The Recipient represents that it is fully qualified and eligible to receive these grant funds to provide the <br /> services identified herein ; and <br /> 13 . The Department has received these grant funds from the State of Florida, and has the authority to <br /> subgrant these funds to the Recipient upon the terms and conditions below; and <br /> C . The Department has statutory authority to disburse the funds under this Agreement. <br /> THERF? FORE , the Department and the Recipient agree to the following : <br /> ( 1 ) SCOPEOF WORK <br /> The Recipient shall perform the work in accordance with the Budget and Scope of Work, Attachment A <br /> and Activity Work Plans, Attachment I of this Agreement, and the Sub-grant Application submitted by the Recipient <br /> including subsequent revisions that are mutually agreed to by both parties, which are incorporated herein by <br /> reference (" the Sub- grant Application ') . <br /> ( 2 ) INCORPORATION OF LAWS , RULES RE( ?ULATIONS AND POLICIFS <br /> The Recipient and the Department shall be governed by the 2008 State of Florida Action Plan Substantial <br /> Amendment and applicable State and Federal laws , rules and regulations, including those identified in Attachment <br /> 13 . <br /> ( 3 ) PERIOD OF AGREEMENT <br /> This Agreement shall begin upon execution by both parties, and shall end twenty - four (24 ) months after the <br /> date last signed , unless tenninated earlier in accordance with the provisions of Paragraph ( 12 ) of this Agreement . <br /> Contract extensions will not be granted unless Recipient is able to provide substantial justification and the Division <br /> Director approves such extension . Extensions will be in accordance with the guidelines established in the 2008 <br /> State of Florida Action Plan Substantial Amendment . <br /> ( 4 ) MODIFICATION OF CONTRACT <br /> Either party may request modification of the provisions of this Agreement . Changes which are agreed upon <br /> shall be valid only when in writing , signed by each of the parties, and attached to the original of this Agreement . <br /> Rev 07/31 /200 9 Page 1 <br />
