In accordance with Contract No . 0390 This Work Order No . 7 is in accordance with the existing AGREEMENT dated September 23 , 2003 , and the extension thereof, between Kimley-Horn & Associates, Inc . (SURVEYOR) and Indian River County (COUNTY) . This Work Order No . 7 amends the agreement as follows : SECTION I — PROJECT LIMITS Oslo Road Phase I Right of Way Map — the SURVEY LIMITS shall begin at the FDOT baseline of US Highway No . 1 and continue westerly on Oslo Road to a point that is 100 ' west of 270' Avenue . SECTION II — SCOPE OF SERVICES The scope of services for this Work Order No . 7 is the preparation of a Right-of-Way Survey for that portion of Oslo Road lying between US Highway No . 1 and 27a' Avenue . The Right-of-Way Survey will be prepared in accordance with all sections hereon, attached exhibits "A" (Man hours/cost), ` B " (Check list) and Chapter 177 & Chapter 472 Florida Statutes and Chapter 61G17 (Florida Minimum Technical Standards) as set forth for these types of surveys and the County Right of Way Map Checklist (attached hereto as Exhibit "B ") , The Murphy Act Reservation lines as provided by Indian River County will be graphically depicted on the Right of Way Map . Coordination with capital projects and planning for any new or proposed right of way acquisitions will occur as part of the 60% County review. Revisions to the survey due to new or proposed right of way acquisitions will be made one ( 1 ) time, immediately after the 60% County review. Deliverables for the 60% County submittal will consist of digital and paper copies of the survey. Deliverables for the final submittal to the County will consist of a digital file and 1 signed/sealed mylar. SECTION III - TIME FOR COMPLETION/DELIVERABLES a) The 60% submittal will be delivered to the County for review and comments within 90 calendar days from Notice to Proceed. Final submittal will be delivered to the County within 60 calendar days of receipt of the 60% submittal comments . b) The SURVEYOR shall prepare its Work Product (Digital and paper versions) so that the COUNTY, consultants or the public can readily use it for design and analysis of the area defined. It shall contain all information necessary for a third-party surveyor to independently recreate and/or utilize the survey work. It is acknowledged that all final products become property of Indian River County and will be available for use by the public at large . c) The SURVEYORS work product shall meet or exceed the minimum standards as defined by Section II and exhibit "A" and "B " attached hereto and made part of this agreement, or the COUNTY will not approve the SURVEYORS request for payment. All and/or any additional services not described hereon shall be pre -approved by the COUNTY . Approved additional services shall be invoiced at the rates disclosed in the approved fee schedule with the SURVEYOR for the contract year of October 1 , 2004 through September 30 , 2005 . All invoicing and payments shall be accordance to original Professional Surveying Services Agreement for Annual Surveying and Mapping Services, contract No : 0390 with the COUNTY and as stated in Section III, IV hereon . The AGREEMENT is hereby amended as specifically set forth herein . All remaining sections of the AGREEMENT shall remain in full force and effect, and are incorporated herein .
