AMENDMENT NO. 4 TO THE PROFESSIONAL ENGINEERING/LAND SURVEYING
SERVICES AGREEMENT BETWEEN KIMLEY-HORN AND ASSOCIATES, INC. AND
INDIAN RIVER COUNTY, FLORIDA,
This is an amendment to the existing Engineering/Land Surveying Services Agreement
(AGREEMENT) dated February 22°d, 2005 between Kimley-Horn and Associates, Inc.
(ENGINEER) and Indian River County (COUNTY). This amendment addresses changes in
"Section I - Project Limits and Description", "Section III - Scope of Services", "Section V -
Compensation" and "Section XVI — Duration of Agreement" of the AGREEMENT.
Amendment Description
This Amendment includes the following:
"SECTION I — PROJECT LIMITS AND DESCRIPTION" is being modified to incorporate the
following:
Consultant services are required for the preparation of design surveys, right-of-way maps,
parcel sketches and legal descriptions, subsurface geotechnical investigations and
roadway improvement plans associated with planned improvements to the Schumann
Drive/ Barber Street intersection.
The intersection improvements shall consist of a single left tum lane, one through lane,
and one dedicated right turn lane on all approaches. In addition to the above describe
lane configuration, the northbound approach shall have an additional left tum lane (dual
northbound lei turn lanes) and two westbound receiving lanes on the eastbound
approach. Signalization improvements shall be designed to accommodate a mast -arm
signal pole configuration.
Based upon
the proposed
improvements described above the total
project length is
estimated to
be 6,600 linear
feet or 1.25 miles.
"SECTION III — SCOPE OF SERVICES" is being modified to incorporate the following:
B. Design Survey
The ENGINEER shall provide design survey services necessary to support and
facilitate contemplated design and permitting activities associated with this
project. This task will consist of the preparation of digital base map topographic
surveys in accordance with the intent of the Florida Minimum Technical

Standards set forth by the Florida Board of Professional Land Surveyors in
Chapter 61 G17-6, Florida Administrative Code, pursuant to Section 472.027,
Florida Statutes.
The DESIGN LIMITS shall be extended to include the following:
Schumann Drive/ Barber Street Intersection
Northbound Approach — (600 feet additional for ROW mapping only. No
design topographic data)
Southbound Approach — 2,000 feet additional topographic data required.
Eastbound Approach — 2,000 feet additional topographic data required.
Westbound Approach — 600 feet additional topographic data required.
Drainage structure survey within the corridor to include pipe size, type, and
invert. The COUNTY will be responsible to insure that structures are clear of
debris. No sub surface utilities are included, and no location of utility designating
is included in this scope of service. Topographic data shall be collected 30 feet
beyond what is delineated as the existing roadway right-of-way.
It is assumed that there will be additional topographic data required to support the
stormwater improvements needed for the intersection improvements. The
stormwater management facilities will be surveyed based upon an hourly not to
exceed basis as an additional service once locations have been identified.
B1. Right -of -Way Survey
Will consist of a Cover Sheet, one Key Sheet, and Detail Sheets depicting existing
right of way lines, and proposed right of way lines, etc, in compliance with the
attached "Exhibit B", as provided by Indian River County. The Right of Way
Survey will also include a Tabulation Sheet depicting Parcel Take information
using owner's name and property tax ID number.
Detail Sheets will depict existing topographic features and right of way control
obtained.
Key Sheets will be
at a
scale of 1 "=
300' and Detail Sheets will be at a scale of 1"
= 40'. The surveys
will
be delivered
on mylar.
It is assumed the COUNTY will provide Title Reports, in a timely manner, and
other available survey control information in the possession of the County. Legal
Descriptions and Sketches will be prepared for approximately 20 parcels based
upon an hourly not to exceed basis.
66`h Avenue Additional Survey Services
Additional effort has been expended to prepare 66th Avenue parcel legal and
sketches. Additional effort has been expended in the interpretation and

rectification of the provided FDOT CR 510 Control Survey. The following
summarizes the activities:
I. Change in Take Description:
a. Additional 10' strip 15 parcels at $187.50 $2,812.50
II. Change in Take Description:
a. 30' Canal & Road Reservations 5 parcels at $187.50 $937.50
III. Additional R/W work on 64th Avenue
Necessitated by double quarter section comers being utilized. Coordination with
FDOT to avoid conflicts with existing Control Survey. Additional field work to
support double quarter corners $95500.00

C. 66th Avenue/ Schumann Drive Route Study
The ENGINEER shall develop and evaluate viable alternatives in order to
address the project needs. The ENGINEER shall investigate the area
surrounding the existing facility to determine reasonable corridor alternative
considerations. No more than two alternative corridors will be investigated and
developed.
The corridor analysis limits will include 66`h Avenue from 59a' Street to the
northern Schumann Drive terminus (approximately 3.5 miles). The evaluation
will address side street improvements associated with 60h Avenue and Schumann
Drive within the limits of the Corridor Analysis, except CR 510. The
ENGINEER shall use aerial photography to identify possible corridor locations
while giving consideration to the following alignment controls which may
influence corridor location:
• Available right-of-way through which an improvement providing
acceptable service could be routed.
• Cultural features including public and private development.
• Natural features which could be impacted by the project.
• Logical termini giving consideration to directness, length, and service.

