Failure on the part of the successful bidder to execute a contract within fifteen (15 ) days after <br /> the notice of acceptance shall be just cause for annulment of award. The OWNER may then <br /> accept the bid of the next best- evaluated bid or re-advertise for bid . If the bid of the next <br /> bidder is accepted, this acceptance shall bind such bidder as though he were the original <br /> successful bidder. <br /> For and in consideration of the County considering Bids submitted, the Bidder, by submitting <br /> its Bid, expressly waives any claim to damages, of any kind whatsoever, in the event the <br /> County exercises its right to cancel the award in accordance herewith. Furthermore, the <br /> ,. County reserves the right : to omit in its entirety any one or more items of the Work without <br /> forfeiture of the Contract or claims for loss of anticipated profits or any claims by the <br /> successful Bidder as Contractor on account of such omission; and to add to the construction of <br /> any portion of the Work shown on the Specifications . <br /> 8 . ACCEPTANCE OF OFFER <br /> The signed bid shall be considered an offer on the part of the bidder; such offer shall be <br /> deemed accepted upon completion of all steps in the purchasing process and issuance by the <br /> County of a contractual document. <br /> 9 . PERFORMANCE <br /> All material and parts shall be bid F . O . B . Destination, at the job site . <br /> a <br /> L" 10. ADDENDA and REQUESTS FOR INFORMATION (RFI) <br /> Addenda issued by OWNER prior to the bid opening shall be binding as if written into the <br /> specifications . Bidders shall acknowledge receipt of the same as indicated on the bid form . <br /> All questions about the meaning or intent of the Bidding Documents are to be submitted to <br /> ENGINEER in writing. Interpretations or clarifications considered necessary by OWNER <br /> or ENGINEER in response to such questions will be issued by Addenda mailed or delivered to <br /> all parties through the Issuing Office as having received the Bidding Documents. Questions <br /> received less than ten days prior to the date for opening of Bids may not be answered. Only <br /> questions answered by Addenda will be binding. Oral and other interpretations or <br /> clarifications will be without legal effect. <br /> 11 . PUBLIC ENTITY CRIMES <br /> Pursuant to Florida Statutes Section 287 . 133 (2) ( a) , all Bidders are hereby notified that a <br /> person or affiliate who has been placed on the convicted vendor list following a conviction for <br /> a public entity crime may not submit a bid, proposal, or reply on a contract to provide any <br /> goods or services to a public entity; may not submit a bid, proposal, or reply on a contract <br /> with a public entity for the construction or repair of a public building or public work; may not <br /> submit bids, proposals, or replies on leases of real property to a public entity; may not be <br /> awarded or perform work as a contractor, supplier, subcontractor, or consultant under a <br /> contract with any public entity; and may not transact business with any public entity in excess <br /> of the threshold amount provided in Florida Statutes Section 287 . 017 for CATEGORY TWO <br /> I�. <br /> Page 8 of 55 <br />
