J. J. P. Hamilton appeared before the Board and filed a <br />Petition for abandoning easements in Winter Beach Estates Unit Two. <br />The County Engineer stated that there were no streets in this area. <br />Motion was made by Commissioner Macdonald, seconded by Commissioner <br />McCullers and unanimously carried, that the following Resolution be <br />adopted. <br />RESOLUTION <br />tHEREAS, J. J. P. HAMILTON has applied to the Board of.County <br />Commissioners of Indian River County, Florida at its regular meeting <br />on February 5, 1964 to vacate all of the rights-of-way, easements or <br />alleys as shown on the Plat and dedicated by the owner of Winter Beach <br />Estates, Unit Two, recorded in Plat Book 1, page 49, and Re -plat of <br />that part of J. J. P. Hamilton's and E. W. Hamilton's land recorded <br />in Plat Book 2, page 28, Indian River County Records insofar as the <br />same may exist on the West h of the Southwest 34 of the Southeast 34 <br />of Section 3, Township 32 South, Range 39 East, Indian River County, <br />Florida; said land being a part of Winter Beach Estates, Unit Two <br />and part of J. J. P. Hamilton's and E. W. Hamilton's land; and <br />WHEREAS, there was an apparent attempt in the replatting of <br />the J. J. P. Hamilton's and E. W. Hamilton's land which was recorded <br />in Plat Book 2, page 28 on February 10, 1934, to replat all of the <br />lands back to acreage and to do away with all streets, alleys, dedi- <br />cations, excepting, however, a road known as Winter Beach Bridge Road <br />(now known as North Winter Beach Road); and <br />WHEREAS, J. J. P. Hamilton has shown that he is the owner in <br />fee simple title to that property on which the easements, road rights- <br />of-way and alleys are sought to be released and vacated; and <br />WHEREAS, J. J. P. Hamilton has for many years maintained a <br />t <br />
