<br />RESOLUTION
<br />WHEREAS, by the provisions of Chapter 21310, Laws of Florida, Acts of 1941,
<br />authority is conferred on the Board of County Commissioners of Indian River County,
<br />Florida, and to establish districts within the unincorporated areas of said County and
<br />within such districts said Board is empowered to regulate and restrict the erection, con-
<br />. struction, reconstruction, alteration and repair of buildings on land and water and the use
<br />of land, buildings and structures for trade, industry, residence or other specific uses, to
<br />regulate and restrict the height, number'of stories and size of buildings and other structures
<br />on land and water, the percentage of land area that may be occupied, the size of yards,
<br />courts and other open spaces and the density of population, all for the purpose of promoting
<br />health, safety, morals or the general welfare; and,
<br />WHEREAS, pursuant to said authority, this Board adopts the regulations hereinafter
<br />set forth in accordance with the comprehensive plan and design to lessen congestion on the
<br />highways, to secure safety from fire, panic and other dangers, to promote health and the
<br />general welfare, to provide adequate light and air, to prevent the overcrowding of land and
<br />water, to avoid undue concentration of population, to facilitate the adequate provisions of
<br />transportation, water, sewage, parks and other requirements. These regulations are made
<br />after reasonable consideration being given, among other things, •to the character of the dis-
<br />trict and its peculiar suitability for particular uses and with a view to conserving the value
<br />of buildings and land and encouraging the most appropriate use of land and water throughout
<br />Indian River County, Florida; and,
<br />WHEREAS, this Board has availed itself of the powers conferred by said Act, by
<br />appointing a Zoning Commission composed of five members, which said Zoning Commission
<br />• has made a preliminary report recommending the boundaries of the various original districts
<br />and recommending appropriate regulations to be enforced therein and after the submission of
<br />said preliminary report by said Zoning Commission to this Board, said Zoning Commission
<br />did hold public hearings thereon and after such public hearings, said Zoning Commission did
<br />submit its final report, and,
<br />WHEREAS, after the submission of said final report by said Zoning Commission, this
<br />Board did publish notice thereof of a public hearing in relation thereto, at which parties in
<br />interest and citizens shall have an opportunity to be heard, which said notice was published
<br />at least fifteen days prior to the time of said public hearing; and,
<br />WHEREAS, this Board has held said public hearing as so published and has heard all.
<br />parties in interest and citizens appearing at said public hearing; and,
<br />WHEREAS, this Board has heretofore determined to exercise the powers conferred by
<br />this Act and has noticed the Governor of the State of Florida of such determination and the
<br />Gv ernor having appointed a County Board of Adjustment for Indian River County, Florida;
<br />and,
<br />WHEREAS, this Board has designated the County Engineer as the employee of this
<br />Board to enforce the provisions of said Act and of this Resolution and this Board has, by
<br />resolution, fixed the fees to be charged for issuing building and other permits required
<br />under the zoning regulations of this County, now, therefore,
<br />BE IT RESOLVED by the Board of Ct,unty' Commissioners of Indian River County,
