t � 44W09 <br /> AMENDMENT AND EXTENSION TO AGREEMENT <br /> This AMENDMENT TO GRAND HARBOR SPOONBILL MARSH BENTHIC <br /> INVERTEBRATE ASSESSMENT AND MONITORING AGREEMENT ("Amendment" ) is entered <br /> into as of this 6th day of pc: t _, 2009 (" Effective Date" ) , by and between INDIAN RIVER <br /> COUNTY , a political subdivision of the State of Florida ("County" ) and FLORIDA ATLANTIC <br /> UNIVERSITY C/O HARBOR BRANCH OCEANOGRAPHIC INSTITUTE ("Consultant" ) . <br /> BACKGROUND RECITALS <br /> A . Effective July 15 , 2008 , the County and the Consultant entered into the GRAND HARBOR <br /> SPOONBILL MARSH BENTHIC INVERTEBRATE ASSESSMENT AND MONITORING <br /> ( "Agreement" ) for the provision of wetlands maintenance services as set forth therein . <br /> B . Pursuant to the Agreement , the County may request that the Consultant perform additional <br /> services under the Agreement . <br /> C . Further , the County and the Consultant desire to extend the term of the Agreement as set forth <br /> in attached Proposed Expanded Scope of Work dated September 15 , 2009 . <br /> NOW THEREFORE , for good and valuable consideration , the receipt and sufficiency of <br /> which is hereby acknowledged , the parties agree as follows : <br /> 1 . The background recitals are true and correct , and form a material part of this Agreement . <br /> 2 . From and after the Effective Date of this Amendment , the Agreement is amended to include the <br /> Services as more specifically set forth in Exhibit 1 , for the price set forth in Exhibit 1 . <br /> 3 . From and after the Effective Date of this Amendment , the term of this Agreement is extended <br /> through December 31 , 2010 . <br /> 4 .
