WITNESSETH that the said party of the first part, for and in consideration of the sum of Ten Dollars ($10.00) to it in hand paid by the party of the second part, receipt whereof is hereby acknowledged, has granted, bargained and sold to the party of the second part, its heirs and assigns forever, the following described land lying and being in Indian River County, Florida: See Exhibit "A" attached hereto IN WITNESS WHEREOF the said party of the first part has caused these presents to be executed in its name by its Board of County Commissioners, acting by the Chairman of said Board, the day and year aforesaid. COLONS It COUNTY ATTOR i=Y .0 The South '/Z of Tract 22 together with the South 95 feet of the North 1/2 of Tract 22, less the West 80 feet of the South 758.14 feet of Tract 22 and less the East 35 feet of the South 758.14 feet of Tract 22 all in the South '/z of Section 29, Township 32 South, Range 39 East, according to general plat of lands of the Indian River Farms Company Subdivision as filed in Plat Book 2, Page 25 of the Public Records of St. Lucie County, said land now lying and being in Indian River County, Florida and less the South 10 feet thereof. Subject to an easement for sidewalk, drainage and utility purposes on, over, across, and beneath the South 15 feet. RELEASE OF EASEMENT WHEREAS, on February 16, 2005 Craig Kovaleski and Carroll Stevens (now known as Carroll Kovaleski) granted an easement for sidewalk, drainage and utility purposes to Indian River County, Florida; said Easement being recorded in O.R. Book 1969, Page 907 of the Public Records of Indian River County, Florida; and WHEREAS, the legal description of said easement contained a scrivener's error resulting in the entire parent parcel being made subject to the easement; and WHEREAS, by a subsequent Corrective Easement, recorded in O.R. Book _, Page of the Public Records of Indian River County, Florida, Craig Kovaleski and Carroll Kovaleski (formerly known as Carroll Stevens) corrected the legal description to reflect the true intent; and WHEREAS, the Board of County Commissioners wishes to eliminate any cloud of title from the property not originally intended as an easement for sidewalk, drainage and utility purposes, NOW, THEREFORE, THIS RELEASE OF EASEMENT is executed on behalf of the Board of County Commissioners of Indian River County, a political subdivision of the State of Florida, whose mailing address is 1801 27Th Street, Vero Beach, Florida 32960, Grantor, to Craig Kovaleski and Carroll Stevens (now known as Carroll Kovaleski) 630037 th Street Vero Beach, FL 32966 their successors in interest, heirs and assigns, Grantee, as follows: Indian River County does hereby release and abandon all right, title, and interest that it may have in the following described easement: The South % of Tract 22 together with the South 95 feet of the North '/2 of Tract 22, less the West 80 feet of the South 758.14 feet of Tract 22 and less the East 35 feet of the South 758.14 feet of Tract 22 all in the South 1/2 of Section 29, Township 32 South, Range 39 East, according to general plat of lands of the Indian River Farms Company Subdivision as filed in Plat Book 2, Page 25 of the Public Records of St. Lucie County, said land now lying and being in Indian River County, Florida and less the South 25 feet thereof.
