13 .2.2.4. 1 Nesting Activity. Monitoring seaturtle nesting activity shall <br /> be the responsibility of the COUNTY. If the project proceeds <br /> later than March 1 , a daily marine turtle nesting survey will <br /> be required to identify and possibly relocate any nests in the <br /> project area. Construction activity may not commence until <br /> the completion of the marine turtle survey each day. Nests <br /> may be present on the beach outside of the work area at the <br /> time of construction. The CONTRACTOR shall not allow <br /> equipment on the beach outside of the designated work area. <br /> 13 .2 .2.4.2 Oualitv Control . During dredging operations, the Sea Turtle <br /> Observer' s Reports shall be included in the Contractor' s <br /> Daily Quality Control Report. Any observations of dead, <br /> injured, or sick sea turtles shall be reported immediately to <br /> the Project Manager for the COUNTY at (772) 567-80005 <br /> EXT. 1568 and to the FDEP at 1 -800-DIAL IMP. <br /> 13 .2.2.4.3 Compaction Testing. The COUNTY shall be responsible for <br /> compaction testing according to FDEP Specific Condition <br /> 12(f) (Appendix B) . <br /> 13 .2 .2.4 .4 Escarpment Formations. The COUNTY shall be responsible <br /> for monitoring escarpment formations according to FDEP <br /> Specific Condition 12(g) (Appendix B). The <br /> CONTRACTOR shall be responsible for grading escarpments <br /> along the shoreline according to Section 31 of these Technical <br /> Specifications. <br /> 13 .2.2.5 Manatee Protection , The CONTRACTOR shall continuously monitor <br /> and manage all construction activities to minimize interference with, <br /> disturbance of, and damage to all fish and other marine life in the project <br /> area including manatees. The CONTRACTOR shall comply with all <br /> conditions of the Marine Mammal Protection Act of 1972, the <br /> Endangered Species Act of 1973 , and the Florida Manatee Sanctuary Act. <br /> There are civil and criminal penalties for harming, harassing or killing <br /> manatees. Any incidental harm caused to a manatee during dredging or <br /> construction operations must be reported immediately to the FWC at 1 - <br /> 888-404-FWCC, FWS at (772) 562-3909, and the COUNTY at (772) <br /> 567-8000, Ex . 1568 . The CONTRACTOR shall be liable for any non- <br /> compliance with these regulations by the CONTRACTOR'S personnel or <br /> subcontractors. <br /> 13 .2 . 2 . 6 Smalltooth Sawfish .
