s <br /> GENERAL CONDITIONS <br /> 1 . RESPONSIBILITIES OF THE CONTRACTOR <br /> Performance : The CONTRACTOR shall perform all authorized work contracted for by the <br /> OWNER promptly and diligently in a good, proper and workmanlike manner in accordance <br /> with these Specifications . The CONTRACTOR, in doing the work, shall have the freedom to <br /> perform the authorized work by such means and in such a manner as he may choose within <br /> the limits of these Specifications . Employees of the CONTRACTOR shall not be deemed <br /> employees of the OWNER for any purposes whatsoever. <br /> Materials, Services and Facilitiles : The CONTRACTOR shall provide and pay for all labor, <br /> tools, equipment, utilities , transportation and materials and these shall be of a high quality in <br /> every respect . The CONTRACTOR'S employees shall be as clean and in good appearance as <br /> the job conditions permit and shall conduct themselves in an industrious and courteous <br /> + manner. Modern tools kept in good working order shall be utilized. Adequate first aid <br /> supplies shall be provided by the CONTRACTOR and shall be accessible to the employees . <br /> Subcontractor : The CONTRACTOR may utilize service or specialty SUBCONTRACTORS <br /> on those parts of the work, which under normal contracting practices, are performed by <br /> specialty SUBCONTRACTORS . The following provisions shall apply: <br /> 1r <br /> The CONTRACTOR shall notify the OWNER in writing of any Subcontractor that is <br /> to be utilized. CONTRACTOR shall not employ any Subcontractor, Supplier or other <br /> person or organization , ( including those who are to furnish the principal items of <br /> materials or equipment) , whether initially or as a substitute , against whom Owner may <br /> have reasonable objection . Acceptance of any Subcontractor, Supplier or other <br /> person or organization by Owner shall not constitute a waiver of any right of Owner to <br /> reject defective Work . Contractor shall not be required to employ any Subcontractor, <br /> Supplier or other person or organization against whom Contractor has reasonable <br /> objection . The CONTRACTOR shall perform at least 51 % of the work with its own <br /> forces . <br /> CONTRACTOR shall be fully responsible to OWNER and ENGINEER for all acts and <br /> omissions of the Subcontractors , Suppliers , and other individuals or entities <br /> performing or furnishing any of the Work just as CONTRACTOR is responsible for <br /> CONTRACTOR' s own acts and omissions . Nothing in the Contract: ( a ) shall create <br /> for the benefit of any such Subcontractor, Supplier, or other individual or entity any <br /> contractual relationship between Owner or Engineer and any such Subcontractor, <br /> Supplier or other individual or entity; nor (b) . shall anything in the Contract create any <br /> obligation on the part of OWNER or ENGINEER to pay or to see to the payment of <br /> any moneys due any such Subcontractor, Supplier, or other individual or entity except <br /> as may otherwise be required by applicable Florida law . <br /> CONTRACTOR shall be solely responsible for scheduling and coordinating the Work <br /> of Subcontractors , Suppliers , and other individuals or entities performing or furnishing <br /> any of the Work under a direct or indirect contract with CONTRACTOR. <br /> Page 10 of 55 <br />
