If substantial completion is not obtained at the inspection called by Contractor, for reasons which are <br /> the fault of Contractor, any additional cost to Owner for the Engineer or design professional for any <br /> subsequent inspections for the purpose of determining substantial completion shall be the responsibility of the <br /> Contractor and shall be assessed against the final payment application . <br /> GC 41 FINAL INSPECTION AND ACCEPTANCE <br /> The following items shall be completed as a condition precedent to a request by Contractor for final <br /> inspection : <br /> 1 . Completion of all punch list items recorded from the substantial completion inspection . <br /> 2 . A complete set of mylar or paper marked-up as-builts with "RECORD" or "AS BUILT" clearly <br /> printed on each sheet along with one copy on AutoCAD CD Release 14 or better on State Plane Coordinates . <br /> Contractor shall accurately and neatly transfer all deviations from progress as-builts to final as-builts . As-built <br /> records shall include drawings signed and sealed by a registered land surveyor certifying the elevation and <br /> location of improvements . Certified drawings are to show locations, lines and grade of buried pipe line four (4) <br /> inches or larger in diameter and exterior to buildings , and other buried facilities (e .g . valves , tanks , vaults , <br /> storm inlets , ducts , etc . ) installed or discovered as a result of the work. Certified drawings are to show building <br /> corners , sidewalks , paved areas and the location of all above ground structures within the project site . <br /> Contractor shall sign each final record drawing and note thereon that the final as-builts are complete and <br /> accurate . <br /> 3 . A complete set of marked-up specifications with " RECORD" or "AS-BUILT' clearly printed on <br /> the cover . Contractor shall accurately and neatly transfer all deviations from progress specifications to final <br /> as-builts . <br /> 4 . A signed and notarized affidavit indicating that no asbestos containing materials were used or <br /> installed during the course of the work . <br /> 5 . A list of each piece of equipment having an individual value of $500 or greater. The list shall <br /> include , at a minimum , the name , make and model number, quantity installed , value of equipment. <br /> Contractor shall inform Owner in writing that work is ready for final inspection . The Engineer will , <br /> within five (5 ) business days , make such inspection . When Engineer finds the work acceptable under the <br /> Contract and all contract terms and conditions fully performed , Engineer shall issue a Final Certification to <br /> Owner . <br /> GC 42 EXTENSION OF TIME . <br /> The time limit for the completion of the work as described in the Contract is of the essence of this <br /> Contract. Contractor must request an extension of the contract completion date in writing and must provide <br /> the following information within seven (7 ) days of commencement of the delay. Contractor acknowledges that <br /> the evaluation of time extensions will be based on the following information : <br /> 1 . All schedule updates , submittals and other conditions of the Contract have been met; <br /> 2 . The delay is beyond the control of the Contractor and subcontractors and due to no <br /> direct or indirect fault of the Contractor. <br /> 3 . Nature of the delay . <br /> 4 . Dates of commencement / and end of delay. <br /> 5 . Evidence that the delayed work results in a direct delay to the schedule critical path . <br /> 6 . List of tasks/work affected by the delay. <br /> 7 . Anticipated extent of delay. <br /> 8 . Recommended action to minimize delay. <br /> 9 . The Contractor has used all the float time available for the work involved in the delay <br /> request. <br /> Time extensions for weather delays will only be considered if all float time is exhausted prior to the weather <br /> occurrence . Failure of Contractor to timely request a time extension constitutes a waiver by Contractor and a <br /> denial of a time extension . <br /> If the Contractor is delayed at any time in the progress of the work by any act or neglect of the Owner, or if any <br /> employee of the Owner or by any separate Contractor employed by the Owner or by any changes ordered in <br /> 40 <br /> F :\Engineering\Capital Projects\0216- 12th Street Between 16th Avenue and 1 lth Place\0216 Federal Contract <br /> Provisions . doc a29rXW 3.06.25 PM <br />
