The Dive Operations Plan is to include all the items specified in paragraph 30.A. 13 of EM 385- 1 - 1 . <br /> This plan shall contain information specific to the diving operations to be performed. <br /> Submission of the plan does not constitute an endorsement on the part of the COUNTY or <br /> ENGINEER that the CONTRACTOR's diving procedures are safe. The plan is intended to <br /> provide a method by which the CONTRACTOR demonstrates an awareness of, and proposed <br /> adherence to, Federal diving standards. <br /> 47 . DELAYS AND EXTENSIONS OF TIME <br /> 47 . 1 No Damages For Delay. The CONTRACTOR shall not be entitled to, and hereby waives, <br /> an increase in the Contract Sum, or payment or compensation of any kind from the <br /> COUNTY for direct, indirect, consequential, compensatory, impact, or other costs, <br /> expenses, or damages, including, but not limited to, lost profits, overhead (howsoever <br /> determined), increased insurance costs, loss ofbonding capacity, lost profits on alternate or <br /> unperformed contracts, or home office expense, which it may suffer by reason of delay, <br /> disruption, interference or hindrance from any cause whatsoever to the commencement, <br /> performance, or completion of the Work under this Contract, whether such delay, <br /> disruption, interference, or hindrance be reasonable or unreasonable, foreseeable or <br /> unforeseeable, or avoidable or unavoidable. The CONTRACTOR hereby acknowledges, <br /> agrees, and affirms that it shall be entitled to extensions of the Contract Time as the sole <br /> and exclusive remedy resulting from any such delay. <br /> 47.2 Notice of Delay . The CONTRACTOR must request the extension of time in writing and <br /> must provide the following information within the time periods stated hereinafter. Failure <br /> to submit such information, and in compliance with the time requirements hereinafter <br /> stated, shall constitute a waiver by the CONTRACTOR and a denial of the claim for <br /> extension of time: <br /> 1 . Nature of the delay or change in the Work; <br /> 2. Dates of commencement and cessation of the delay or change in the Work; <br /> 3 . Activities on the current progress schedule affected by the delay or change in the <br /> Work; <br /> 4. Identification and demonstration that the delay or change in Work affects the <br /> progress schedule; <br /> 5 . Identification of the source of delay or change in the Work; <br /> 6. Anticipated extent of the delay or change in the Work; and <br /> 7. Recommended action to minimize the delay. <br /> 47.3 Time of Notice. The CONTRACTOR shall not be entitled to any extension of time for <br /> delays resulting from any cause unless it shall have notified the COUNTY and the <br /> ENGINEER in writing within twenty-four (24) hours after the commencement of such <br /> delay or 96 hours of knowledge of a potential delay, whichever is earlier. In any event, <br /> within five (5) calendar days of commencement of the delay, the CONTRACTOR shall <br /> provide in writing the information set forth herein above. <br /> TECHNICAL AND ENVIRONMENTAL SPECIFICATIONS Rev October 5. 2007 TS-51 <br />
