This Agreement for Lease Extension ("Amendment") entered into on the 18th day
of November, 2008, by Indian River County, a political subdivision of the State of Florida,
1801 27th Street, Vero Beach, FL 32960 ("County"), and Donald R. and JoAnne M.
Staszewski, ("Tenant") whose address is 1940 58th Avenue, Vero Beach, FL 32966.
WITNESSETH:
The County purchased Tenant's property on April 17, 2008. The property contains
a two story structure and is 0.459 acres in size; and
WHEREAS, the purchase of the property was in lieu of eminent domain, as the
County is planning widening and improvements to the intersection of 58th Avenue and
State Road 60; and
WHEREAS, as part of the consideration for purchase of the property, the County
agreed to lease -back the property to Tenant until January 31, 2009; and
WHEREAS, the Tenant has requested an extension to the lease and the County is
not planning to begin road construction of the 58th Avenue/SR 60 project within that time;
and
WHEREAS, the County has no objection to extending its lease with Tenant for an
additional one year period,
NOW, THEREFORE, in consideration of the mutual terms and promises stated
herein, and other good and valuable consideration, the receipt and sufficiency of which is
hereby acknowledged, the County and Tenant agree as follows:
1. The foregoing recitals are true and incorporated as if fully restated herein.
2. The first and second paragraph of that certain Lease Agreement dated April 17
2008 is hereby amended to terminate on January 31, 2010,
3. In the event that the County needs access to the property prior to the termination
of this lease extension, the County shall notify the Tenants in writina and the
tenants shall have sixty (60) days to vacate the premises.
4. Except as amended herein, the terms and conditions of the Lease shall remain
in full force and effect. To the extent of any conflict between the terms of this
Amendment and the terms of the Lease, the terms of this Amendment shall
control.
