I have enclosed the following documents to clarify the location and legal description of the 60400t
parcel that Chris proposes to quitclaim to the County per the Settlement Agreement:
1 . Recorded Quitclaim Deed from Kirchoff to Fred Mensing,
2 . Recorded Quitclaim Deed from Fred Mensing to C.N. Kirrie Trust for Parcel 2.
3 . Portion of survey that Chris had prepared showing the relationship of the 60400t parcel to
his three (3 ) lots and 130th Street.
4. Legal description from the survey that describes the subject 60400tparcel.
When you review the enclosed documents,. you will see the relationship o f the subject 60-foot parcel
to Lots 28 , 29 and 30, as referenced in the legal description in my settlement letter, this is the deeded
description of the land that Chris received. I would not- say that Parcel2 is bounded by Lot 9, but that is what
Fred Mensing used on the Deed. Alan has moved to foreclose the Code Enforcement Lien using the same
legal description as in my. settlement. letter.
For settlement .purposes, I am , 2greeincluding the surveyed descriptiom along with the
description in the Quitclaim Deed that Chris received from 111:Fred Mensmg.

SUBJECT: Kime Settlement
C . N . Kirrie is a defendant in a Code Enforcement Board suit authorized to
foreclose a lien against various properties Mensing claims ownership to and for
an injunction to come into compliance with codes . Kinie is a defendant because
he acquired a certain strip of land which is subject to this suit.
Through his attorney, Warren Dill , Mr. Kirrie has proposed to be dismissed from
the . suit, convey whatever interest he has in these strips to the County if the
County can agree to certain terms as set out in the May 29 , 2003 letter from Mr.
Dill .
I have discussed each point with Mr. Dill and I believe they may be acceptable to
the Commission .
RECOMMENDATION :
Approve the settlement with Mr. Kirrie to simplify the lawsuit.

Dear Will:
This letter is in response to our meeting last Friday regarding the settlement of the above referenced
case .
The County has included Chris Kirrie in a foreclosure action against Fred Messing, because it
alleges that Chris acquired a 60400t strip of land from Fred Mensing after the County ' s Code Enforcement
Lien was recorded against Mr. Mensing. Chris is willing to settle this matter in accordance with the
following points:
1 . Christopher N. . j pie, as Trustee of the Christopher N. Kirrie Trust, dated June 20, 1995
will quitclaim all of his interest in the following described property to the County:
Parcel : 60 feet more or less X 3 30 feet more or less bounded by Lots 28 & 29 and
9 & 20 in A.A. BERRY' S Subdivision, as recorded in Official Records Book 1015 ,
Page 814, Public Records of Indian River County, Florida.

2 . The ounty acknoydedjes that upon conveyance of the Subject Property to the County that
Chris g_urte has no meals ^f a }.:� t 30t and that the County would not
subsequently attempt to force him to use 130' Street for access to the 14-acre tract that he
has purchased through C .W.N., LLC, a Florida Limited Liability Company from the
Sembler family described as follows:
Lots 16, 27 and 28 , less the Northwesterly 131 .91 feet of Lot 28 , Section 30,
Township 30 South, Range 38 East, FLEMING GRANT, according to the plat
thereof as: recorded in Plat Book 2, " Page 25, of the Public Records of Brevard
County, Florida, said lands now lying and being in Indian River County, Florida.
Also known as:
Lots ' 16, 27 and 28 , less the Northwesterly 131 .91' feet " of Lot 28 , FLEMING
GRANT, Section 30 , according to the Plat thereof filed in Plat Book 1 , Pages 72
and 73 , Public records of Brevard County, Florida; said lands now lying and being
in Indian River County, Florida.

3 . The County acknowledges that 1 91st Stree� t is a gub��ay which Chris Kirrie, as
the owner of the Kirrie Property is entitled to access either as an abutting land owner if the
60400t strips of land do not exist, or if the court determines that the 60400t strips of land
do exist, then the 60-foot strip of land lying between the Kirrie Property and the terminus
of , 129th Street can be crossed by Chris Kirrie to access 129th Street by virtue of an
easement granted to Chris Kirrie . See copy of Easement attached hereto . The County

crossingsaid intervening 60=foot strip of land if it is determined by the court that the 60-foot
strips of land do exist.
4. The County acknowledges that Chris Kirrie, as the owner of the Kirrie. Property is entitle
to receive an Indian River Countyht-of-way vermit, subject only to the standard 10
conditions tided in the it A�lication
5 , The County acknowle that the Kirrie Property is located within the City of Sebastian
and therefore is subject to its land development permitting requirements, including, but not
limited to site plan requirements and water and wastewater service. The County will not
atter to impose adv *Prt»TMpon the development of the Kirrie Propertyincent
with theme Cit�y permitting requirements.
This letter is written to advance settlement negotiations and its contents are inadmissible under
Section 90 .4.08 F.S . ; however, you are authorized to discuss this letter with your client at a public meeting.
