• <br />Mr. Jennings reported that his Department has started preparing <br />the site for this construction and asked the Board decision on the <br />disposition of our palm trees which must be removed. It was the opinion <br />of the Board to offer them to the Garden Club or the City of. Vero Beach, <br />if they will move them. <br />The matter of title encroachment between Mr.. Norman Zaph and <br />the county -owned stump dump property on Kingsberry Road, (Tract 13, <br />Section 18, Twp 32s, Range 39 E¢,) was discussed and'tef"erded to the <br />County Attorney for study and recommendation. <br />Motion was made.by Commissioner Waddell, seconded by Commissioner <br />McCullers and carried, that the service contract with D & J Sheet Metal <br />Company for serviciing:all air conditioning units in the Courthouse once <br />a month, $40,00 a month, be renewed for the period of one year. <br />The County Attorney presented Crossing agreements between the <br />Florida -East Coast Railway Company and Indian River County for the <br />i <br />middle crossing in Gifford and the 4th Place crossing. Upon Motion <br />by Commissioner Waddell, seconded by Commissioner Haffield, the agreements <br />were approved and the following Resolution unanimously adopted as to <br />each agreement: <br />RESOLUT1.ONyNOe . 40.` . <br />Upon motion duly jnade and seconded,:the following Resolution was:,,a <br />passed and adopted: ". <br />BE IT RESOLVED, by.,theBoard of County Commissioners in and.for <br />Indian River County; a'politioal subdivision of the State of Florida, as <br />follows: <br />1. That the Board .of County Commissioners ire and for Indian River.' <br />County does hereby oontract and agree to enter into an agreement with the <br />v. . <br />Florida East Coast Railway Company wherein and whereby said Board pf <br />Commissioners will shareequally with the Railway the expense for install- <br />ing automatic crossingsignal.proteotion and is given the right and privilege' <br />,:•.to use and maintain as a crossing for road crossing purposes'. that portion o•f <br />the rightof way of the Railway in Indian River; County, Florida, as more; <br />.particularly described in License Agreement attached hereto and made a part <br />hereof. <br />- County.Commissioners in and <br />for Indian.River County. with the attestation of the:clerk of said board, be <br />• <br />-:and they hereby are' each :authorized and directed to: execute said agreement';-'< <br />.for 'and on .behalf of said Indian River County.. <br />3.
