2 . CR512 Right-of-Way Acquisition : Currently, the right-of-way of CR512 directly <br /> adjacent to the Property is approximately 90 feet wide. DEVELOPER shall sell to <br /> COUNTY, as additional right-of-way along CR512 , a 0 . 5 acre strip of property directly <br /> adjacent to the southerly property line of the Property described in Exhibit " B " attached <br /> hereto and incorporated by reference herein. The right-of-way shall be conveyed by deed <br /> at the request of the COUNTY, but not later than March 15, 2006, at a cost to the <br /> COUNTY of $ 100,000. 00 per acre. <br /> 3 . Access Improvements : The COUNTY will include the following improvements as part <br /> of the CR512 expansion project to serve and benefit the Property: <br /> A. a full median access improvement (eastbound left-turn lane along CR512 to <br /> serve the "Eastern 512 Access Point" in a manner that will serve the number of trips <br /> necessary for the development of the Property) at a location approximately between <br /> Station 268+00 and 269+00 as indicated on the C.R. 512 Corridor Improvements (West <br /> of C .R. 510 to Roseland Road) Phase 3 (Indian River County plans — project number <br /> 9611 ) that is properly aligned with the driveway entrance road on the Property as depicted <br /> on the attached Exhibit "C " (the "Site Plan") to serve the proposed Commercial <br /> Development, the Residential Property and the property located to the east of the <br /> Commercial Development (the "Eastern 512 Access Point"). The COUNTY <br /> acknowledges that the Eastern 512 Access Point is not presently designed in an <br /> appropriate location, and agrees to modify the design of the Eastern 512 Access Point on <br /> its plans so that it properly aligns with the driveway entrance road for the Property as <br /> depicted on the Site Plan. The DEVELOPER acknowledges that the COUNTY will have <br /> to acquire additional property to complete the Eastern 512 Access Point. In order to <br /> acconunodate the traffic from the median access, the COUNTY shall permit a driveway <br /> connection from DEVELOPER ' S property to CR512 across COUNTY owned right-of- <br /> way land. The DEVELOPER shall pay $ 50,000. 00 towards the cost of the full median <br /> access improvement which shall be applied as a credit towards the amount owed by the <br /> COUNTY to the DEVELOPER hereunder. <br /> B. a stubout from its CR512 improvements for a right-tum in/right-turn out <br /> driveway connection to CR512 at a location at least 230' west of the aforementioned east <br /> 2 <br /> 1:\CENTURY\Sebastian\Indian River CounNTevelopment Agreement TC 030606.doc <br />
