easements and lands for the construction of
Section 88070-2501, State: Road AIA, in Indian River County, Florida; and,
WHEREAS, said County has been unable by donation or
purchase to acquire the .remaining parts thereof; Now, therefore,
BE IT RESOL VED by the Board. of County Coanrissioners of
Indian River County, Florida, that Charles L. Herring, the Attorney for
this Board in said County, is herewith authorized and directed to prepare
and file in the Circuit (dun of Indian: River County, Florida, any and all
documents required in order that said lands required for said rights -of -ways
shalt be condemned in eminent dory ain proceedings and the title to said lands
vested in said State, including a Declaration of Taking, as authorized by
Chapter 74, Florida Statutes, and said attorney is further authorized and
directed to prosecute said proceedings in the name of Indian River County,
Florida, to final judgment
