SEP 9-1965 <br />BOOR 9 FACE 304 <br />RESOLUTION <br />WHEREAS, the Board of County Commissioners of Indian River County <br />are in the process of constructing North Winter Beach Road between <br />Rangeline and Ranch Road; and <br />WHEREAS, in conjunction with this construction, the Sebastian <br />River Drainage District, a political subdivision of the State of <br />Florida, is improving and widening their existing canal in this <br />same area; and <br />WHEREAS, the Board of County Commissioners has acquired a <br />certain right-of-way from Robert W. Newman and Jane Newman, his wife, <br />without compensation, described as the South 30 feet of the North <br />921 feet of the West 562.15 feet of the East 762.15 feet of Section 12, <br />Township 32 South, Range 38 East; being .4 of an acre, more or less, <br />which said deed is recorded in Official Record Book 216, page 137; and <br />WHEREAS, the right-of-way from Robert W. Newman and Jane Newman, <br />his wife as described does not properly line up with North Winter Beach <br />Road and the Sebastian River Drainage District requires the said right - <br />of -,way for the construction of their canal; and <br />WHEREAS, The Sebastian River Drainage District owns a right-of-way <br />which is described as the North 30 feet of the South 62.5 feet of the <br />East 629.72 feet of the SES of Section 1, Township 32South, Range 38 <br />East, would better suit the new road alignment; and <br />WHEREAS, the Sebastian River Drainage District has agreed to <br />exchange, without compensation, the rights-of-way as described above <br />as an easement to Indian River County, subject to the Sebastian River <br />Drainage District's paramount right to the use of this property for <br />the maintenance of thedrainage system owned by the Sebastian River <br />Drainage District; and <br />WHEREAS, the Board of County Commissioners are satisfied that the <br />above right-of-way acquired from Robert W. Newman and Jane Newman, his <br />wife, is required by the Sebastian River Drainage District and is not <br />needed for County purposes; <br />
