property line driveway to be approved by the COUNTY (the "Western 512 Access <br /> Point") as depicted in the Site Plan. The COUNTY shall pay 100% of this improvement. <br /> C. a west-bound deceleration lane to serve the Eastern 512 Access Point. The <br /> design shall accommodate the residential and commercial development proposed for the <br /> Property as depicted on the Site Plan. The DEVELOPER shall pay 530,000. 00 towards <br /> the cost of the tum lane improvement which shall be applied as a credit towards the <br /> amount owed by the COUNTY to the DEVELOPER hereunder. <br /> D. All of the accesses and improvement locations addressed in this paragraph that <br /> are depicted in the attached Exhibit "C" are incorporated herein by reference and shall <br /> conform to Florida Department of Transportation Green Book specifications. <br /> 4. The DEVELOPER shall , on or before March 15, 2006, convey the 0. 983 acre parcel of <br /> property described in the attached Exhibit "D" incorporated herein by reference to the <br /> COUNTY for stonnwater wet detention storage required as part of the CR512 <br /> improvements ("Stonnwater Property"), at a cost to the COUNTY of $ 100,000. 00 per <br /> acre. The COUNTY will include the design, permitting and construction of this <br /> improvement as part of the CR512 expansion project. <br /> 5 . The COUNTY shall be given a dollar for dollar credit for the DEVELOPER ' S share of <br /> the costs of all improvements as set forth above, and said credit to be applied against the <br /> land purchase prices for the right-of-way and Stonnwater Property. Given the amounts <br /> set forth in this Agreement, the COUNTY owes the DEVELOPER 868 ,300 . 00 (the "Net <br /> Payment") . <br /> 6 . The COUNTY may either pay the Net Payment to the DEVELOPER in cash (which may <br /> include a County check, wire or electronic fund transfer) or provide payment in the form <br /> of transportation impact fee credits to the DEVELOPER. The impact fee credits shall be <br /> fully transferable by DEVELOPER. <br /> 7 . The DEVELOPER shall convey, without additional consideration, twenty (20) feet of <br /> right-of-way to the COUNTY, or the COUNTY' S designee, for the purpose of the <br /> development of the trail across the Property to be located, at DEVELOPER' S election, on <br /> either the southern or northern boundary of the Commercial Development proposed for <br /> 3 <br /> l:\CENTURY\Sebastian\Indian River County\Development Agreement TC 030606.dm <br />
