SEP 9 1665 <br />BOOK 9 PACE 3O2 <br />Upon the recommendation of the County Attorney and on Motion <br />by Commissioner Macdonald, seconded by Commissioner Haffield and <br />unanimously carried, a settlement of $3,450.00 ($3125 plus $325 Attorney <br />fee) for the right-of-way for West Wabasso Road, Parcel 137.1, owned <br />by Avesta S. Mowatt, et vir was approved. <br />The County Attorney reported that a Final Decree has been filed <br />in the case no. 6935, City of Vero Beach vs Homer C. Fletcher, as Tax <br />Assessor of Indian River County, et als., and that a petition for re- <br />hearing on the Final Decree has been filed. upon the recommendation <br />of the County Attorney, Motion was made by Commissioner Waddell, <br />fi <br />seconded by Commissioner McCullers and unanimously carried, that <br />the County Attorney be authorized to join the Attorney for the Tax <br />Assessor in an appeal of this suit in the event that the petition <br />,for re -hearing is denied; and further, that the Board• officially <br />request the•Indian River County School Board and all other taxing <br />districts of Indian River County to take similar action. <br />Motion was made by Commissioner Waddell, seconded by Commissioner <br />McCullers and unanimously carried that the Board request the Tax Collectors <br />office to investigate and take any action that is.feasible for the <br />collection of back taxes owed Indian River County by the Florida <br />East Coast Railway, and to pursue, if feasible,the same avenue of <br />collection that the City of Miami has taken. <br />The Deputy Clerk read for following letter and it was moved by <br />Commissioner Macdonald, seconded by Commissioner Waddell and unanimously <br />carried that Clerk be authorized to draw a warrant to Julian W. <br />Lowenstein, dated October 1, 1965, and turn it over to the County <br />Attorney: <br />