The ENGINEER shall analyze and evaluate each corridor alternate to a point of
rejection or selection as a viable corridor. The impacts for each alternate shall be
identified and expressed in a form suitable for comparison to other corridor
alternates. It will be necessary to analyze in sufficient detail to identify enough
differences to select the most viable corridor(s) that would be in the best overall
public interest. The analysis will include evaluation of alternative alignments,
safety considerations, long range planning, environmental impacts and costs.
The ENGINEER shall prepare a Route Study to document the results of the
corridor analysis. The Route Study shall summarize the project need, discuss the
corridors evaluated, and provide a recommendation for the best corridor(s) for
further study.
D. Roadway Plans
Roadway plans shall be prepared to include: plotting of survey data;
establishment of profile grades; key map; plan and profile sheets (including
geometric calculations); typical section sheets; summary of quantities; summary
of drainage structures; cross-section sheets at 100' intervals (including earthwork
computations); signing and pavement marking plans; and other detail sheets
necessary to convey the intent of the scope of services outlined herein. All plans
shall be prepared in the English units.
Roadway set of plans shall consist of the following:
The Roadway plans will be submitted to the COUNTY for review at the 30%5
60%, 90% and 100% plan completion.
The scope of this work will require coordination with adjacent on-going

phasing and/or schedule of various County roadway projects, roadway transitions
may be required within the DESIGN LIMITS to tie to abutting roadway facilities,
E. Stormwater Design & Permitting
1. Perform drainage investigations and analysis necessary to prepare a design
which will drain the project in accordance with the City of Sebastian, St.
Johns River Water Management District (SJRWMD), Sebastian River Water
Control District (SRWCD), Army Corps of Engineers (ALOE) and/or Indian
River County design criteria.
2. The ENGINEER shall prepare stormwater permit applications for the
SJRWMD, SRWCD, ACOE and US Environmental Protection Agency (EPA)
requirements for submittal by the COUNTY. This will consist of all required
evaluation, design, coordination, and follow-up work necessary to support
permit applications. The COUNTY will review the permit applications as
necessary. The ENGINEER shall assemble and be responsible for the final
submittal.
3. The ENGINEER shall prepare permit sketches for submission by the
COUNTY to ACOE, and SJRWMD for dredge and fill activities, if necessary.
The ENGINEER shall submit all permit sketches on 8" x 11" sheets. Sketches
shall be neatly scaled, signed and sealed, and reproducible.
4. Environmental evaluations and/or biological summary reports necessary to
discern impacts to other surface waters, wetlands and/or endangered species
associated with contemplated alignments will be completed, if necessary.
Should mitigation plans be required to address delineated impacts a separate
agreement with the COUNTY will be provided as an additional service, or the
applicable COUNTY Department may design modifications with Department
Staff or other consultants.
5. Stormwater Design and Permitting will be performed and any cost savings,
should the COUNTY enter into a development agreement with adjacent
property owners that enables the COUNTY to utilize their lands for the
purpose of stormwater attenuation and water quality treatment, shall be passed
on to the COUNTY.
6. A Stormwater Pollution Prevention Plan (SWPPP) will be developed in
conjunction with this project. The site specific SWPPP is a requirement of
both the EPA National Pollutant Discharge Elimination System (NPDES)
General Permit for Stormwater Discharges from Construction Activities, and
the FDEP Generic Permit for Stormwater Discharges from Construction
Activities. Note: SJRWMD administers permit for FDEP.
G. Sienalization Plans
Signalization plans will be developed in conjunction with the roadway

improvements at the Schumann Drive/ Barber Street intersection. Mast -arm
signal configuration will be designed to meet current COUNTY and FDOT
standards.
H. Structure Headwall Desian
The ENGINEER shall prepare preliminary and final plans associated with the
culvert extension and headwall replacement associated with the cross drain
culvert located west of Schumann Drive under Barber Street.
Culvert plans will be prepared associated with the culvert located along
the east leg of Barber Street. The design and construction documents will
be prepared utilizing FDOT's LRFD Culvert Program.
2. Construction and material specifications will be based on FDOT Standard
Specifications for Road and Bridge Construction, 2007 Edition.
3. All design and plan details will be in the English unit system.
"SECTION V — COMPENSATION" is being modified to incorporate the following:
The COUNTY agrees to pay and the ENGINEER agrees to accept for services rendered
pursuant to this Agreement fees inclusive of expenses in accordance with the following:

"SECTION XVI — DURATION OF AGREEMENT" is being modified to incorporate the
following:
The time for completion of the 90% design drawings and permit applications for the
scope of services detailed in this amendment will be fifteen (15) months following receipt
of the notice to proceed from the COUNTY. Once permits and 90% design comments
are received from the COUNTY, 100% design drawings will be completed 30 days
thereafter.

The AGREEMENT
is hereby amended as specifically set
forth here in.
All other sections of the
AGREEMENT shall
remain in full force and effect and are incorporated
herein.
This Amendment No. 4 to the AGREEMENT regardless of where executed, shall be governed
by and construed by the laws of the State of Florida.
